Description/Analysis
Issue Detail: The applicant is requesting entitlements to allow for the development of a three-story mini-storage building on a vacant lot within the General Commercial (C-2-EA-3-PUD) zone, Executive Airport Overlay, and Greenhaven Executive Park Planned Unit Development. The climate- controlled storage building features a contemporary architectural design that maximizes buildable space on the parcel. There is an onsite apartment for the manager and a small office adjacent to Corporate Way.

The following entitlements are requested:

1. Rezone: Ordinance rezoning 2.27-acres from the Office Business (OB-EA-3-PUD) zone, Executive Airport Overlay, and Greenhaven Executive Park Planned Unit Development to the General Commercial (C-2-EA-3-PUD) zone, Executive Airport Overlay, and Greenhaven Executive Park Planned Unit Development.

2. Amendments to the Greenhaven Executive Park Planned Unit Development:

Resolution amending the Greenhaven Executive Park Planned Unit Development Guidelines and Schematic Map to redesignate 2.27-acres from Office to Commercial, updating commercial signage allowance, and other text updates to clean-up old procedures and standards.

3. Conditional Use Permit: Conditional Use Permit to establish a mini-storage facility in the General Commercial (C-2-EA-3-PUD) zone, Executive Airport Overlay, and Greenhaven Executive Park Planned Unit Development; and

4. Site Plan and Design Review: Site Plan and Design Review to construct a three-story, 152,625-square-foot mini storage building and associated site improvements.

Public/Neighborhood Outreach and Comments: As part of the application review process, the proposal was routed to surrounding property owners and tenants within a 500-foot radius and to the following neighborhood groups: Pocket Greenhaven Community Association, Preservation

Sacramento, Civic Thread, and Sacramento Area Bicycle Advocates. Staff did not receive any comments from the aforementioned community groups.

Staff received correspondence from three surrounding property owners (Attachment 11). Two letters of support for the mini-storage facility were received commending the project in developing a blighted site and support for a much-needed service (i.e. storage).

Staff also received one letter in opposition from a neighbor who expressed four issues regarding the project. The issues were related to the building massing and aesthetics, lack of community benefit and redundant land uses in the area (mini-storage), environmental health concerns with construction and proximity to a preschool, and concerns with creating a bad precedent by rezoning the property.

Below are the neighbor’s comments and staff response to their concerns. · “Incompatibility with Surrounding Land Use and Aesthetic: The planned three-story self- storage facility does not fit the character of the surrounding area, which includes schools, residential homes, and community-centered institutions. This large commercial structure disrupts the general aesthetic of the neighborhood and does not align with the family-friendly, low-rise design valued in the Pocket area.”
Staff Response:

The maximum allowed height within the PUD is 55-feet or 4 stories and the storage facility is proposed at 41-feet. The height of the building does not require a deviation and is consistent with the Planned Unit Development Guidelines. Self-storage facilities are considered to be a commercial service use that support residential, office, and commercial sectors, all of which are commonly found in the nearby area. This is supported by General Plan polices LUP-1 and LUP-2 (see below). Staff worked with the applicant and their design team to create an attractive building with materials commonly found in the area. The building will be setback 26-feet from Corporate Way and the building façade will be softened by new landscaping that includes drought tolerant plants and native trees. · “Lack of Community Benefit: The proposed self-storage facility does not address a community need, nor does it create meaningful employment opportunities for local residents. Moreover, there is already an existing self-storage facility on Corporate Way, making this additional development redundant.”
Staff Response:

The subject site is located in the Executive Airport Overlay, Area 3, indicating that the property is subject to specific safety requirements and restrictions limiting the number of people allowed on the property at any one time to 50 people per acre, making a low intensity use such as self-storage an acceptable land use.

The applicant has indicated that there is a significant demand in the area that is outpacing available space. They estimate that occupancy levels are at 95%-98% within a 3-mile radius, inclusive of Superior Self-Storage, located approximately 460 feet from the subject site (1106

Page 3 of 8 ends

File ID: 2025-00231 1/21/2025 Public Hearing Item 7.

Corporate Way.) The Applicant has also stated that self-storage facilities within this 3-mile radius offer limited numbers of climate-controlled storage. The subject site Operator intends to hire between 2-3 full-time employees, with one full-time manager living on site, and 2-3 part time employees.
· “Environmental and Health Concerns Near a Preschool: I am particularly concerned about the facility’s proximity to a preschool, where construction and operational impacts on air quality, noise, and traffic directly endanger the health and safety of children and staff. The facility’s close proximity to such a sensitive site should be grounds for a more cautious approach to development.”
Staff Response: An environmental document has been prepared to address any potential environmental health issues. As proposed, the project will not exceed thresholds of significance established by the City Council and will follow any standards required by the Sacramento Metropolitan Air Quality Management District. The building is fully enclosed with hours of Monday through Saturday, 9am to 7pm, not operating 24-hours. A site manager will also be present. Self-storage facilities are highly secured, low traffic, and are low impact as evaluated by the Initial Study-Mitigated Negative Declaration (IS/MND) environmental analysis. A memo was prepared in response to all comments received during the public review period of the IS/MND. The link to access all comments and City responses is available through the link found under the Environmental Considerations section noted below. · “Additionally, I worry that approving this rezoning sets a precedent that may open the door to future developments which do not align with the Pocket Community Plan or the needs of our area. Allowing this project to move forward under the new zoning designation could make it more difficult to preserve the neighborhood’s intended purpose and character in the future.” Staff Response:

According to the applicant, the current property owner has made efforts to either develop or sell the property, using a range of marketing campaigns targeted at industries allowed within the current zoning-such as research and development, medicine, and technology. Despite utilizing multiple channels like online platforms, industry websites, and email campaigns, rising interest rates and high construction costs have deterred potential buyers and developers, making office or other commercial uses financially unfeasible.

The site zoning is within the Executive Airport Overlay, which restricts what land uses can be allowed to operate within its four safety area zones and density of people that can congregate in the area.

The Sacramento City Code outlines, the purpose of the OB zone is to provide for a low-rise mixed-use employment zone that is intended to permit business, office, institutional, or professional buildings; the sale of goods and services; and lodging and dwellings. In contrast,

Page 4 of 8 ends

File ID: 2025-00231 1/21/2025 Public Hearing Item 7.
the C-2 zone is to provide for the sale of goods; the performance of services, including repair facilities; office uses; dwellings; small wholesale stores or distributors; and limited processing and packaging.

Given the reduced demand for office spaces following the COVID-19 pandemic and the rise of remote work, coupled with the lack of demand for office space as indicated by the applicant’s marketing campaign, a rezone is a reasonable consideration.

Policy Considerations:
2040 General Plan
The 2040 General Plan designation for the subject site is “Office Mixed Use”. This designation is intended to provide space for job centers, office buildings, and business parks, with complementary commercial and service uses that cater to employees throughout the day. This designation applies in areas with good access to the regional transportation system outside of the Central City. Allowable uses include professional and service-oriented offices, commercial support uses such as restaurants, coffee shops, dry cleaners, gyms and fitness centers, markets, hotels, business support services, residential development in either a mixed-use or standalone format, care facilities, assembly facilities, and compatible public and quasi-public uses. Mini-storage facilities are complimentary commercial uses that support residential, commercial, and office sectors.

Staff finds that the proposed mini-storage facility is consistent with the following 2040 General Plan Land Use Element Goals and policies:

LUP-1 A compact urban footprint and sustainable development pattern with infrastructure that supports efficient delivery of public services while protecting surrounding open space lands.

LUP-1.1 Compact Urban Footprint. The City shall promote a land- and resource-efficient development pattern and the placement of infrastructure to support efficient delivery of public services and conserve open space, reduce vehicle miles traveled, and improve air quality LUP-1.13 Airport Land Use Compatibility. The City shall work with the Sacramento County Airport System (SCAS) and the Airport Land Use Commission (ALUC) to ensure that new development near the area’s airports is compatible with airport operations, adopted ALUC policies, and applicable Airport Land Use Compatibility Plans.

Staff Response:

A vertical climate controlled mini-storage facility aligns with the goals and policies of LUP-1 and LUP-1.1 by promoting compact urban footprint that maximizes land use efficiency while reducing urban sprawl with the selected site being an urban infill parcel. The siting of a self-storage facility within the Greenhaven Executive Park PUD will reduce vehicle miles traveled, due to the fact that self-storage occupancy rates within a three-mile radius exceed 90%, justifying the need for

Page 5 of 8 ends

File ID: 2025-00231 1/21/2025 Public Hearing Item 7.
additional facilities for existing and future neighborhood residents. The project was reviewed against ALUC’s development standards and was found to be compatible with the plans, consistent with policy LUP-1.13.

LUP-2 Balanced and connected community with thriving neighborhoods and centers and development intensities linked to transit.

LUP-2.1 Overall Balance of Uses. The City should encourage a balance and a mix of employment, residential, commercial, cultural, and tourism-related uses, as well as a full range of amenities and services necessary to support a thriving city.

Staff Response:

The proposed vertical climate controlled mini-storage facility is consistent with LUP- 2 and LUP-2.1 by contributing to the overall balance of uses within the neighborhood and City at large. The mini-storage facility offers storage solutions that supports residential, commercial, and office sectors by providing accessible and secure storage options. According to the applicant, within a 3-mile radius of the project site, storage space is under supplied with demand outpacing available space.

General Plan - Pocket Greenhaven Community Plan Area
The subject property is located within the Pocket Community Plan Area of the General Plan. The Pocket Community Plan Area is located southwest of Sacramento’s downtown and adjacent to a large bend of the Sacramento River which has been known for many years as the “Pocket Area.” The Pocket Area comprises four neighborhoods: South Land Park, Greenhaven, Pocket, and Z’berg Park. Residential areas consist of mostly single-family units with multi-family units integrated throughout the community. Health care, religious and educational institutions, and parks and recreation uses are scattered throughout the area and neighborhood servicing retail and commercial centers are also at key intersections.

Staff Response
: No goals or policies specific to Community Plan Area are applicable to the proposed project. Given the project’s consistency with the Office Mixed Use designation and goals and policies from the 2040 General Plan, staff finds the proposed project is also consistent with the Community Plan Area.

Greenhaven Executive Park Planned Unit Development
The subject site is located within the Greenhaven Executive Park PUD which was originally adopted in 1983. While the PUD outlines the initial vision for the area there are no goals or policies specific to the PUD have been adopted to address the evolving needs of the district.

Given the absence of the of goals and policies specific to the PUD, staff analyzed the project for consistency with current zoning and general plan framework to determine if the proposed use is aligned with current land use objectives and policies. This ensures that any proposed rezone,

Page 6 of 8 ends

File ID: 2025-00231 1/21/2025 Public Hearing Item 7.
guidelines amendment, or development are consistent with the cities long-term policies and objectives.
200-Year-Flood Protection
The project site is within an area for which the local flood-management agency has made adequate progress (as defined in California Government Code section 65007) on the construction of a flood- protection system that, for the area intended to be protected by the system, will result in flood protection equal to or greater than the urban level of flood protection in urban areas for property located within a flood-hazard zone, as demonstrated by the SAFCA Urban Level of Flood Protection Plan and Adequate Progress Baseline Report and the SAFCA Adequate Progress Toward an Urban Level of Flood Protection Engineer’s Report, each accepted by the City Council on June 21, 2016 (Resolution No. 2016-0226), and the SAFCA 2024 Adequate Progress Annual Report accepted by the City Council on October 22, 2024 (Resolution No. 2024-0311).

Economic Impacts: The proposed project will provide retail viability and provide new job opportunities in the area.

Environmental Considerations: The City of Sacramento prepared a Mitigated Negative Declaration (MND) for the Self-Storage Facility on Corporate Way Project (P24-014). In accordance with the California Environmental Quality Act (CEQA), the MND was circulated for a 30-day public review period which ended November 6, 2024. The comment period was also advertised in a newspaper of general circulation. A notice of availability / notice of intent to adopt an MND was posted in the County Clerk’s Office and was sent to applicable regulatory agencies, neighborhood associations, and stakeholders in the project area.

The City received three letters/emails during the public comment period. The comment letters and responses are included on the City’s CDD EIR webpage under the Self-Storage Facility on Corporate Way Project (P24-014) heading (webpage listed below). Each of the comments addressed the project site and conditions as they relate to the particular areas of concern of the respective commenting agency, company, or organization. The comments from the Central Valley Regional Water Quality Control Board, the Sacramento Metropolitan Air Quality Management District and a community member are acknowledged by the City and have been considered as part of the project planning and its implementation. The comments received did not identify any new significant effect, increase in severity of an impact identified in the Mitigated Negative Declaration, or provided significant new information. In response Staff has made clarifications and minor modifications to the MND as reflected in the Response to Comments memo posted on the City’s CDD EIR webpage. The comments and responses do not create any circumstances identified in CEQA Guidelines Section 15073.5 that would require recirculation.

The Environmental Services Manager has determined that adoption of the Mitigated Negative Declaration and Mitigation Monitoring Plan are appropriate actions under the CEQA. The initial

study/MND for the project, and the MND revisions, comments and responses are available at the Community Development Department’s EIR webpage located at the following:
<https://www.cityofsacramento.gov/community-development/planning/environmental/impact-reports> Sustainability: A vertical climate controlled mini-storage facility aligns with the goals and policies of LUP-1 and LUP-1.1 by promoting compact urban footprint that maximizes land use efficiency while reducing urban sprawl with the selected site being an urban infill parcel. Additionally, the project will comply with Building Energy Efficiency Standards (Title 24).

Commission/Committee Action: On December 12, 2024, the Planning and Design Commission voted to forward a motion to approve the proposed project.

Rationale for Recommendation: Staff recommends the Sacramento City Council approve the Corporate Way Greenhaven Self Storage, based on the findings of fact and conditions of approval listed in Attachment 9. Staff recommends approval of the proposed mini-storage facility because it is consistent with the 2040 General Plan, which encourages a variety of professional and service- oriented uses to complement existing offices, commercial, and residential sectors. The project promotes key policies LUP-1 and LUP-1.1, by promoting a compact urban footprint, LUP-2 and LUP-

2.1 providing a service to both residential and commercial sectors and addressing a community need for additional storage space in the neighborhood and City at large. The project was also reviewed and found to be consistent with the Executive Airport Overlay development standards.

Financial Considerations: None.

Entitlement Review
The applicant is requesting to construct a three- story, 152,625-square-foot mini-storage facility. To accommodate the request, the applicant is requesting the approval of a rezone, Planned Unit Development Schematic Plan and Guidelines text a mendments, conditional use permit, and site plan and design review. Pursuant to Sacramento City Code (SCC) 17.808.230.B.2, the Planning and Design Commission will consider and make a recommendation to the City Council on the requested entitlements. The recommendations of the Planning and Design Commission will be forwarded to the City Council for final action.

Rezone
The applicant requests to rezone one parcel totaling 2.26- aces in the Office Business Executive Airport Overlay (OB -EA-3-PUD) and Greenhaven Park Planned Unit Development to the General Commercial Executive Airport Overlay (C -2-EA-3-PUD) and Greenhaven Park Planned Unit Development . The requested rezone would allow the mini storage with an approved conditional use permit, facilitating the development of the vacant site. SCC section 17.808.230.C.1.D requires the following findings be made to approve a rezone: (1) the rezone is consistent with the applicable general plan designation, use, and development standards; the goals, policies, or other provisions of the general plan; and any applicable specific plan; and (2) the amendment promotes the public health, safety, convenience, and welfare of the City.

The proposed rezone is consistent with the Office Mixed Use land use designation which encourages the development of job centers, office building buildings, business parks, and complementary commercial and service uses. The proposed vertical climate- controlled mini -storage facility fit s within this designation by providin g a service that supports residential, office, and commercial sectors, while also meeting a demonstrated need for additional storage capacity in the area. The development will have a compact building footprint, which aligns with the goals for sustainable development, efficient infrastructure, and resource conservation (LUP -1, LUP -1.1). Additionally, the mini - storage facility contributes to an overall balance of uses as outlined in LUP -2 and LUP-

2.1 by offering an essential service that enhances the surrounding neighborhood and supports the City’s goal of providing a mix of uses within established neighborhoods.

The rezone further promotes the public, health, safety, convenience, and welfare of the City by providing a needed service, such as a storage facility, to an under served area, reducing the potential for urban sprawl and contributing the City’s economic viability.

The development was reviewed for compatibility with airport operations and found to be in compliance with the Airport Land Use Commission regulations.

Figure 2: Propose Rezone

Planned Unit Development Guidelines and Schematic Plan Amendments The project site is located within the Greenhaven Executive PUD. The PUD is bounded by Florin Road to the north, Interstate 5 to the east, South Land Park Drive to the south, and Greenhaven Drive to the west. The PUD consists of a mix of zoning districts including Office Business Low -Rise Mixed -Use (OB), Multi -Unit Dwelling (R- 2B, R -4) and General Commercial (C-2). The PUD is currently developed with a mix of office and medical office uses, commercial uses, as well as residential uses. The Greenhaven Executive Park (formerly Pocket Office Park) Planned Unit Development (PUD) was established by the City Council in 1983 with PUD Guidelines and PUD Schematic Plan.

PUD Guidelines Text Amendment
Section VII of the Greenhaven Executive Park PUD Guidelines sets sign criteria and regulations for commercial uses.

The applicant is requesting an amendment to the commercial development sign guidelines and to update the text to reflect today’s city sign code for commercial uses .

The proposed text changes will 1) allow for two attached sign per occupancy; allowing two attached signs for the storage facility and 2) the size of the attached signs will be scaled to the lineal frontage of the façade on which they are place.

Other text amendments include clean up language and development approval procedures to be consistent with todays standards.

Staff is supportive of the proposed text amendments and text clean up as it updates the guidelines with today’s city code and will provide additional guidance for customers and city staff when evaluating future signage within the PUD.

PUD Schematic Plan Amendment

The current PUD Schematic Plan designates the site for office use. An amendment to the Schematic P lan is required to allow mini storage uses to be established at the project site in the PUD. The Schematic Plan amendment would, as shown in Attachment 9, redesignates the parcel to commercial. Staff is in support of the proposed commercial designation, as it would be consistent with the proposed rezone and provide greater flexibility by allowing for a variety of support commercial uses within proximity to residential, office, and other commercial sectors within the PUD and surrounding neighborhoods.

Figure 3: Proposed Schematic Plan Amendment
Conditional Use Permit
SCC section 17.216.710.B establishes mini storage as a conditional use subject to review and approval of a conditional use permit by the Planning and Design Commission. SCC section 17.808.200.C.1. requires the following findings be made to approve a conditional use permit:
a) the proposed use and its operating characteristics are consistent with the general plan and any applicable specific plan or transit village plan; b) the proposed use and its operating characteristics are consistent with the applicable standards, requirements, and regulations of the zoning district in which it is located, and of all other provisions of this title and this code; c) the proposed use is situated on a parcel that is physically suitable in terms of location, size, topography, and access, and that is adequately served by public services and utilities; and
d) the proposed use and its operating characteristics are not detrimental to the public health, safety, convenience, or welfare of persons residing, working, visiting, or recreating in the surrounding neighborhood and will not result in the creation of a nuisance.

The proposed mini-storage use features three levels of individual storage units ranging in size from 25-square-feet to 300 -square-feet. The building will feature a customer service office in the front of the building and a watchperson quarter for an onsite manager (a dwelling unit permitted as an accessory use) at the ground floor on the north side of the building. A covered loading area near the entry into the storage portion of the building will be provided for customer access. The business office hours will be from 9:00am to 7:00pm Monday thru Saturday and closed on Sunday. The facility will be closed on Sundays. The operator expects to employ between four to six employees.

The proposed mini-storage facility is consistent with the Office Mixed Use designation of the 2040 General Plan, which allows for complementary commercial and service uses such as a storage facility. Additionally, the facility aligns with the goals and policies of the General Plan, including promoting compact development pattern (LUP -1), supporting a balanced mix of uses (LUP -2), and improving services. The mini-storage will not be detrimental to surrounding uses including the adjacent office, commercial, and residential uses. The proposed use will be self-contained within the building and will not generate excessive noise, light, or odors associated with the business. Additionally, the operations will not result in any conflicts with the existing nature of the surrounding businesses or result in any nuisance activity. The use will generate new and repeat customers to the site that will activate the ground floor of the building near the street.

Vehicle trips will range from standard passenger vehicles to medium sized trucks and vans carrying goods for storage that will utilize the provided loading zones, onsite parking spaces, or use street parking.

Overall staff supports the proposed use and believes it will be a positive contribution to the Pocket Greenhaven neighborhood by developing a vacant infill site with a well - planned, compact large- scale building, that will support existing and future residents and businesses in the area. The development will also feature a secure design that will discourage activities such as illegal dumping, and littering, and transient activity around the project site and surrounding area. The building’s size and scale will provide visibility from the freeway that will help attract additional visitors to the district and support economic growth.

Site Plan and Design Review
SCC section 17.808.110 requires site plan and design review for new commercial buildings. Additionally, SCC section 17.228.106 establishes development standards for mini storage uses. The project is also subject to the Greenhaven Executive Park Planned Unit Development.

Site Design
The proposed development consists of a three- story, climate -controlled self -storage building that is designed to maximize the efficient use of space while providing a variety of storage options. The facility is structured with similar floor plans on each level, ensuring uniformity and a variety of storage unit sizes. The building will have a strong street presence with a 26 -foot setback from the street and apple landscaping. The building facade will be softened by new landscaping new trees and bioretention basin adjacent to the street. The building includes a 600-square-foot office space surrounded by a glass storefront , further activating the space while adding transparency to the building façade.

Onsite vehicle circulation will be provided via two, two-way driveways on Corporate Way. Paved drive aisles and parking areas would be constructed to provide vehicle access to the building. The paved two- way 20- foot wide drive aisle loops around the building and would serve as a fire lane. The site will have five vehicle parking spaces, including four spaces on the southeast corner of the site, and one space on the northeast corner of the building near the entrance from Corporate Way for the onsite manager.

Figure 4: Proposed Site Plan

Architectural Design and Height
The building features the highest level of detail and material transition on the east elevation adjacent to Corporate Way . The east elevation has aluminum storefronts along with a variety of metal and fiber cement panel configurations utilizing offsets, color tones, and varying dimensions. The metal and fiber cement panel system wraps the building at the southwest corner. The rest of the façade features horizonal metal panels with varied color tones that create a complete design theme across the building. The roof parapets will vary at multiple points of the building, creating additional variation to the elevations.

Figure 5: Northeast Perspective (View from Corporate Way) The PUD Guidelines promote the innovative and creative use of materials and construction methods, specifying wall materials like stucco, concrete, wood, glass, metals, and brick. Regarding building colors, the PUD encourages earth tones such as various shades of gray, muted tones, and medium to dark hues of burnt umber, raw umber, raw sienna, burnt sienna, reds, yellows, greens, and terracotta. Staff collaborated with the applicant to incorporate materials and colors recommended by the PUD. The applicant has selected a diverse range of building materials and earth tones commonly seen in the PUD, including crimson- colored fiber cement panels along Corporate Way. Additionally, extra glazing near the building entrance/office helps activate the street frontage. The PUD identifies height limitations within the PUD at maximum of 55-feet or 4 stories. The building will reach a top parapet height of 41- feet and does not deviate from the PUD.

Setbacks
The PUD only establishes required building setbacks from Corporate Way (front-yard setback) and is silent for rear - and interior -yard setbacks; the building is set off the property lines by varying degrees to orient the building to the street while accommodating proposed improvements and to provide fire access around the building.

The required front yard setback is a minimum of 25- feet. The proposed building setback from Corporate Way is 26.7-feet, 30-feet from north property line, 34-feet from the south property line, and 35-feet from the rear-property line. Deviations are not required for the proposed project.

Landscape and Fencing
Within the PUD, the minimum landscape coverage percentage for commercial zones is 20%. But in the case of self-storage facilities, landscaping coverage shall only pertain to the publicly accessed areas. The applicant will shade the parking lot area at 51% exceeding the minimum requirements set for the PUD. RESOLUTION NO. 2024-

Adopted by the Sacramento City Council
January 21, 2025

ADOPTING THE MITIGATED NEGATIVE DECLERATION AND MITIGATION

MONITORING PLAN FOR THE CORPORATE WAY GREENHAVEN SELF STORAGE (P24-014) (APN: 031-0051-019-0000)

BACKGROUND

A. On December 12, 2024, the City Planning and Design Commission conducted a public hearing on Corporate Way Greenhaven Self Storage (P24 -014) and forwarded a recommendation of approval of the Project to City Council.

B. On January 21, 2025, the City Council conducted a public hearing, for which notice was given pursuant Sacramento City Code, and received and considered evidence concerning the Corporate Way Greenhaven Self Storage (P24-014).

BASED ON THE FACTS SET FORTH IN THE BACKGROUND, THE CITY COUNCIL RESOLVES AS FOLLOWS:

Section 1. The City Council finds as follows:

A. The City’s Environmental Planning Services Division has prepared an Initial Study to determine if the Project may have a significant effect on the environment.

B. The Project initial study identified potentially significant effects of the Project. Revisions to the Project made by or agreed to by the Project applicant before the proposed mitigated negative declaration and initial study were released for public review were determined by City’s Environmental Planning Services to avoid or reduce the potentially significant effects to a less than significant level, and, therefore, there was no substantial evidence that the Project as revised and conditioned may have a significant effect on the environment.

C. Mitigated Negative Declaration (MND) for the Self-Storage Facility on Corporate Way Project (P24-014) was then completed, noticed and circulated in accordance with the requirements of the California Environmental Quality Act (CEQA), the State CEQA Guidelines and the Sacramento Local Environmental Procedures as follows:

i. On October 7, 2024, a Notice of Intent to Adopt the MND (NOI) dated October 7, 2024, was circulated for public comments for 30 days. The NOI was sent to those public agencies that have jurisdiction by law with

respect to the proposed project and to other interested parties and agencies, including property owners within 500 feet of the boundaries of the proposed project and occupants within and adjacent to t he project site. The comments of such persons and agencies were sought.

ii. On October 7, 2024, the NOA/I was published in the Sacramento Bulletin, a newspaper of general circulation, and the NOA/I was posted in the office of the Sacramento County Clerk.

iii. Based upon the comments received there are no significant modifications required to the MND. The revisions, pursuant to CEQA Guidelines Section 15073.5 to the MND consist of clarifications and insignificant modifications and do not require recirculation.

SECTION 2.

The City Council has reviewed and considered the information contained in the MND, including the initial study, revisions, and conditions incorporated into the Project, the comments received during the public review process and the hearing on the Project, and all oral and documentary evidence received during the hearing on the Current Project.

The City Council has determined that the MND constitute an adequate, accurate, objective, and complete review of the proposed project.

SECTION 3.

Based on its review of the previously adopted MND for the Project, and all oral and documentary evidence received during the hearing, the City Council finds substantial evidence supports the use of the MND and the MND constitute an adequate, accurate, objective, and complete review of the proposed project.

SECTION 4.

Pursuant to CEQA section 21081.6 and CEQA Guidelines section 15074, and in support of its approval of the Project, the City Council adopts the Mitigation Monitoring Plan to require all reasonably feasible mitigation measures, including mitigation measures from the Master EIR as appropriate, be implemented by means of Project conditions, agreements, or other measures, as set forth in the Mitigation Monitoring Plan.

SECTION 5.

Upon approval of the Project, the City Manager shall file or cause to be filed a Notice of Determination with the Sacramento County Clerk and with the State Office of Planning and Research, pursuant to section 21152(a) of the Public Resources Code and the State EIR Guidelines adopted pursuant thereto.

SECTION 6.

Pursuant to Guidelines section 15091(e), the documents and other materials that constitute the record of proceedings upon which the City Council has based its decision are located in and may be obtained from, the Office of the City Clerk at 915 I Street, Sacramento, California. The City Clerk is the custodian of records for all matters before the City Council.

(ESA) around the burrow. During the breeding season (February 1 through August 31), the biologist shall establish a 300- foot ESA around the burrow in consultation with CDFW.
• The size of the ESA may be reduced if the biologist monitors the construction activities and determines that disturbance to the burrowing owl is not occurring. Reduction of ESA size depends on the location of the burrow relative to the proposed disturbance area, project activities during the time the burrow is active, and other project-specific factors.
• If the burrow is located within the construction zone and it is during the -breeding season, the burrowing owl shall be passively excluded from the burrow using one- way doors, as described in the Exclusion Plan of Appendix E of the CDFW’s 2012 Staff Report on Burrowing Owl non Mitigation.
• If the burrow is located within the construction zone and it is during the breeding season, the burrowing owl shall only be passively excluded if it has been confirmed that the owl has not begun egg laying and incubation, the clutch was unsuccessful, or juveniles from the occupied burrows are foraging independently and are capable of independent survival.

Nesting Birds and Raptors
IV-2 If construction activities on the project site are to begin during the nesting season for raptors or other protected bird species in the region (generally February 15- September 15), a qualified biologist shall be retained by the project applicant to conduct pre- construction surveys in areas of suitable nesting habitat for common raptors and other bird species protected by the MBTA or California Fish and Game Code located within 500 feet of project activity, as accessible. Surveys shall be conducted no more than 10 days before ground disturbance is expected to occur. The pre- construction surveys shall be submitted to the City’s Community Development Department. If active nests are not found, further mitigation is not required. If active nests are found, the construction contractor shall avoid impacts on such nests by establishing a no- disturbance buffer around the nest. The appropriate buffer size for all nesting birds shall be determined by a qualified biologist, but shall extend at least 50 feet from the nest. Buffer size will vary depending on site- specific conditions, the species of nesting bird, nature of the project activity, the extent of existing disturbance in the area, visibility of No more than 10

several alternative means, including:

• Planning construction to avoid archaeological sites and/or other cultural resources; incorporating cultural resources within parks, green-space or other open space; covering archaeological resources; deeding a cultural resource to a permanent conservation easement; or other preservation and protection methods agreeable to consulting parties and regulatory authorities with jurisdiction over the activity.
• Recommendations for avoidance of cultural resources will be reviewed by the City representative and other appropriate agencies, in light of factors such as costs, logistics, feasibility, design, technology and social, cultural and environmental considerations, and the extent to which avoidance is consistent with project objectives. Avoidance and design alternatives may include realignment within the project site to avoid cultural resources, modification of the design to eliminate or reduce impacts to cultural resources or modification or realignment to avoid highly significant features within a cultural resource.
• If the discovered cultural resource can be avoided, the construction contractor(s), will install protective fencing outside the site boundary, including a 100- foot buffer area, before construction restarts. Use of temporary and permanent forms of protective fencing will be determined in consultation with Native American representatives from interested culturally affiliated Native American tribes. • The construction contractor(s) will maintain the protective fencing throughout construction to avoid the site during all remaining phases of construction. The area will be demarcated as an “Environmentally Sensitive Area”.

If a cultural resource cannot be avoided, the following performance standard shall be met prior to continuance of construction and associated activities that may result in damage to or destruction of cultural resources:

• Each resource will be evaluated for California Register of Historical Resources- (CRHR) eligibility through application of established eligibility criteria (California Code of Regulations 15064.636), in

consultation with consulting Native American Tribes, as applicable. • If a cultural resource is determined to be eligible for listing in the CRHR, the City will avoid damaging effects to the resource in accordance with California PRC Section 21084.3, if feasible. The City shall coordinate the investigation of the find with a qualified archaeologist (meeting the Secretary of the Interior’s Professional Qualifications Standards for Archeology) approved by the City. As part of the site investigation and resource assessment, the City and the archaeologist shall assess the significance of the find, make recommendations for further evaluation and treatment as necessary and provide proper management recommendations should potential impacts to the resources be determined by the City to be significant.

A written report detailing the site assessment, coordination activities, and management recommendations shall be provided to the City representative by the qualified archaeologist. These
recommendations will be documented in the project record.

V-2 Implement Procedures in the Event of the Inadvertent Discovery of Human Remains.

If an inadvertent discovery of human remains is made at any time during project-related construction activities or project planning, the following performance standards shall be met prior to implementing or continuing actions such as construction, which may result in damage to or destruction of human remains. In accordance with the California Health and Safety Code (HSC), if human remains are encountered during ground- disturbing activities, the City shall immediately halt potentially damaging excavation in the area of the remains and notify the Sacramento County Coroner and a professional archaeologist to determine the nature of the remains. The Coroner is required to examine all discoveries of human remains within 48 hours of receiving notice of a discovery on private or State lands (HSC Section 7050.5[b]).

If the human remains are of historic age and are determined to be not of Native American origin, the City will follow the provisions of the HSC Section 7000 (et seq.) regarding the disinterment and removal of non- Native American human remains.

ADOPTING FINDINGS OF FACT AND APPROVING
CORPORATE WAY GREENHAVEN SELF STORAGE (P24-014)
(APN: 031-0051-019-0000)

BACKGROUND

A. On December 12, 2024, the City Planning and Design Commission conducted a public hearing on Corporate Way Greenhaven Self Storage (P24-014) and forwarded a recommendation of approval of the Project to City Council.

Section 1. Based on the verbal and documentary evidence received at the hearing on the Project, the City Council approves the Project entitlements based on the findings of fact and subject to the conditions of approval as set forth below

Section 2. The City Council approves the Project entitlements based on the following Findings of Fact:

FINDINGS OF FACT
A. The Conditional Use Permit to establish a mini-storage facility in the General Commercial (C-2-EA-3-PUD) zone, Executive Airport Overlay, and Greenhaven Executive Park Planned Unit Development is approved based on the following Findings of Fact:

1. The proposed use and its operating characteristics are consistent with the general plan in that the proposed mini-storage facility is consistent with the Office Mixed Use designation which allows for complementary commercial, and service uses that promote compact development patterns (LUP-1), supporting a balanced mix of uses (LUP-2), and improving services within the PUD, Pocket Greenhaven Community and surrounding area.

2. The proposed use and its operating characteristics are consistent with the applicable standards, requirements, and regulations of the zoning districts in which it is located, and of all other provisions of this title and this code, in that the project complies with development standards of the C-2 zoning district and this project meets all requirements in terms of setbacks, height, landscaping, and special use regulations in SCC section 17.228.106

3. The proposed use is situated on a parcel that is physically suitable in terms of location, size, topography, and access, and that is adequately served by public services and utilities, in that the project location has been evaluated to ensure safe access internally and in relation to Corporate Way.

4. The proposed use and its operating characteristics are not detrimental to the public health, safety, convenience, or welfare of persons residing, working, visiting, or recreating in the surrounding neighborhood and will not result in the creation of a nuisance, in that the project will be self-contained within the building and will not generate excessive noise, light, or odors associated with the business. Additionally, the operations will not result in any conflicts with the existing nature of the surrounding businesses or result in any nuisance activity. The use will generate new and repeat customers to the site that will activate the ground floor of the building near the street. The proposed use is not anticipated to generate a high number of vehicle trips; vehicles will range from standard passenger vehicles to medium sized trucks and vans carrying goods for storage that will utilize the provided loading zones, onsite parking spaces, or use street parking.

B. Site Plan and Design Review to construct a three-story, 152,625 square foot mini storage building and associated site improvements. is approved based on the following Findings of Fact:

1. The design, layout, and physical characteristics of the proposed development is consistent with the Office Mixed Use land designation in that this project develops a vacant infill site with a compatible neighborhood supportive use that features quality architectural detailing and materials, consistent with LUP-1 and LUP-2.

2. The design, layout, and physical characteristics of the proposed development are consistent with all applicable design guidelines and with all applicable development standards or, if deviations from design guidelines or development standards are approved, the proposed development is consistent with the purpose and intent of the applicable design guidelines and development standards. The project is designed to provide a 26-foot front-yard setback planted with native trees and landscaping and landscaping coverage of 28% consistent with the landscaping standards within the Greenhaven Executive Park PUD. The proposed building design is cohesive with other existing commercial buildings in the PUD by incorporating fiber cement nichiha panels along the front elevation. Aluminum storefronts along with a variety of metal and fiber cement panel configurations utilizing offsets, color tones, and varying dimensions will create a complete design theme across the building. The roof parapets will vary at multiple points of the building, creating additional variation to the elevations. There are no deviations to design guidelines or development standards.

3. All streets and other public access ways and facilities, parking facilities, and utility infrastructure are adequate to serve the proposed development and comply with all applicable design guidelines and development standards, in that the proposed project provides onsite and offsite improvements to sufficiently serve this project and its users through appropriate stormwater management, extension of necessary public and private utility infrastructure, and landscaping improvements.

4. The design, layout, and physical characteristics of the proposed development are visually and functionally compatible with the surrounding neighborhood in that the project proposes a modern, well-articulated building design in a neighborhood with a diverse range of commercial uses.

5. The design, layout, and physical characteristics of the proposed development ensure energy consumption is minimized, and use of renewable energy sources is encouraged in that the project will use building materials that will help reduce energy costs as required by the California Green Building Code. Furthermore, the site exceeds the 20% shading requirements which helps reduce the urban heat island effect which translates to reduced cooling costs in the summer months.

6. The design, layout, and physical characteristics of the proposed development are not detrimental to the public health, safety, convenience, or welfare of persons residing, working, visiting, or recreating in the surrounding neighborhood and will not result in the creation of a nuisance, in that the site will have an attractive street presence, ample landscaping, and pedestrian connections to the street.

C. 200-Year Flood Protection

1. 200-Year Flood Protection: The project site is within an area for which the local flood-management agency has made adequate progress (as defined in California Government Code section 65007) on the construction of a flood-protection system that, for the area intended to be protected by the system, will result in flood protection equal to or greater than the urban level of flood protection in urban areas for property located within a flood- hazard zone, as demonstrated by the SAFCA Urban Level of Flood Protection Plan and Adequate Progress Baseline Report and the SAFCA Adequate Progress Toward an Urban Level of Flood Protection Engineer’s Report, each accepted by the City Council on June 21, 2016 (Resolution No. 2016-0226), and the SAFCA 2024 Adequate Progress Annual Report accepted by the City Council on October 22, 2024 (Resolution No. 2024- 0311).

B73. SMUD has existing underground 12kV facilities on south west and north east of the PROJECT SITE that will need to remain. The Applicant shall be responsible for maintaining all CalOSHA and State of California Public Utilities Commission General Order No. 128 safety clearances during construction and upon building completion. If the required clearances cannot be maintained, the Applicant shall be responsible for the cost of relocation.

B74. Structural setbacks less than 14-feet shall require the Applicant to conduct a pre- engineering meeting with all utilities to ensure property clearances are maintained.

B75. Any necessary future SMUD facilities located on the Applicant’s property shall require a dedicated SMUD easement. This will be determined prior to SMUD performing work on the Applicant’s property.

B76. In the event the Applicant requires the relocation or removal of existing SMUD facilities on or adjacent to the subject property, the Applicant shall coordinate with SMUD. The Applicant shall be responsible for the cost of relocation or removal.

B77. SMUD reserves the right to use any portion of its easements on or adjacent to the subject property that it reasonably needs and shall not be responsible for any damages to the developed property within said easement that unreasonably interferes with those needs.

B78. The Applicant shall not place any building foundations within 5-feet of any SMUD trench to maintain adequate trench integrity. The Applicant shall verify specific clearance requirements for other utilities (e.g., Gas, Telephone, etc.).

B79. The Applicant shall comply with SMUD siting requirements (e.g., panel size/location, clearances from SMUD equipment, transformer location, service conductors). Information regarding SMUD siting requirements can be found at:
https://www.smud.org/en/BusinessSolutions-and-Rebates/Design-and- Construction-Services.

B80. The Applicant shall dedicate a 12.5-foot public utility easement for overhead and/or underground facilities and appurtenances adjacent to all public street rights-of-ways.

B81. The Applicant shall dedicate and provide all-weather vehicular access for service vehicles that are up to 26,000 pounds. At a minimum: (a) the drivable surface shall be 20-feet wide; and (b) all SMUD underground equipment and appurtenances shall be within 15-feet from the drivable surface.

DEPARTMENT OF UTILITIES
B82. Per City Code Section, 13.04.070, multiple water services to a single lot or parcel may be allowed if approved by DOU Development Review and Operations and Maintenance staff. Any new water services (other than fire) shall be metered.

Excess services shall be abandoned to the satisfaction of the DOU.

B83. Prior to or concurrent with the submittal of improvement plans, prepare a project specific water study for review and approval by the DOU. The water system shall be designed to satisfy the more critical of the two following conditions: (1) at maximum day peak hour demand, the operating or "residual" pressure at all water service connections shall be at least 30 pounds per square inch, (2) at average maximum day demand plus fire flow, the operating or "residual" pressure in the area of the fire shall not be less than 20 pounds per square inch.

The water study shall determine if the existing and proposed water distribution system is adequate to supply fire flow demands for the project. A water supply test may be required for this project. The applicant is advised to contact the City of Sacramento Utilities Department Development Review Section (916-808- 7890) at the early planning stages to address any water related requirements.

Failure to submit the water study may delay review and approval.

B84. Common area landscaping shall have a separate street tap for a metered irrigation service.

B85. This project is served by the Separated Sewer System. Therefore, the developer/property owner will be required to pay the Separated Sewer System Development Fee prior to the issuance of building permit per City Council Resolution 2023-0338. The fee will be used to upsize City sewer mains and sewer pumps. The applicant is recommended to contact the Department of Utilities Development Services at 916-808-7890 for a separated sewer fee estimate.

B86. Prior to or concurrent with the submittal of the building permit application, the applicant shall prepare a project specific drainage study meeting the criteria specified in the current Onsite Design Manual and/or the Design and Procedures Manual, for review and approval by the DOU. Per the current DOU Onsite Design Manual, either a static or dynamic analysis for mitigating sizing and drainage system design may be used. Using the static analysis and per the DOU onsite project storage method, an estimated 6,000 cubic feet of detention must be provided per each additional acre of impervious area. The maximum discharge rate must be limited to an estimated 0.25 cfs/acre. The applicant is advised to contact the City of Sacramento Utilities Department Development Review Section (916-808-7890) at the early planning stages to address any drainage related requirements. Failure to submit the drainage study may delay review and approval. Note: A maintenance agreement may be required for detention and Low Impact Development (LID) features.

B87. This project is in Drainage Basin 142 which is subject to the new Drainage Pumped Impact Fee per City Council Resolution 2023-0368.

B88. The onsite water, sewer and storm drain systems shall be private systems maintained by the owner or other approved entity.

B89. All on-site drainage systems shall be designed to the standards specified in the DOU onsite design manual.

B90. Finished floor elevations shall be a minimum of 6-inches above the 100-year HGL or 1-foot above the overland flow release elevation, whichever is higher or as approved by the DOU.

B91. No more than 6,000 square feet is allowed to sheet drain over a public sidewalk.

If the area is larger than 6,000 square feet, then an on-site surface drainage system is required and shall be connected to the street drainage system by means of a storm drain service tap. All on-site systems shall be designed to the standard specified in the DOU onsite manual.

B92. A grading plan showing existing and proposed elevations is required. Adjacent off-site topography shall also be shown to the extent necessary to determine impacts to existing surface drainage paths. No grading shall occur until the grading plan has been reviewed and approved by the DOU.

B93. This project will disturb more than one acre of land; therefore, the project is required to comply with the State’s “Construction General Permit”. To comply with the State Permit, the applicant must file a Notice of Intent (NOI) through the State’s Storm Water Multiple Application and Report Tracking System (SMARTS). A valid WDID number must be obtained and provided to the DOU prior to the issuance of any grading permits.

B94. The applicant must comply with the City of Sacramento's Grading, Erosion and Sediment Control Ordinance. This ordinance requires the applicant to show erosion and sediment control methods on the construction drawings. These plans shall also show the methods to control urban runoff pollution from the project site during construction.

B95. Post construction (permanent), stormwater quality control measures shall be incorporated into the development to minimize the increase of urban runoff pollution caused by development of the area. The project is an area not served by an existing regional water quality control facility and/or the project has more than one-acre of new or modified impervious area; therefore, Low Impact Development (LID), Hydromodification Management Plan (HMP), certified full capture trash control devices, and permanent on-site treatment measures will be required. The on-site storm water treatment measures required may affect site design and site configuration and should be considered during early planning stages.

B96. A separate maintenance agreement will be required for both on-site treatment measures and full capture control devices. Contact DOU for a list of accepted proprietary devices considered for treatment control and full capture trash control. Construction drawings must include all proposed source controls and on-site water quality measures selected for the site. Refer to the latest edition of the “Stormwater Quality Design Manual for the Sacramento Region” for appropriate measures. A maintenance plan and guidelines will be required for all City owned and maintained basins.

REGIONAL SAN
B97. Prior to the ISSUANCE OF A BUILDING PERMIT: The owner must contact the Regional San Permit Services Unit at [email protected] or by phone at (916) 876-6100 to determine if sewer impact fees are due. Fees are to be paid prior to the issuance of building permits.

URBAN FORESTRY

B98. This project shall contract with a Project Arborist experienced with tree protection and construction that is required to:

a) Attend the preconstruction meetings to approve of and inform contractors of all tree protection measures.
b) Visit the site before and after demolition, grading and landscaping as well as at least twice each month during construction to ensure that tree protection measures are implemented and maintained.
c) Be responsible for correcting any site conditions that may negatively impact the trees and revisit the site to ensure that corrective action was properly implemented.
d) The Project Arborist shall report in writing to Urban Forestry all violations and tree protection failures along with corrective action taken and expected outcomes.

B99. All concrete sidewalks and driveways shall be retained throughout construction to protect the roots and soil from the impacts of construction activities.

a) Existing driveways shall be used as the sole access to the site. Where there are no existing driveways, access shall be limited to a one or two locations outside the dripline of protected trees that have protection from soil compaction with the use of one or more of the following: A 6-inch layer of hardwood chips covered by ¾-inch plywood or trench plates, geotextile fabric covered by a 6-inch layer of hardwood chips or an alternative that is approved by the City Arborist.

B100. Construction trailers and port-a-potties shall be placed on existing hardscape or bridged over the tree protection zone or planter so as not to compact soil.

B101. Any Regulated Work within the dripline or Tree Protection Zone of a protected tree shall be separately permitted prior to the start of construction and supervised by a Certified Arborist. Submit a tree permit application and a tree protection plan created by a Certified Arborist to [email protected] and refer to the planning project number or off-site project number.

B102. All excavation, grading, or trenching within the dripline of a protected tree for the purpose of utility installation, constructing foundations, footings, sidewalks, curbs, gutters, or any other reason shall employ one of the following methods: Hydro- excavation, pneumatic excavation or hand digging and shall be directly supervised by a Certified Arborist.

B103. There shall be no excavation deeper than the existing excavation for sidewalks within the dripline of protected trees.

B104. There shall be no grade changes within the dripline of protected trees. All grade changes shall be accommodated onsite.

B105. There shall be no soil compaction within the dripline of protected trees.

B106. The following is a list of activities that require a tree permit if they are to occur or be used within the right-of-way planter and/or within the tree protection zone of protected trees: any regulated work as defined in SCC 12.56, excavation, grade changes, trenches, root or canopy pruning, or boring.

B107. The following is a list of activities that are prohibited within the right-of-way planter and/or tree protection zone of protected trees: pedestrian and equipment traffic that could compact the soil or physically damage roots, parking vehicles, equipment and/or port-a-potties, storing of soil, construction materials, petroleum products, water or building refuse, disposing of wash water, paint, cement, fuel or other potentially damaging liquids, and any other activities that may have negative impacts on the trees and soil.

B108. All trees shall be watered regularly according to the recommendation of the Project Arborist.

Subject: Objection to Self-Storage Facility on Corporate Way (Project P24-014) Based on Zoning, Aesthetic, and Community Impact Concerns

Dear Mr. Bess,
I am writing to express my personal objection to the proposed self-storage facility on Corporate Way (Project P24-014). As both a resident and business owner in the Pocket area, and as a property owner on Corporate Way, I am concerned that this development is misaligned with our community’s character, needs, and aesthetic. I respectfully request that the City reconsider this project based on the following issues:

Incompatibility with Surrounding Land Use and Aesthetic: The planned three-story self-storage facility does not fit the character of the surrounding area, which includes schools, residential homes, and community-centered institutions. This large commercial structure disrupts the general aesthetic of the neighborhood and does not align with the family-friendly, low-rise design valued in the Pocket area.

Lack of Community Benefit: The proposed self-storage facility does not address a community need, nor does it create meaningful employment opportunities for local residents. Moreover, there is already an existing self-storage facility on Corporate Way, making this additional development redundant.

Environmental and Health Concerns Near a Preschool: I am particularly concerned about the facility’s proximity to a preschool, where construction and operational impacts on air quality, noise, and traffic directly endanger the health and safety of children and staff. The facility’s close proximity to such a sensitive site should be grounds for a more cautious approach to development.

Additionally, I worry that approving this rezoning sets a precedent that may open the door to future developments which do not align with the Pocket Community Plan or the needs of our area. Allowing this project to move forward under the new zoning designation could make it more difficult to preserve the neighborhood’s intended purpose and character in the future.

Thank you for your attention to these concerns. I appreciate the City’s consideration of the impact this project will have on the Pocket area’s long-term character and community goals.

Sincerely,
Robert Omoto, OD
