Description/Analysis
Issue Detail: The position of City Manager was vacated effective December 31, 2024. The City Council has begun a recruitment process for the position of City Manager. The City Council wishes to appoint an Interim City Manager while the recruitment is conducted.
Government Code section 54953 requires that prior to taking final action, the legislative body must orally report a summary of the recommendation for final action on salaries, salary schedules, or compensation paid in the form of fringe benefits of a local agency executive during the open meeting in which the final action is to be taken. Local agency executives are defined in Government Code section 3511.1 (d) as “(d) Local agency executive means any person employed by a local agency who is not subject to the Meyers-Milias-Brown Act (Chapter 10 (commencing with Section 3500)).” The Interim City Manager meets the local agency executive definition. As part of the appointment process for the Interim City Manager position, the City Council will set a salary and the Interim City Manager will be subject to, and receive benefits consistent with, the terms of the City of Sacramento’s Personnel Resolution Covering Unrepresented Officers and Employees.
On January 7, 2025 the City Council passed a motion appointing Leyne Milstein as Interim City

Sustainability: Not applicable.
Commission/Committee Action: Not applicable.
Rationale for Recommendation: The City Manager has resigned effective December 31, 2024. The Council desires to appoint an Interim City Manager that will have the authority to exercise all authority vested in the City Manager by the City Charter and City Code, as well as any applicable City resolution, policies, or procedures. The appointment of an Interim City Manager will also assure a smooth transition while recruiting for the position of City Manager.
Financial Considerations: The salary for the City Manager classification is already fully funded within the budget for the City Manager’s Office.
Local Business Enterprise (LBE): Not applicable.
