Description/Analysis
Issue Detail: State law requires all cities and counties in California adopt a Housing Element as part of their General Plan to address housing needs. Adopted by City Council in 2021, the 2021-2029 Housing Element commits to implementing programs over the eight-year planning period, prioritizing programs to effectively increase housing availability, particularly affordable housing. Among these implementation programs is Program H15, titled “Permitting Requirements for Special Needs Housing,” which states:
File ID: 2024-01747 12/10/2024 Public Hearing Item 23.
The City shall ensure compliance with State law and encourage special needs housing through the following actions:
· The City shall amend the Zoning Code to allow Low Barrier Navigation Center developments by right in mixed-use zones and nonresidential zones permitting multi-unit uses (Government Code Sections 65660-65668).
· The City shall review and revise the Zoning Code provisions for temporary residential shelters to comply with locational restrictions and parking requirements under State law (Government Code Section 65583(a)(4)), establish a higher threshold for the number of beds permitted by right, and ensure that the zones in which shelters are permitted by right provide sufficient capacity in appropriate locations within the City where public transit and services are available.
· The City shall update the Zoning Code to allow single room occupancy SROs (i.e., residential hotels) by right in commercial and multi-unit dwelling zones. · The City shall develop a processing procedure to allow for the approval of 100 percent affordable developments that include a percentage of supportive housing units, either 25 percent or 12 units, whichever is greater, without a conditional use permit or other discretionary review in all zoning districts where multi-unit and mixed-use development is permitted (Government Code Section 65651(a)).
· Review and amend the Zoning Code, as necessary, to ensure requirements for group homes of seven or more persons are consistent with State law and fair housing requirements.
Staff’s analysis of these actions is detailed in Attachment 2. To implement this program, Staff has prepared an ordinance that amends the Planning and Development Code (Title 17 of the City Code), the primary means by which the City’s land use policy is implemented.
Policy Considerations: The proposed ordinance does not replace continued work in 2024 and 2025 to fully align Title 17 of the City Code with the 2040 General Plan. The ordinance seeks to implement the 2021-2029 Housing Element which sets forth the City’s goals and policies to address current and future housing needs.
The ordinance includes amendments that advance the following goals and policies of the 2040 General Plan:
Land Use Element
File ID: 2024-01747 12/10/2024 Public Hearing Item 23.
Policy LUP-6.10 Care Facilities. The City shall encourage the development of older adult daycare facilities, assisted living facilities, hospice, childcare, and other care facilities in appropriate areas throughout Sacramento.
Staff Analysis: The ordinance establishes clear regulations that align with new State laws for supportive housing and residential care facilities, thereby encouraging their development.
Housing Element
Policy H-2.3.5: Clear Development Standards and Approval Procedures. The City shall maintain and administer clear development standards, and approval procedures for a variety of housing types, including, but not limited to multifamily housing and emergency shelters.
Policy H-2.10: Awareness and Support. The City shall work to increase community awareness and support for affordable housing citywide.
Policy H-4.1: Expand Housing Types Throughout the City. The City shall take meaningful actions to allow for a greater array of housing types throughout the city to create more inclusive and equitable neighborhoods and to affirmatively further fair housing.
Policy H-6.6: Preserve Central City Single Room Occupancy Units. The City shall continue to preserve single room occupancy (SRO) units in the Central City.
Policy H-7.4: Permanent Supportive Housing. The City shall facilitate and provide permanent supportive housing options that offer appropriate services so that people experiencing chronic homelessness can maintain permanent housing.
Policy H-7.9: Remove Barriers to Accessing Shelters. The City shall strive to remove barriers to emergency shelter access.
Staff Analysis: The ordinance supports Policy H-2.3.5 by establishing clear development standards and approval procedures for diverse housing types, including shelters, residential hotels, and supportive housing. Additionally, it aligns with Policy H-2.10 by fostering community awareness of various affordable housing types. The ordinance promotes Policy H-
4.1 by expanding the variety of housing options, by allowing residential hotels by right in commercial and multi-unit dwelling zones. It also facilitates permanent supportive housing specified in Policy H-7.4 by clarifying a State law process by which supportive housing receives ministerial review. Finally, by increasing the size of shelters allowed by right, the ordinance addresses Policy H-7.9, removing barriers to development of emergency shelters.
File ID: 2024-01747 12/10/2024 Public Hearing Item 23.
Economic Impacts: Access to various affordable housing types enhances economic opportunities for more community members and helps reduce poverty and homelessness. A strong and affordable housing environment is critical to the economic well-being and growth of Sacramento and its residents.
Environmental Considerations: The ordinance will not result in any additional project-specific significant environmental effects not previously analyzed in the Negative Declaration for the 20212029 Housing Element, adopted by the City on August 17, 2021 (addendum adopted on December 14, 2021). Pursuant to CEQA Guidelines sections 15162 and 15164, the City has determined that the ordinance is project within the scope of the 2021-2029 Housing Element Negative Declaration, none of the conditions set forth in section 15162 have occurred, and that no additional environmental review is required.
Sustainability: A sustainable community includes housing for current and future households of all income levels. Increasing housing production and affordability will assist in creating a sustainable Sacramento and provide a platform for sustainable economic growth.
Commission/Committee Action: On July 25, 2024, staff presented an overview of the direction and proposed approach to implementing Housing Element Program H15 to the Housing Policy Working Group. This group, established per the direction of City Council, meets to review and provide a range of perspectives on local housing policies and programs of the Housing Element. Its membership includes representatives from various sectors, such as real estate, housing development, and advocacy organizations. The working group expressed support for staff’s approach and did not request any modifications.
On September 6, 2024, the Planning Director initiated, pursuant to City Code Section 17.916.010.A, an ordinance to implement Housing Element Program H15.
On October 24, 2024, the Planning & Design Commission conducted a public hearing on the ordinance and forwarded the ordinance, as presented, to the City Council for consideration.
On November 12, 2024, the Law & Legislation Committee reviewed and forward the ordinance, as presented, to the City Council for consideration.
On December 3, 2024, City Council passed the ordinance for publication pursuant to Sacramento City Charter Section 32.
Rationale for Recommendation: Staff recommends the City Council pass a motion adopting an Ordinance amending various provisions of, and adding Chapters 17.876 and 17.880 to, Title 17 of the Sacramento City Code, relating to special-needs housing, and also determining the ordinance is a

project within the scope of the Negative Declaration for the 2021-2029 Housing Element and will not have any additional project-specific significant environmental effects not previously examined in the Negative Declaration (CEQA Guidelines, §§ 15162 and 15164)). The proposed ordinance implements the City’s 2021-2029 Housing Element, an important State mandated planning document that serves as the City’s overall housing strategy.
Financial Considerations: Not applicable.
Local Business Enterprise (LBE): Not applicable.
Low Barrier Navigation Centers
Housing Element Program H15 Direction
• The City shall amend the Zoning Code to allow Low Barrier Navigation Center developments by right in mixed-use zones and nonresidential zones permitting multi-unit uses (Government Code sections 65660-65668).
What is a low barrier navigation center?
• Defined in State law as a Housing First, low-barrier, service enriched shelter focused on moving people into permanent housing.
• Provides temporary living facilities while case managers connect individuals to services • “Low barrier” means best practices to reduce barriers to entry such as the presence of partners if not a population-specific site, pets, storage of possessions, and privacy.
Issue
• Effective January 1, 2020, AB 101 r equires low barrier navigation centers meeting specified requirements be permitted by right in mixed-use and multi-unit dwelling zones, but are not a
ddressed in Title 17 and there are no procedures for processing applications.
Recommendation
• Implement the Housing Element directive by adding:
o A definition for “low barrier navigation center” to Title 17. o A new statute specific application form for low barrier navigation centers o Low barrier navigation centers as a permitted use in the following zones:

Housing Element Program H15 Direction
The City shall review and revise Zoning Code provisions for temporary residential shelters to:
• Comply with locational restrictions and parking requirements under State law (Government Code Section 65583(a)(4)),
• Establish a higher threshold for the number of beds permitted by right, and • Ensure that the zones in which shelters are permitted by right provide sufficient capacity in appropriate locations within the City where public transit and services are available.
What is a temporary residential shelter?
• Shelter that provides short-term, temporary housing for free or substantially below cost. • Services may be provided such as health care, mental health services, counseling, case management, permanent housing assistance programs, job training. • Also known as an emergency shelter in State Law.
Issue
• State Law sets parameters for the development standards local jurisdictions can apply to shelters and Title 17 presently includes conflicting standards. • Currently, shelters with more than 24 beds are required to receive a conditional use permit approved by the Planning and Design Commission, which the Housing Element identified as a potential constraint to providing larger shelters.
• State Law requires there be enough vacant sites allowing shelters by right to meet the capacity of the point in time count conducted before the start of the planning period. o The 2021-2029 Housing Element identified enough sites to meet the required capacity, but most were in parts of the City far from transit and amenities. o Following adoption of the Housing Element, changes in State Law modified requirements for sites that are considered as eligible towards providing required capacity.
Recommendation
• Implement the Housing Element directive by:
o Removing standards for shelters in Title 17 that conflict with State Law, o Increasing the size of shelters allowed by right from 24 beds to 100 individuals to be consistent with Sacramento County’s zoning standards, and o Revising the analysis demonstrating sufficient capacity to reflect State Law changes.
• While not explicitly directed by the Housing Element, the recommendation also includes:
o Lowering the level of review for shelters outside of the River District from planning and design commission level to zoning administrator.

Capacity for Temporary Residential Shelters
Analysis
• State Law requires Housing Elements demonstrate there are enough sites allowing shelters by right to meet the capacity of the point in time count conducted before the start of the planning period. The zoning code must be amended if sufficient capacity cannot be demonstrated.
• The Point-in-Time (PIT) count is a count of sheltered and unsheltered homeless persons conducted by Sacramento Steps Forward on a single night in January every other year.
• The 2021-2029 Housing Element identified enough vacant sites over 0.25 acres, estimated to be the smallest size necessary for 24 beds, to accommodate the 2019 point in time count. However, most sites were in outer areas of the city far from transit and amenities and Program H15 directed additional analysis to ensure enough sites in appropriate areas.
• After adoption of the 2021-2029 Housing Element, AB-2339, effective January 1, 2023, added new criteria for demonstrating capacity for emergency shelters, including that vacant sites in zones for “nonresidential use that allow residential use” where shelters are allowed by right must be located near amenities and services (May include health care, transportation, retail, employment, and social services, or that the city will provide free transportation to services or offer services on site), and provide at least 200 square feet per person.
• To determine capacity, vacant sites with an area of at least 4,800 square feet were identified in the C-4, M-1, M-1(S), M-2, M-2(S), and M-T zones within ½ mile of existing light rail or bus stops and at least one of the following Sacramento County Assessor Special Land Use Codes:
o Bank
o Church
o Large Retail
o Large Single Tenant
o Medical / Dental
o Multi-tenant
o Office
o Office (General)
o Post Office
o Restaurant
o Retail / Commercial
o Shopping Center
o Small Retail
o Store / Office Combo
o Acute Care Hospital
o Care / Health
o Day Nursery
• The analysis also noted if the site would be located within 300 feet of an existing temporary residential shelter serving only single adults based on a list of shelters provided by the City’s Department of Community Response. Per City Code Section 17.228.610, shelters serving single adults must be at least 300 ft from another shelter.
• Sites within the River District Special Planning District (SPD) were excluded as a conditional use permit is required for smaller shelters in this area.
• City owned sites were excluded. Including them would require substantial evidence that the city intends to make them available during the planning period. Planning staff had no such evidence and, therefore, excluded city owned sites.
Results
• Based on the current zoning and State Law requirements, there are 304 qualifying sites that allow a total of 7,176 beds by right. A map showing the location of these sites, amenities, and transit is shown on the following page, along with the map that was done for the 2021- 2029 Housing Element before State Law requirements changed.
• The current zoning could accommodate the 2019 point in time count of 2,858 individuals, the 2022 point in time count of 5,038 individuals, and the 2024 point in time count of 3,053 (although State Law only requires accommodating the 2019 count).
• Additionally, the recommendation proposes expanding the allowable size of shelters to accommodate 100 individuals, which would also increase overall capacity.
• If the River District SPD were included, the analysis shows, with the application of State criteria, there are 23 sites able to provide 552 beds.

SRO’s (Residential Hotels)
Housing Element Program H15 Direction
• The City shall update the Zoning Code to allow SROs (i.e., residential hotels) by right in commercial and multi-unit dwelling zones.
What is an SRO/residential hotel?
• Land use with six or more rooms or efficiency units used for sleeping or living purposes by guests and that is the primary residence of the guests. • May provide shared or private bathrooms as well as shared kitchens, or no kitchens. • Also known as a residential hotel in Title 17.
Issue
• Beginning in the 1920s, residential hotels were a major source of affordable housing in the Downtown Sacramento Area, but today require a conditional use permit approved by Planning and Design Commission in most zones, which the Housing Element identified as a potential constraint to new development.
• The Department of Housing and Community Development (HCD) identifies lack of zoning for SROs as an example of common zoning and land use barriers to affirmatively furthering fair housing.
• Development standards for residential hotels (SRO’s) were added to City Code over 30 years ago and need to be clarified to reflect how residential hotels function today.
Recommendation
• Implement the Housing Element directive by:
o Changing the review level from discretionary (i.e., CUP at PDC) to ministerial (permitted by-right land use).
o Expanding the number of zones where residential hotels are allowed:

o Revising the definition of “residential hotel” to clarify residential hotels are also known as single-room occupancy (SRO) hotels and may include on-site services. o Clarifying standards for unit size, unit occupancy, and common space.
History of Residential Hotels (SRO’s) in Sacramento
• Beginning in the 1920s, residential hotels were a major source of affordable housing in the Downtown Sacramento Area.
• In 1960, residential hotels provided 3,558 housing units (Ordinance No. 2006-056). • A moratorium on residential hotel conversion passed in 1983 in response to the loss of six hotels from the 1970s to 1983.
• By 1986, sixteen residential hotels remained.
• In 1986, Council adopted an ordinance requiring relocation benefits be paid to residents of SRO residential hotels upon withdrawal or conversion to other uses to mitigate the effect of displacement of very low-income households.
• I
n 1991, redevelopment agency staff presented recommended changes to the Zoning Ordinance to define residential hotels, provide development standards, and designate zones where new construction would be a permitted use, or an allowed use subject to a Special Permit.
• I
n 1992 Council adopted an ordinance adding a new land use category to the zoning ordinance for residential hotels (SROs).
o The ordinance allowed residential hotels with up to 125 units by right in the C-2, C- 3, C-4, M-1, and M-2 zones, or with a special permit to exceed the 125 unit maximum.
o Th e ordinance also allowed residential hotels with a special permit in the C-1, R-5, R-O zones. Residential hotels in the C-1 zone were allowed up to 125 units, and residential hotels in the R-5 and R-0 zones were governed by the maximum density allowed, or 125 units, whichever was less. A special permit was required to exceed this maximum.
o The ordinance included standards for minimum floor size, occupancy, common facilities, manager’s office, parking, and requirement for review by the Design Review Board (Ordinance No.92-012).
• In 1998, Council adopted an emergency ordinance deleting by-right provisions and requiring a special permit for residential hotels in the R-5, R-0, C-1, C-2, C-3, C-4, M-1, and M-2 zones.
o “While residential hotels serve a valuable purpose, they also have been shown to have the potential to have a significant impact on neighborhoods in which they are located” (Ordinance No. 98-010).
o Council extended this emergency ordinance twice that year (Ordinance No. 98-018 and Ordinance No. 98-037).
• In 1999, Council adopted an ordinance amending the zoning ordinance relating to housing requirements, mixed use parking requirements, and establishing new overlay zones in the Central City.
o The ordinance required a special permit for residential hotels in the Neighborhood Corridor, Urban Neighborhood, and Midtown Commercial Overlay Zones (Ordinance No.1999-021).
• In 2006, Council adopted an amendment to the 1986 relocation ordinance that identified ten SRO hotels and required relocation benefits be paid to residents in the event of a conversion or demolition of one of these properties.
o The amended relocation ordinance also imposed an obligation on the city to maintain an inventory of not less than 712 SRO units (Ordinance No. 2006-056). • In 2010, the Planning Commission approved a special permit for a mixed-use project containing 150 residential hotel units at 7th and H (P10-007). This is the most recently approved special permit, now called a conditional use permit, application for a new residential hotel to date.
• In 2016, Council adopted an amendment to the Residential Hotel Unit Withdrawal, Conversion, and Demolition Ordinance.
o The amendments included removal of rehabilitated, regulated or replaced SROs, and required the remaining four un-rehabilitated and un-regulated SROs to remain subject to the Ordinance.
• In 2017, the Planning Division received its last conditional use permit application to date for a new residential hotel (P17-034), which was withdrawn by the applicant. • In 2020, Council adopted an ordinance establishing the M-T Industrial and Transit-Area Zone, which allows residential hotels by right subject to special use regulations in
17.228.112 (Ordinance No. 2020-0006).
• In 2023, SHRA reported there were 142 non-regulated units subject to the ordinance and 800 regulated/replacement units.
Supportive Housing
Housing Element Program H15 Direction
• The City shall develop a processing procedure to allow for the approval of 100 percent affordable developments that include a percentage of supportive housing units, either 25 percent or 12 units, whichever is greater, without a conditional use permit or other discretionary review in all zoning districts where multi-unit and mixed-use development is permitted (Government Code Section 65651(a)).
What is supportive housing?
• Defined in State law as Housing with no limit on length of stay that is linked to onsite or offsite services and occupied by the target population. • Depending on the target population, there are different requirements under State Law:
o Supportive housing occupied by persons with low incomes with one or more disabilities, and may include adults, emancipated minors, families, elderly persons, young adults aging out of the foster care system, individuals exiting from institutional settings, veterans, and homeless people is by State Law to be treated the same as a dwelling for zoning purposes.
o Additionally, supportive housing occupied by persons with disabilities, families who homeless, and homeless youth is eligible for streamlined review.
Issue
• Effective January 1, 2019, AB 2162 requires local jurisdictions to ministerially approve supportive housing that meets affordability requirements, restricts units to the target population, provides supportive services, and complies with objective standards • Supportive housing is defined in City Code Section 17.108.200 but does not include the type of supportive housing that is eligible for streamlined review.
Recommendation
• Implement the Housing Policy directive by:
o Revising the definition of supportive housing in City Code Section 17.108.200 to reference the different types of supportive housing in State Law, o Adding a new chapter to City Code for processing streamlined supportive housing projects, and
o Creating a statute-specific application form.
Group Homes
Housing Element Program H15 Direction
• Review and amend the Zoning Code, as necessary, to ensure requirements for group homes of seven or more persons are consistent with State law and fair housing requirements.
What are group homes?
• There are several land uses classifications in Title 17 with characteristics similar to what can be described as “group homes. ”
• The primary activity of each use is to dwell with persons who are not biologically related. • These uses include family care facility, residential care facility, dormitory, residential hotel, supportive housing, and transitional housing.
Issue
• The Housing Element identified that the conditional use permit requirement for group homes of more than six persons could be considered a fair housing issue. • State law requires that group homes that fall within State Law definitions of “supportive housing” and “transitional housing” be regulated in the same manner as the type of dwelling they occupy, but this is not clearly identified in City Code. • State Law allows local jurisdictions to require a conditional use permit for State-licensed residential care facilities with more than six residents, but the definition of residential care facility does not specify they are State-licensed.
Recommendation
• Implement the Housing Policy Directive by:
o Revising the definition of residential care facilities to specify they are State Licensed,
o Revising the definitions of dormitory, family care facility, residential hotel, and temporary residential shelter to clarify they are separate from supportive and transitional housing, and
o Subsequently as part of the work presently underway to bring Title 17 into consistency with the 2040 General Plan evaluate a new land use classification of “dwelling” that replaces existing land use classifications (e.g., single-unit dwelling, duplex, multi-unit dwelling) to align with policy goals for a broader array of housing types, including those currently categorized as ‘group homes’ . 1 ORDINANCE NO.
