Description/Analysis
Issue Detail: Pursuant to the California Surplus Land Act (California Government Code § 54220 et seq.), the City Council must declare property as either “surplus land” or “exempt surplus land” before the City can dispose of it or participate in negotiations to dispose. “Surplus land” is real property owned in fee simple that is not necessary for the City’s use.

The purpose of the Resolution is to formally declare the property located at 2225 Colfax Street (the “Property”) to be surplus land in compliance with the Surplus Land Act.

The Property is a vacant parcel of land approximately 2.17 acres in size. It was originally acquired by the City of North Sacramento, and upon annexation of North Sacramento into the City of Sacramento in 1965, ownership automatically transferred to the City. The Property was utilized as a corporation yard until approximately 2001 and was recently the location of Camp Resolution.

Staff have consulted with the various City departments and determined that the Property is not necessary for City’s use and is not designated for any current or future City projects.

California Environmental Quality Act (CEQA): The City Council declaration that a parcel is surplus land is in compliance with a statutory requirement and is not part of a project that has been identified, designed, or funded. No physical change in the environment would occur. The action is an administrative activity that would not result in direct or indirect physical changes in the environment and is not a project as defined in CEQA. (CEQA Guidelines section 15378(b) (2); 15060(c)(3)).

Sustainability: Not applicable.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: The Surplus Land Act requires the City Council to declare property as “surplus land” supported by written findings before any action can be taken to dispose of the property. Adoption of the Resolution by the City Council will allow for possible sale of the Property in accordance with the requirements of the Surplus Land Act. Before disposing of the Property or participating in negotiations to dispose of the Property, the City will send a written notice of availability to certain designated entities and complete all other actions required under the Surplus Land Act.

Financial Considerations: Not applicable.
