Description/Analysis
Issue Detail: The City operates a public water system under a permit issued by the California State Water Resources Control Board. Laboratory services are necessary to protect public health through continued monitoring and testing of the City’s drinking water supply and water sources as specified under the City’s operating permit. Additionally, these services keep the City in compliance with various federal and state drinking water quality monitoring requirements for the City’s potable water supply.
Policy Considerations: City Council authorization is required pursuant to section 3.04.020 as this supplemental agreement exceeds the City Manager’s approval authority and requires Council approval.
The Sacramento City Code Section 4.04.020 and the City Council Rules of Procedure (Chapter 7,

Section E.2.d) mandate that unless waived by a 2/3 vote of the City Council, all labor agreements, and all agreements greater than $1,000,000 shall be made available to the public at least ten (10) days prior to City Council action. This item was published for 10-day review on December 26, 2024, in compliance with the City Code.
Economic Impacts: None.
Environmental Considerations: The activity described in this report consisting of approval of an agreement for ongoing laboratory services has been determined to not be a project pursuant to the California Environmental Quality Act (CEQA). CEQA Guidelines Section 15378(b). The activity is a continuing administrative and maintenance activity [CEQA Guidelines section 15378 (b)] and is not subject to CEQA [CEQA Guidelines Section 15060(c)(3)].
Sustainability: The City’s drinking water quality monitoring program is consistent with the City’s 2040 General Plan PFS-3.1 to continue to provide reliable water, wastewater, and stormwater drainage utility services.
Commission/Committee Action: Not applicable.
Rationale for Recommendation: On April 26, 2023, Request for Proposal P23141371513 was advertised and issued on PlanetBids for laboratory services for drinking water and groundwater analysis. Three proposals were received and Eurofins Eaton Analytical was determined to be the most qualified to perform the testing that the City of Sacramento requires.
On November 13, 2023, DOU executed PRC002508 with Eurofins Eaton Analytical for drinking water and groundwater laboratory analysis $249,500. Supplement 1 was executed September 5, 2024, to extend Time of Performance through September 30, 2025. Supplement 2 is being proposed to increase the agreement by $1,250,500 bringing the agreement’s total not-to-exceed amount to $1,500,000.
Financial Considerations: Funding for the first year of this agreement of approximately $300,000 has been included in the approved Fiscal Year 2024/25 DOU Budget. Funding for future fiscal years shall be subject to funding availability in the adopted budgets for the applicable fiscal year in an amount not to exceed $1,500,000 over the five-year term. Purchase orders encumbering funds under this agreement will not be created until needs and funding are identified in the applicable budget (operating, capital, multi-operating, or grants).
There are no General Funds planned or allocated for this project.
Local Business Enterprise (LBE): Eurofins Eaton Analytical is not an LBE. The minimum LBE participation requirement was waived for this agreement.
