Description/Analysis
Issue Detail: The Storm Drainage Property Fee was established through a voter -approved ballot measure in April 2022 to support a DOU Storm Drainage CIP and the associated operating costs. In June 2022, a lawsuit was filed against the City that challenged the cons titutionality of the measure.
DOU continued collecting the new fee but did not spend the proceeds until there were developments in the litigation. The City received a favorable judgement on December 22, 2023, that has since been appealed and is still pending. On the recommendation of the City Attorney’s Office (CAO), DOU will reserve one year of revenue in the Storm Drainage Property Fee Fund (Fund 6021) of approximately $20 million. The remaining revenues have been releas ed for spending. Currently, there is approximately $17.4 million in the approved CIP and MYOPs for projects. FY2024/25 revenues will be

released every six months. Future year revenues will be released per the approved budget at six- month intervals until the litigation is resolved.
As part of the adoption of the fee, approved by ratepayers, DOU promised that the funding associated with the new fee would be used to implement a DOU Storm Drainage CIP and pay the associated operating costs including, but not limited to:
• Repairing aging storm drainage and combined sewer pipelines and other infrastructure. • Replacement of aging and deteriorating pumps to prevent flooding; • Protection of local water quality and water supplies; • Keeping trash and harmful chemicals out of the American and Sacramento rivers and local creeks;
• Preventing sewage and human waste from flooding City streets; and • Providing safe, clean water for future droughts and emergencies.
For DOU to deliver on its promise to rate payers, the FTE and equipment included in the rate planning process need to be included in the approved budget. The positions will be filled as projects warrant additional staff. Adding the positions and vehicles per the rate planning process, will ensure that projects move forward in a timely manner.
Policy Considerations: Not Applicable.
Economic Impacts: Not applicable.
Environmental Considerations: It has been determined that the proposed activity is not a project pursuant to the California Environmental Quality Act (CEQA) Guidelines Section 15378(b)(2 and 4).
The activities described in this report are continuing administrative or maintenance activities, such as purchases and personnel-related activities, and government fiscal activities and are not subject to CEQA [CEQA Guidelines Section 15060(c)(3)].
Sustainability: Not applicable.
Commission/Committee Action: Not applicable.
Rationale for Recommendation: DOU has moved forward with spending the Storm Drainage Property Fee revenues to support the Storm Drainage CIP and the related operating costs; however, it is not attainable at the current staffing levels. The approved rates included the addition of 25 FTEs starting in FY2023/24. The three positions for FY2023/24 were included in the adopted budget but have been on hold due to the litigation. Below is a table that summarizes the initially planned FTEs by classification by fiscal year followed by the Department ID and program.

During FY2024/25 budget development, DOU was asked to request the Storm Drainage positions through a stand-alone council report rather than submitting them during the budget process. DOU is now requesting that the City Council authorize a modified proposed FTE request that includes 10 of the 12 planned positions from FY2024/25. The remaining positions will be requested in the applicable fiscal year budget development process. Future FTE and equipment needs could change in classification and type as programs are being developed, but DOU will remain within the estimated funding presented to the rate payers. Below is a table that summarizes the modified proposed FTE by classification and fiscal year followed by the Department ID and program.

All of the associated vehicles for new staff were originally planned to be purchased in FY2024/25. One VacCon and one Closed Circuit Television Vehicle (CCTV) were requested and approved through Resolution #R2024-0238 in July 2024. These costs are one-time impacts with minimal ongoing expenses. Replacements for these units will be budgeted for in the applicable fiscal year. DOU is now requesting that the City Council authorize a modified proposed vehicle request that delays the purchases of the required vehicles to coincide with the same fiscal year the proposed FTEs are requested.

Financial Considerations: Positions are considered an associated operating expense and will be included in the Storm Drainage Fund (Fund 6011), with CIP offsets or interfund reimbursements from the Storm Drainage Property Fee Fund (Fund 6021). Due to the timing of the recruitments for these positions, the CIP offsets or interfund reimbursement budgets will be included in the FY2025/26 budget or applicable fiscal year.
