Description/Analysis
Issue Detail: The Department of Utilities (DOU) is a member of a Sacramento Stormwater Quality Partnership (Partnership) to regionally manage stormwater pollution prevention activities as outlined in the 2012 Memorandum of Understanding Regarding Administrative Responsibilities and Apportionment of Costs between Permittees Under NPDES Permit No. CAS082597 (Agreement 2012-0656). The stormwater management activities coordinated by the Partnership include annual contracts managed by Sacramento County, which are described in more detail in the Background section of this report below.

Policy Considerations: The contract authority to expend these costs is provided by a Memorandum of Understanding for Division of Administrative Responsibilities and Apportionment of Costs (2012- 0656) (2012 MOU) approved by City Council on July 31, 2012. This staff report informs Council of budgeted expenditures for the next five years and requests Council approval of those costs.

Economic Impacts: None.

Environmental Considerations: This report concerns continuing administrative activities and the creation of government funding mechanisms or other government fiscal activities which do not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment. These activities do not constitute a “project” as defined by California Environmental Quality Act (CEQA) [CEQA Guidelines Sections 15378(b)(2 and 4)] and is therefore, not subject to CEQA [CEQA Guidelines Section 15060(c)(3)].

Sustainability: Monitoring, pesticide reduction, and public outreach activities coordinated through the Sacramento Stormwater Quality Partnership support compliance with the City’s NPDES Permit and are consistent with the 2040 General Plan by supporting Goal ERC-1.3: “The City shall protect surface water and groundwater resources from contamination from point (single location) and non- point (many diffuse locations) sources, as required by federal and State regulations.” Commission/Committee Action: Not applicable.

Rationale for Recommendation: In partnering with other agencies, the City is pooling its staff and financial resources regionally to meet regulatory requirements and protect water quality.

Financial Considerations: The authorization proposed is for FY2024/25 through FY2029/30 and is for a total amount not-to-exceed $464,103. Sufficient funding exists in the NPDES Stormwater Program, Storm Drainage Fund (I14010200, Fund 6011).

There are no General Funds allocated or planned for this project.

Local Business Enterprise (LBE): Not applicable.

The City of Sacramento is a member of the Sacramento Stormwater Quality Partnership (Partnership), which was formed for Sacramento County agencies identified as Phase 1 municipal separate storm sewer system (MS4s) permittees (Permittees) to jointly implement a comprehensive stormwater management program to meet the requirements of the Central Valley Regional Water Quality Control Board Regional MS4 National Pollutant Discharge Elimination System (NPDES) Permit. The Sacramento Stormwater Quality Partnership’s 2012Memorandum of Understanding Regarding Administrative Responsibilities and Apportionment of Costs between Permittees Under NPDES Permit No. CAS082597 (MOU) (Agreement 2012-0656) established the joint processes for collaboration and cost-sharing with other Permittees to address common issues and coordinate resources in regional programs, such as monitoring and public outreach. Table 1 provides a summary of cost sharing for each partner, as recorded in the 2012 MOU, based on population.

Joint Authorizations are used to document agreement to the scope, budget, and cost share for each joint activity designated by either the MOU, Steering Committee, or the Permittees acting as Lead Permittees responsible for implementation of the activity. The Joint Authorizations establish a Contract Administrator, responsible for establishing a contract through its jurisdiction.

Contracts for Partnership activities/programs are primarily managed by both City of Sacramento and Sacramento County staff, as the Lead Permittees. All contracts managed by City of Sacramento staff are procured in accordance with City of Sacramento policies, and accordingly are approved by the Council or its delegated signatories on a contract by contract basis.

The County of Sacramento is the contract administrator for joint activities as presented in Table 2 below.
