Issue Detail: Prior to the City and community efforts, conditions on 21st Avenue discouraged pedestrians and transit riders due to persistent issues such as garbage buildup, dumping, graffiti, inadequate lighting, and issues with sidewalks and bus stops.

In January 2022, the City’s Public Works Department collaborated with the Franklin Neighborhood Development Corporation (FNDC) to apply for a grant from the California Department of Transportation’s (Caltrans) Clean California Local Grant Program aimed at improving 21st Avenue.

The 21st Avenue Beautification Project (“Project”) aims to enhance the public environment by implementing various improvements. By replacing ditches at 32nd Street with curbs, bioswales, and greenery, the project seeks to discourage future trash and dumping while facilitating more effective

street sweeping. The addition of curb ramps at 32nd Street will enhance accessibility for all users.

Furthermore, the inclusion of artistic bus shelters, cultural murals, and improved lighting will transform the street into a vibrant hub of art, promoting pedestrian activities, transit usage, and attracting visitors to the area. The infrastructure elements of the grant are being managed by the Public Works Department while the FNDC is overseeing non-infrastructure aspects.

The Project covers the segment of 21st Avenue from the underpass at SR-99 across Franklin Boulevard to Ethel Phillips Elementary School. The Project was divided into two phases:

Phase 1: Create a widened Americans with Disabilities Act (ADA)-compliant sidewalk for students walking to and from Ethel Philips Elementary School on 21st Avenue. Phase 1 of the Project was constructed by City forces in 2023.

Phase 2: On 32nd Street at 21st Avenue by the underpass, dirt ditches that accumulate garbage will be replaced with curb, gutter, bioswales, and vegetation. To beautify the route between the neighborhoods, the Project will add artistic bus shelters, waste containers, lighting, and cultural murals by local artists on buildings along 21st Avenue which will be facilitated by FNDC.

The infrastructure component of Phase 2 is expected to complete construction by November 2024.

During construction, some items have required contract change orders. These items included unforeseen fence relocation, concrete headwalls, time extension for materials, and drainage modifications due to unforeseen conditions. Change Order No. 4 includes modifications to the roadway section due to the lack of sufficient base material to support the new asphalt pavement, as well as the need for a 90- day landscape maintenance period and exceeds the allowable City Manager authority per City Code. City Council action is required to execute this change order and reset City Manager change order authority.

Policy Considerations: The actions requested herein are consistent with the City policies to support public spaces, litter abatement, and improvements to public facilities, including the following General Plan policies listed below:

M 1.3.4 - Barrier Removal for Accessibility: The City shall remove barriers, where feasible, to allow people of all abilities to move freely and efficiently throughout the City.

PHS 5.1.9 - Healthy Communities: The City shall encourage the planning of new communities and revitalization of existing urban areas to achieve improvements in overall public health by encouraging a healthier living environment that includes walkable neighborhoods, access to recreation and open space, healthy foods, medical services, and public transit.

Creative Edge Cultural Plan 5.1: The City’s Creative Edge cultural plan calls for celebrating and

infusing all Sacramento neighborhoods and districts with arts and culture. It calls for supporting and expanding neighborhood-based programming and creative placemaking through community- and artist-initiated projects as well as artist-designed neighborhood markers.

Economic Impacts: This new infrastructure is expected to create 0.28 total jobs (0.16 direct jobs and 0.12 jobs through indirect and induced actives) and create $43,506 in total economic output ($27,422 of direct output and another $16,084 of output through indirect and induced activities).

The indicated economic impacts are estimates calculated using a calculation tool developed by the Center for Strategic Economic Research (CSER). CSER utilized the IMPLAN input-output model (2009 coefficients) to quantify the economic impacts of a hypothetical $1 million of spending in various construction categories within the City of Sacramento in an average one-year period. Actual impacts could differ significantly from the estimates and neither the City of Sacramento nor CSER shall be held responsible for consequences resulting from such differences.

Environmental Considerations:

California Environmental Quality Act (CEQA): The City of Sacramento Environmental Planning Services has reviewed the project and finds the project is a Categorical Exemption under CEQA Class 1, 3, and 4 and Section 15301, 15303, and 15304. The project consists of the operation, repair, or minor alteration of public streets, sidewalks, gutters, bicycle lanes, and similar facilities involving no expansion of use [15301(c)]. The project also consists of the construction, location, installation of new small equipment (Section 15303) and the minor public or private alterations in the condition of land, water, and/or vegetation which do not involve removal of healthy, mature, scenic trees except for forestry or agricultural purposes.

Sustainability: The recommended action supports the City Council’s sustainability priorities. This project intends to reduce waste and debris in public spaces and to support actions to promote greening and mitigate the urban heat island effect. The project will help advance climate resiliency and support safe and active transportation.

Commission/Committee Action: The 21st Ave Beautification Project was presented to the Active Transportation Commission (ATC) on May 18, 2023. The ATC supported the project.

Rationale for Recommendation: Staff recommends the City Council approve Change Order No. 4 with B and M Builders, Inc. for the City Agreement No. 2024-0306. The proposed Change Order No. 4 provides compensation for modifications to the roadway section due to the lack of sufficient base material to support the new asphalt pavement, as well as the need for a 90-day landscape maintenance that was not identified in the original contract documents. Approval by the City Council is required to execute this change order and reset the administrative authority of the City Agreement.

For contracts awarded of a price of at least $250,00, but less than $1,000,000, section 3.04.020(A)(2)

of the City Code provides the City Manager is authorized to execute contract amendments that increase the contract amount provided the sum of all contract amendments does not exceed 10% of the original contract price. As this contract supplemental exceeds this amount, Council approval is required.

The change order is needed to complete the construction of the Project.

Financial Considerations: The estimated total cost of the 21st Ave Beautification Project (T15235300) is approximately $2.1 million and includes the cost of Phase 1: the sidewalk expansion by Ethel Philips completed in 2023, and the non-infrastructure elements that are being performed by the FNDC.

There is sufficient funding in the project to execute Change Order No. 4 with B and M Builders, Inc. for an amount not to exceed $70,463 and cover the remaining construction management and all other project related costs.

Local Business Enterprise (LBE): B and M Builders, Inc, met the 5% LBE participation goal by utilizing local subcontractors, John Padilla Trucking for 3.6% and Anrak Corporation for 1.5% LBE utilization.
