Description/Analysis
Issue Detail: The City operates its Permanent Household Hazardous Waste Collection Facility (PHHWCF) at the Sacramento Recycling and Transfer Station, located at 8491 Fruitridge Road, where residents may drop off household hazardous waste (e.g., antifreeze, batteries, bulbs, oil, and paint) at no charge. CalRecycle administers the Household Hazardous Waste (HHW) Discretionary Grant Program to provide funding to local jurisdictions to improve HHW collection facilities and enhance HHW collection programs. The Department of Public Works, Recycling and Solid Waste Division (RSW) sought this grant funding during Cycle 41 to fund the repair and resurfacing of the flooring in the PHHWCF building with chemical-resistant epoxy sealant. CalRecycle requires an applicant’s governing body to adopt a resolution authorizing the local jurisdiction to apply for the grant payment program.
File ID: 2024-01930 12/3/2024 Consent Item 7.
On September 5, 2023, City Council adopted Resolution 2023-0281, authorizing the Department of Public Works on behalf of the City to apply for this grant in a not-to-exceed amount of $49,545. The submitted application was then completed by RSW on September 12, 2023. On February 5, 2024, CalRecycle awarded the grant to the City. Between April 7, 2024, and April 15, 2024, the PHHWCF floors were repaired and resurfaced by QuestMark Flooring.
During the grant request process on October 9, 2024, CalRecycle informed RSW that Resolution 2023-0281 needed to be renewed and extended due to the Resolution not specifying a period of time during which its authorizations are valid. Absent a time frame contained in the Resolution, CalRecycle deems any authorizations given by an applicant’s governing body to be valid only for one year. An amended Resolution specifying a period of valid authorization must be adopted to have the grant funding disbursed to the City. Staff is bringing forth this Amended Resolution to Resolution 2023 -0281 to extend its authorizations through September 5, 2028.
Policy Considerations: The recommendations in this report are consistent with the City’s Climate Action and Adaption Plan goal A-1-4:
Resilient City Facilities - Evaluate and prioritize climate vulnerabilities in City facilities and infrastructure and establish a coordinated plan for the pursuit of related grants across City departments.
Economic Impacts: None.
Environmental Considerations:
California Environmental Quality Act (CEQA): No environmental review is necessary because the recommendations in this report involve the administrative activity of applying for grant funding and are not considered to be a project in accordance with Section 15378(b)(2) of the CEQA Guidelines.
Sustainability: Facility improvements to the PHHWCF will ensure that it will continue to operate in a safe and clean manner and have the capacity to process and store waste it receives from the public.
Commission/Committee Action: None.
Rationale for Recommendation: CalRecycle’s grant application procedures require the applicant’s governing body to adopt a resolution specifying a period of time authorizing submission of the application and payment of the grant, if awarded. Amending Resolution 2023-0281 is needed to specify that the resolution is valid through September 5, 2028, in order for CalRecycle to issue the final grant payment.
File ID: 2024-01930 12/3/2024 Consent Item 7.
Financial Considerations: This report recommends adopting this amended Resolution to meet the requirements of the CalRecycle Household Hazardous Waste Grant Program - Cycle 41. This amended Resolution will allow CalRecycle to issue a reimbursement payment to the City in an amount of $49,545 to the PHHWCF HD41 Resurfacing Floor Project (Y14000911, Other Capital Grants, Fund 3407).
Local Business Enterprise (LBE): Not applicable.
RESOLUTION NO. 2024-
Adopted by the Sacramento City Council
December 3, 2024
Amend Resolution No. 2023-0281 for California Department of Resources Recycling and Recovery (CalRecycle) Household Hazardous Waste Grant Program – Cycle 41 (Y14000900)
BACKGROUND
A. The City of Sacramento accepts household hazardous waste for disposal at the Permanent Household Hazardous Waste Collection Facility (PHHWCF), located at 8491 Fruitridge Road. The improper disposal of household hazardous waste is costly, environmentally hazardous, and in violation of state law.
B. On September 5, 2023, City Council adopted Resolution No. 2023-0281 which authorized the City Manager or City Manager’s designee to:
1. Submit an application for the California Department of Resources Recycling and Recovery (CalRecycle) Household Hazardous Waste Discretionary Grant Program (HD41: FY24) in an amount not to exceed $49,595; and
2. Execute all documents necessary to implement and secure such payment, if awarded; and
3. Establish a Household Hazardous Waste Discretionary Grant Program (HD41:
FY24) Solid Waste Facility Repair and Rehab Project (Y14000911) and related revenue and expenditure budgets in an amount not to exceed $49,545 (Solid Waste Fund, Fund 6007), if awarded, to resurfacing the floors of the City of Sacramento’s Permanent Household Hazardous Waste Collection Facility.
C. Following the adoption of Resolution 2023-0281, the City Manager’s designee submitted an application to CalRecycle seeking funding in a not-to-exceed amount of $49,545 for the Household Hazardous Waste Discretionary Grant Program.
D. CalRecycle subsequently informed the City that the application had been reviewed and accepted, and the City of Sacramento Department of Public Works, Recycling and Solid Waste Division (RSW) had been awarded funding as part of the Household Hazardous Waste Discretionary Grant Program.
E. The grant application guidelines and instructions stated that if a Resolution does not identify a duration of time for authorization, CalRecycle will consider the Resolution valid for one year from the date of adoption. Resolution 2023-0281 was adopted on September 5, 2023, without specifying a length of time that the authorizations were to be valid. On October 9, 2024, CalRecycle informed RSW that the Resolution needed to be amended to continue with participation in the Household Hazardous Waste Discretionary Grant No. HD41-23-0017.
F. Section 2 of Resolution 2023-0281, authorizing the City Manager or the City Manager’s designee to execute all documents necessary to implement and secure payment, needs to be amended so that authorization remains effective through September 5, 2028.
G. Section 3 of Resolution 2023-0281, authorizing the City Manager or the City Manager’s designee to establish revenue and expenditure budgets in an amount not-to-exceed $49,545 in the Solid Waste Repair and Rehabilitation Project (Y14000900), needs to be amended so that authorization remains effective through September 5, 2028.
BASED ON THE FACTS SET FORTH IN THE BACKGROUND, THE CITY COUNCIL RESOLVES AS FOLLOWS:
Section 1. Section 2 of Resolution 2023-0281 is hereby amended to read as follows: The City Manager or the City Manager’s designee is authorized to execute all documents necessary to implement and secure payment until September 5, 2028.
Section 2. Section 3 of Resolution 2023-0281 is hereby amended to read as follows: The City Manager or the City Manager’s designee is authorized to establish revenue and expenditure budgets in an amount not-to-to-exceed $49,545 in the Solid Waste Repair and Rehabilitation Project (Y14000900) until September 5, 2028.
Section 3. Except as amended in Section 1 and Section 2 above, all other sections in Resolution 2023-0281 shall remain the same and in full force and effect.
