Description/Analysis
Issue Detail: The City currently has funds from two U.S. Environmental Protection Agency (EPA) Brownfield Revolving Loan Fund (BRLF) grants. The EPA defines a brownfield as a property, the expansion, redevelopment, or reuse of which may be complicated by the presence or potential presence of hazardous substance, pollutant or contaminant. In 2018, the EPA awarded the City a BRLF grant in the amount of $750,000. The RLF funds can be used to make loans and subgrants for the remediation of publicly- or privately-owned brownfield sites. The City also has approximately

$1.2 million in program income from a closed RLF grant originally awarded to the City in multiple installments between 1997 and 2010. Program Income funds can be used to provide loans and subgrants for a wider array of tasks, including to inventory, characterize, asses, conduct cleanup and reuse planning, direct cleanup, and monitoring of publicly- and privately-owned brownfield sites.

In order to perform our duties under the grants, the City must have access to environmental consultants to conduct a number of environmental services including environmental site assessments, hazardous building surveys, geophysical testing, soil sampling and remediation oversight. The on-call contracts increase efficiency and allow for expedited contracting on an asneeded basis.

Policy Considerations: The actions in this report related to the BRLF grant are consistent with the 2040 General Plan Land Use and Placement Element Policy LUP-4.2 Incentivizing Infill as it facilitates and promotes an economic incentive for infill development in key infill and opportunity areas.

Economic Impacts: None at this time.

Environmental Considerations: This report does not relate to a project requiring review under the California Environmental Quality Act, consistent with CEQA Guidelines sections 15060(c)(3) and 15378(b)(4), because it relates to government fiscal activities of the City that do not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment; furthermore, this report relates to activities that are exempt from the National Environmental Policy Act (24 C.F.R. §58.34 (a)(1)).

Sustainability: The City’s brownfields work promotes sustainability by eliminating property contamination and supporting infill development.

Commission/Committee Action: Not Applicable.

Rationale for Recommendation: In October 2024, the Office of Innovation and Economic Development solicited Statements of Qualifications from consulting firms for environmental consulting services. In November 2024, the City received eleven Statements of Qualifications. The selection committee conducted a review and evaluation of the submittals based on team qualifications and experience, experience with public agencies and regulators, and experience with U.S. EPA grant funded projects. The following top ranked firms were selected to enter into on-call professional service agreements: Geocon Consultants, Inc.; Nichols Consulting Engineers, Chtd.; Ninyo and Moore; Stratus Engineering Associates; and Terracon Consultants, Inc.

Financial Considerations: Each on-call contract will not exceed $350,000. Notice to Proceeds

approved and managed by staff will not exceed $250,000 per project. Purchase orders encumbering funds under each contract will not be opened until funding is identified. The costs extended under these agreements will be paid predominately by the Brownfields Revolving Loan (G02180100, Fund 2029) and the Brownfield Revolving Loan Program Income Projects (I02180800, Fund 2029), however, other funding may be used as necessary. Funding for future years will be subject to funding availability in the applicable fiscal year.

Local Business Enterprise (LBE): Federal requirements prohibit using geographic preferences in conducting procurement for federally funded projects, even if those preferences are authorized by state, tribal, or local law (2 CFR 200.319).
