Description/Analysis
Issue Detail: Staff has prepared three ordinances that amend the Planning and Development Code (Title 17 of the City Code). Title 17 is the primary means by which the City’s land use policy is implemented. When considering and acting upon proposed amendments to Title 17 of the City Code, City Council is to consider two findings:
1. As amended, this title complements, supports, and facilitates the implementation of the goals, policies, and other provisions of the general plan and the City’s specific plans and transit village plans; and
2. The amendment promotes the public health, safety, convenience, and welfare of the City.
The proposed amendments set forth in the ordinances fall into three categories:
1. State Law Consistency: These amendments respond to planning and zoning laws passed during the 2023 state legislative session.
2. Streamlining: These amendments refine existing regulations without establishing a fundamental new policy.
3. Administrative Cleanup: These amendments correct typographical errors.
A detailed explanation of proposed amendments is provided in the Background section of this report.
Amendments to portions of the City Code outside Title 17 also concern planning and development topics. Amendments to Title 15 concern correcting a typographical error in sign standards.
Policy Considerations: The proposed ordinances do not replace continued work in 2024 and 2025 to fully align Title 17 of the City Code with the 2040 General Plan, nor are they intended to implement specific General Plan policies. Rather, the ordinances seek to make pragmatic changes that results in a Planning and Development Code that is accurate (e.g., no typographical errors), consistent with State law (e.g., passed in 2023), and one that refines the implementation of certain policies in a manner consistent with the General Plan. Additionally, the density bonus ordinance fulfills Housing Element Program H16 by updating the ordinance for consistency with State Law.
The ordinances include amendments that advance the following goals and policies of the 2040 General Plan:
File ID: 2024-01742 12/3/2024 Consent Item 14.
Land Use Element
Goal LUP-1: A compact urban footprint and sustainable development pattern with infrastructure that supports efficient delivery of public services while protecting surrounding open space lands.
Goal LUP-2: Balanced and connected community with thriving neighborhoods and centers and development intensities linked to transit.
Goal LUP-3: Flexible development standards to promote revitalization in corridors and centers.
Staff Analysis: Orderly and well-planned development cannot be easily achieved without accurate and clear regulations. The ordinances provide for clearer regulations, consistency with new state laws, correct typographical errors, and streamline existing rules to better implement existing policies. In doing so, the ordinances help staff and code users maintain focus on achieving the policy goal rather than be distracted by questions about inaccuracies, inconsistencies (e.g., with state law), or burdened with cumbersome processes that achieve the same goal with more effort and cost.
Housing Element
Policy H-2.3.2: Streamlined Application and Building Process. The City shall continue to facilitate interdepartmental review of development applications, encourage pre-application meetings with planning and building staff, and streamline the overall planning application and building process for all development types.
Policy H-2.3.5: Clear Development Standards and Approval Procedures. The City shall maintain and administer clear development standards, and approval procedures for a variety of housing types, including, but not limited to, multifamily housing and emergency shelters.
Staff Analysis: For the reasons stated in the staff analysis above, the ordinance advances Policy H-2.3.2. On the topic of housing, the ordinance includes important clarifications (e.g., accessory dwelling units, state density bonus law) and streamlining changes in furtherance of Policy H-2.3.5.
Economic Impacts: None.
Environmental Considerations: The Community Development Department, Environmental Planning Services Section has determined, pursuant to California Environmental Quality Act (CEQA)
File ID: 2024-01742 12/3/2024 Consent Item 14.
Guidelines Sections 15060(c)(3), 15061(b)(3), and 15378(b)(5), that the proposed omnibus, rezone, and density bonus ordinances are exempt from CEQA. These ordinances consist of amendments to Title 17 to conform to existing state law, streamline the development process, and fix typographical errors. None of these amendments will result in direct or indirect physical changes in the environment and as such the ordinance is exempt from CEQA review.
Sustainability: The proposed ordinances include amendments that help to make zoning standards easier to understand and implement. This will help facilitate development in the City in a manner consistent with existing policy, including that relating to sustainability.
Commission/Committee Action: The following actions were taken to initiate the proposed amendments to Titles 15 and 17 of the City Code:
· On August 22, 2024, the Planning and Design Commission initiated, pursuant to City Code Sections 17.916.010.A and 17.400.030.B, rezoning amendments to remove the Ascot Avenue (AOL) Overlay Zone and Labor Intensive (LI) Overlay zone, along with text amendments to the Del Paso Boulevard/Arden Way Special Planning District. · On September 10, 2024, the Planning Director initiated, pursuant to City Code Section
17.916.010.A, the density bonus ordinance and remaining omnibus ordinance text amendments.
· On October 24, 2024, the Planning & Design Commission conducted a public hearing on four ordinances. The Commission forwarded three ordinances, as presented, to the City Council for consideration and continued consideration of the ordinance for Senate Bill 684 (2023, Caballero) to a date uncertain.
· On November 12, 2024, the Law & Legislation Committee reviewed and forwarded the ordinances, as presented, to City Council for consideration.
Rationale for Recommendation: Staff recommends the City Council review the ordinances and pass for publication the ordinances per Sacramento City Charter Sec. 32 for City Council consideration on December 10, 2024. The amendments contained in the proposed ordinances help to refine the City’s Planning and Development Code to make implementation easier and more streamlined, which supports several goals and policies of the 2040 General Plan.
Financial Considerations: Not applicable.
Local Business Enterprise (LBE): Not applicable.

ATTACHMENT A: BACKGROUND
Introduction
This attachment provides a summary for each amendment proposed in the ordinances.
Amendments are categorized as follows:
A. State Law Consistency: These amendments respond to planning and zoning laws passed during the 2023 state legislative session.
B. Streamlining: These amendments refine existing regulations without establishing a fundamental new policy.
C. Administrative Cleanup: These amendments correct typographical errors.
Within each category, the following information is provided:
Ordinance Section numbers: to locate and review the text within the ordinance. Title 17 Section Number(s): to identify the specific section(s) being amended. Issue Statement: to explain why an amendment is proposed. Amendment Summary: to concisely explain the proposed amendment. Rationale: the reasoning behind specific amendment(s) proposed.
A. Amendment Category: State Law Consistency
Proposed Ordinance Section 16, 20:
Title 17 Section 17.228.105
Topic: Accessory Dwelling Units
Issue: SB-477 became effective March 25, 2024. This bill made non-substantive changes and reorganized provisions for accessory dwelling units (ADUs) in California Government Code. The references to Government Code in the City’s local ADU ordinance now reference sections that have been repealed and no longer exist.
Additionally, the City’s local ordinance for ADUs allows the creation of two ADUs on a lot developed with a primary dwelling. ADUs may be attached to or detached from the primary dwelling. An ADU is considered detached if it does not share walls with the primary dwelling. The current development standards require 4 feet between detached ADUs. This causes confusion that a detached ADU cannot be attached to another detached ADU. Finally, only junior accessory dwelling units are not called out separately in the Executive Airport Overlay zone. This causes confusion about whether they are permitted.
Proposed Amendment:
Update references to California Government Code.
Specify that a detached ADU may be attached to another detached ADU. Add junior accessory dwellings to the Executive Airport Overlay Zone.
Rationale for Change: The proposed changes ensure consistency with State Law and clarify that detached accessory dwelling units may be attached to one another.
Proposed Ordinance Section 30:
Title 17 Section 17.808.160
Topic: Electrical Vehicle Charging and Hydrogen-Fueling Stations
Issue: AB-1236 became effective January 1, 2016. This bill imposed a statewide requirement to administratively approve applications to install electric vehicle (EV) charging stations through issuance of a building permit or nondiscretionary permit. SB- 1291 became effective January 1, 2023 and additionally requires administrative approval of hydrogen-fueling stations that satisfy specified requirements. City Code Section 17.808.160 lists development projects that are exempt from site plan and design review but does not include EV charging stations or hydrogen fueling stations.
Attachment A: Background – Streamlining
Proposed Amendment:
Add electric vehicle charging stations and hydrogen-fueling stations to the list of development exempt from site plan and design review.
Rationale for Change: The proposed change ensures the City will timely and accurately facilitate the review of electric vehicle charging stations and hydrogen fueling stations by clarifying that these stations are not subject to discretionary site plan and design review.
In addition to Title 17 amendments, staff will prepare and publish a statute-specific exemption application form (e.g., like is presently done for other projects exempt from site plan and design review, including roofing). This form will also make clear that installation of EV and/or hydrogen fueling facilities are not exempt from the tree preservation requirements of City Code Chapter 12.56.
Proposed Ordinance Section 34:
Title 17 Section 17.860.023
Topic: Affordable Housing on Faith and Higher Education Lands Act of 2023: SB 4 Issue: SB 4 became effective January 1, 2024. This bill imposes a statewide requirement to allow housing development projects on land owned by an independent institution of higher education or religious institution. No local ordinance is required.
However, the absence of information on how to process housing development locally under SB 4 may lead to unnecessary delays and/or confusion on how to comply (for both staff and developers).
Proposed Amendment:
Codify administrative procedures for application review under SB 4.
Rationale for Change: The proposed change ensures the City will timely and accurately facilitate the review of housing developments under state-mandated ministerial housing laws by providing clear instruction for compliance steps. In addition to Title 17 amendments, staff will prepare and publish a statute-specific application form (e.g., like is presently done for SB 35 projects).
Proposed Ordinance Section 35:
Title 17 17.860.024
Topic: Extremely affordable adaptive reuse projects: AB 1490
Issue: AB 1490 became effective January 1, 2024. This bill imposes a statewide requirement to allow extremely affordable adaptive reuse projects. No local ordinance is required. However, the absence of information on how to process housing development
locally under AB 1490 may lead to unnecessary delays and/or confusion on how to comply (for both staff and developers).
Proposed Amendment:
Codify administrative procedures for application review under AB 1490.
Rationale for Change: The proposed changes ensure the City will timely and accurately facilitate the review of housing developments under state-mandated housing laws by providing clear instruction for compliance steps. In addition to Title 17 amendments, staff will prepare and publish a statute-specific application form (e.g., like is presently done for SB 35 projects).
Proposed Ordinance:
Title 17 Chapter 17.704
Topic: Density Bonuses
Issue: The current density bonus ordinance was last updated in 2013 and does not reflect the numerous changes in State Law that occur annually. The current ordinance also includes an additional density bonus not required by State Law for buildings meeting or exceeding CALGreen Tier I or Tier II green building standards. No applications requesting an additional density bonus under these provisions have been received.
Proposed Amendment:
Repeal the existing Chapter 17.704
Replace with an ordinance that primarily references State Law.
Rationale for Change: The proposed changes ensure consistency with State Law and create an ordinance that is drafted to minimize the need for continual amendments in response to annual changes in State Law. In addition to Title 17 amendments, staff will prepare and publish a statute-specific application form to guide both staff and applicants.
Attachment A: Background – Streamlining
B. Amendment Category: Streamlining
Proposed Ordinance Section 25:
Title 17 Section 17.600.155
Topic: Setback Determinations for Lots of Peculiar Shapes or Locations
Issue: Presently, the process for determining setbacks for lots of peculiar shapes or locations includes a mandatory Site Plan & Design Review application. Examples of peculiar lots include polygon-shaped lots that exclude right angles or interior lots with no clear ‘front’ or ‘rear’ lot area adjacent to a public street. Staff field hundreds of inquiries weekly for basic regulatory information such as setback requirements. The time (i.e., to prepare/process an application) and cost (i.e., $181 minimum charge for one hour) for owners of ‘peculiar’ lots to understand setbacks is excessive and places an undue burden on the public. At the same time, this specific type of inquiry is infrequent (e.g., once or twice per month).
Proposed Amendment:
Authorize the Zoning Administrator to make a setback determination when no Site Plan & Design Review application is otherwise required.
Rationale for Change: The change will remove a burdensome cost for basic regulatory information (i.e., setback requirement) when no land use entitlement is otherwise required. At the same time, the expected frequency for the Zoning Administrator to make determinations is low enough that existing staff resources are adequate to respond to these inquiries.
Proposed Ordinance Section 26, 27, 28, 29:
Title 17 Chapter 17.624
Topic: Residential Accessory Structures: Arbor, Trellis, Pergola, Swimming Pools
Issue: The existing residential accessory structure regulations provide confusing and conflicting standards for trellis’ and pergolas. They also omit standards for arbors. As a result, staff spend unnecessary time responding to inquiries and evaluating applications including such accessory structures. Code compliance complaints have led to inconsistent enforcement actions. Additionally, the referring to “swimming pools” as “uncovered and unenclosed,” instead of just “swimming pools” causes unnecessary confusion and is inconsistent with the rest of Title 17.
Proposed Amendment:
Clarify the distinction between trellis’ and pergolas in both definitions and standards.
Provide new definition and standards for arbors.
Simplify the wording for swimming pools.
Rationale for Change: The change will correct an existing conflict for standards applicable to trellis’ and pergolas. This will increase the accuracy of information provided to the public and prevent the waste of staff resources. The amendments proposed will also ensure that standards are provided for arbors so that homeowners and staff clearly understand what is permitted. Additionally, the amendments will simplify understanding of requirements for swimming pools.
Proposed Ordinance Section 31:
Title 17 Chapter 17.808.430
Topic: Modification of terms and conditions: Site plan and design review
Issue: The existing procedure for modifying an approved Site Plan and Design Review permit consists of filing a new application for the same permit type again at the original fee. There is no distinction between the degrees of change proposed. Based on the project, this could involve substantial fees ($840 minimum; up to $16,590) and a public hearing for even the most minor, non-substantive change. The inflexibility of this process is overly burdensome for both staff (e.g., time to answer inquiries and process applications) and permittees (e.g., time and cost).
Proposed Amendment:
Establish a ‘minor’ and ‘major’ modification process that mirrors what is presently provided for Conditional Use Permits.
‘Minor’ modifications will be processed at the staff level based on an hourly rate ($168/hour).
‘Major’ Site Plan & Design Review permit modifications will be processed at the director level based the existing CUP major modification fee ($3,612).
Rationale for Change: The change provides for a consistent approach to the two most common land use entitlements processed by the City (i.e., Site Plan & Design Review, Conditional Use Permit). Implementing this change will reduce unnecessary costs and prevent the waste of time (for both applicants/staff) while at the same time, ensuring there is no compromise of existing standards and guidelines for development.
Attachment A: Background – Streamlining
Proposed Ordinance Section 32:
Title 17 17.828.170
Topic: Tentative Map Time Extensions
Issue: The Subdivision Review Committee reviews tentative map applications for conformance with standards and provides conditions of approval prior to consideration by the Zoning Administrator. Requests for time extensions to tentative maps are also required to be reviewed by the Subdivision Review Committee even though the applicant has not made changes to the map that was originally approved, and no new conditions are added.
Proposed Amendment:
Remove the requirement for tentative map time extensions to be considered by the subdivision review committee.
Rationale for Change: Implementing this change will eliminate an extraneous step in the tentative map entitlement process.
Attachment A: Background – Administrative Cleanup
C. Amendment Category: Administrative Cleanup
Proposed Ordinance Section 2:
Title 17 Section 15.148.600
Topic: Temporary Signs
Issue: City Code subsection 15.148.600.E exempts temporary signs from other provisions of the City’s Sign Ordinance. Subsection E.2 provides criteria for temporary signs in an SC, HC, C, or M Zone. Subsection E.2.a allows temporary signs with a cumulative display area of ten (10) square feet or less. Subsection E.2.b allows an additional temporary sign if a parcel is undeveloped, but incorrectly states the sign is allowed in addition to signs allowed in the R, A, or OB zones, rather than correctly referencing the SC, HC, C, or M zone.
Proposed Amendment:
Correct the reference from 15.148.600.E.1.b (Temporary Signs in an R, A, or OB Zone) to 15.148.600.E.2.a (Temporary Signs in an SC, HC, C or M Zone) in
15.148.600.E.2.b (Temporary Signs in an SC, HC, C, or M Zone).
Rationale for Change: Self-explanatory – fix an incorrect reference.
Proposed Ordinance Section 3, 4:
Title 17 Section 17.108.060
Topic: “E” Definitions
Title 17 Section 17.108.130
Topic: “L” Definitions
Issue: The definition for “estate lot” is separate from the remainder of lot type definitions.
This inconsistency hampers the ability to easily read the code and understand requirements.
Proposed Amendment:
Relocate the definition of “estate lot” to the other lot definitions at “L.” Create a new-cross reference at the “E” definitions for estate lots.
Rationale for Change: Maintain consistency with the location of definitions for all lot types.
Attachment A: Background – Administrative Cleanup
Proposed Ordinance Section 5, 6:
Title 17 Section 17.212.110
Topic: RMX Zone – Conditional Uses
Title 17 Section 17.212.210
Topic: RO Zone – Conditional Uses
Issue: The “assembly- cultural, religious, social” use is listed as both a permitted use and a conditional use. An “assembly- cultural, religious, social” only requires a conditional use permit if it exceeds the limit of outdoor events established in the special use regulations. Other zones that allow this land use by right within the limitations of the special use regulations only include the land use in the permitted uses table.
Proposed Amendment:
Remove “assembly-cultural, religious, social” from the conditional uses table.
Rationale for Change: The proposed change clarifies the land use is allowed by right and maintains consistency with land use tables in other zones.
Proposed Ordinance Section 7, 8, 9, 10, 11, 12, 13, 14:
Title 17 Section 17.220.110.B.1
Topic: M-1 Zone – Permitted Uses, Conditional Uses
Title 17 Section 17.220.120
Topic: M-1 Zone – Office Development
Title 17 Section 17.220.210.B.1
Topic: M-1(S) Zone – Permitted Uses, Conditional Uses
Title 17 Section 17.220.220
Topic: M-1(S) Zone – Office Development
Title 17 Section 17.220.310.B.1
Topic: M-2 Zone – Permitted Uses, Conditional Uses
Title 17 Section 17.220.320
Topic: M-2 Zone – Office Development
Title 17 Section 17.220.410.B.1
Topic: M-2(S) Zone – Permitted Uses, Conditional Uses
Title 17 Section 17.220.420
Attachment A: Background – Administrative Cleanup
Topic: M-2(S) Zone – Office development
Issue: The light and heavy industrial zones (M-1, M-1(S), M-2, and M-2(S) zones) allow an office use by right, or with approval of a conditional use permit, depending on square footage of the proposed office use. There is duplicative text for standards that allow an office by right and with a conditional use permit. A separate code section also states offices are allowed by right at a greater square footage when located in a building with a specified floor area ratio, and within a ¼ mile of a light rail station. The standards allowing an office by right in proximity to light rail are separate from other requirements that hampers the ability to easily understand when an office is allowed by right.
Proposed Amendment:
Delete duplicative text in the permitted uses and conditional use land use tables for offices.
Organize all requirements for office uses to be allowed by right in the permitted uses table.
Rationale for Change: This change allows for a clearer understanding of when an office requires a conditional use permit in the light and heavy industrial zones and maintains consistency with previous action taken by City Council.
Proposed Ordinance Section 15:
Title 17 Section 17.228.104
Topic: Short-Term Rental
Issue: To simplify administration of the Finance Department’s short-term rental permit program, section 5.114.210 of the City Code was recently revised. This amendment limits the lodging of a short-term rental dwelling unit to a total of 90 days for the term of the short-term rental permit, rather than 90 days in a calendar year. The definition of a short-term rental in 17.228.104, which limits lodging to 90 days within a calendar year, now creates inconsistencies with other sections of the City Code.
Proposed Amendment:
Revise the limit of a short-term rental from the aggregate of 90 days in a calendar year to 90 days for the term of the short-term rental permit
Rationale for Change: Maintain consistency throughout City Code.
Attachment A: Background – Administrative Cleanup
Proposed Ordinance Section 17:
Title 17 Section 17.228.119
Topic: Superstore
Issue: This section contains requirements for superstores that are no longer in effect, pursuant to City Council Ordinance 2013-0016, which took effect July 1, 2014 and sunset May 31, 2017.
Proposed Amendment:
Repeal the section.
Rationale for Change: The change ensures the code remains consistent with actions taken by the City Council.
Proposed Ordinance Section 18:
Title 17 Section 17.228.400
Topic: Recycling facility---General
Issue: The special use regulations for recycling facilities list the zones where recycling facilities are permitted, but omits referenced to the MRD zone which does allow recycling facilities with approval of a conditional use permit.
Proposed Amendment:
Insert the MRD zone in the list of zones that permit minor and major recycling facilities with a conditional use permit.
Rationale for Change: The change corrects inconsistency between different sections within Title 17.
Proposed Ordinance Section 19:
Title 17 Chapter 17.304
Topic: Ascot Avenue (AOL) Overlay Zone
Issue: The chapter concerns an overlay zone that no longer exists and, pursuant to City Council Ordinance 2013-0020 which comprehensively revised Title 17, is reflected in the current code by error.
Attachment A: Background – Administrative Cleanup
Proposed Amendment:
Repeal the chapter.
Rationale for Change: To maintain a code free from errors and which is consistent with prior City Council actions.
Proposed Ordinance Section 21:
Title 17 Chapter 17.320
Topic: Labor Intensive (LI) Overlay Zone
Issue: The chapter concerns an overlay zone that no longer exists and, pursuant to City Council Ordinance 2013-0020 which comprehensively revised Title 17, is reflected in the current code by error.
Proposed Amendment:
Repeal the chapter.
Rationale for Change: To maintain a code free from errors and which is consistent with prior City Council actions.
Proposed Ordinance Section 22:
Title 17 Section 17.332.070
Topic: Parkway Corridor (PC) overlay zone---Development regulations
Issue: The definition of reference line in the Parkway Corridor overlay zone includes a typographical error in the spelling of landside.
Proposed Amendment:
Correct the error.
Rationale for Change: Self-explanatory.
Proposed Ordinance Section 23:
Title 17 Section 17.424.070
Topic: Del Paso Boulevard/Arden Way Special Planning District—M-1 light industrial zone
Attachment A: Background – Administrative Cleanup
Issue: Similar to the M-1, M-1(S), M-2, and M-2(s) base zones, the Del Paso Boulevard/Arden Way Special Planning District requires a conditional use permit for office uses depending on floor area of the building, floor area of the office use, and distance from a light rail station. The organization of the text is confusing to readers.
Proposed Amendment:
Re-organize text to clarify requirements.
Rationale for Change: Self-explanatory.
Proposed Ordinance Section 24:
Title 17 Section 17.444.100
Topic: Central City Special Planning District—C-3 Central business district zone
Issue: Developments that exceeded a certain height were previously required to be reviewed at the commission level. Adoption of Ordinance 2020-0021 by City Council, which took effect June 11, 2020, removed this height threshold requirement for commission level review. Subsection F still references the height threshold that is no longer in effect.
Proposed Amendment:
Delete the subsection.
Rationale for Change: The change ensures the code remains consistent with actions taken by the City Council.
Proposed Ordinance Section 36:
Title 17 Section 17.916.010.B
Topic: Planning and Development Code – Procedures for amendments
Issue: This section defines the procedures for amendments to Title 17, but incorrectly mentions a motion for general plan adoption.
Proposed Amendment:
Delete the text pertaining to general plan adoption.
Rationale for Change: Self-explanatory.

2. A major modification is one that will result in any one of the following:
a. The deletion of a condition of approval;
b. A change to a condition of approval that prevents or substantially alters its intended outcome; or
c. A substantial change to exhibits (e.g., site plans,
architectural plans, landscape plans, design specifications, etc.) that accompany the permit.

a. Decision-maker. If the development project is located in a historic district or involves a landmark, a request for a major modification is subject to review by the preservation director. If the project is not located in a historic district and does not involve a landmark, the modification is subject to review by the design director.
b. Decision and findings. Approval of a major modification is made at the director level and based on the findings in section 17.808.140. Approval may include the imposition of new or different conditions as determined to be necessary or appropriate to make the required findings.
2. Minor modifications.
a. Decision-maker. If the development project is located within a historic district or involves a landmark a request for a minor modification is subject to review by the preservation director. If the development project is not located within a historic district and does not involve a landmark, the modification is subject to review by the design director.
b. Decision and findings. Approval of a minor modification is made at the staff level and based on the findings in section 17.808.150. Approval may include the imposition of new or different conditions as determined to be necessary or appropriate to make the required findings.

An application for a density bonus, incentive or concession, or waiver or reduction of development standards will be reviewed concurrently with and in the same manner as the accompanying permit application.
B. The application for a density bonus, incentive or concession, or waiver or reduction of development standards will be reviewed for completeness consistent with California Government Code section 65943.
17.704.050 Density bonus.
A. If a housing development qualifies for a density bonus under more than one category set forth California Government Code section 65915, subdivision (b), the applicant shall select one category under which the density bonus is to be granted.

B. The city is not required to waive or reduce development standards if the waiver or reduction would:
1. Result in a specific, adverse impact upon health or safety, as defined in California Government Code section 65915, subdivision (e), for which there is no feasible method to satisfactorily mitigate or avoid;
2. Result in an adverse impact on any property listed in the California Register of Historical Resources; or
