Recommendation: 1) Pass a Motion by two-thirds vote waving the requirement for Personnel and Public Committee review, pursuant to Council Rules of Procedure Chapter 13, Section B.I.b.xi), and 2) adopt an Ordinance adding section 2.50.045 and amending sections 2.50.020, 2.50.030, and 8.96 of the Sacramento City Code relating to the Housing Code Advisory and Appeals Board.

Description/Analysis
Issue Detail: On September 24, 2024, City Council passed a series of ordinance amendments related to various City Boards and Commissions, including those relating to the Housing Code Advisory and Appeals Board. Additional amendments were unintentionally omitted from the amendment package. Failure to include the proposed amendments has prohibited the Board from operating under the full intended authority of the City Council.
Policy Considerations: As the Board has not been able to operate to the full intended authority City Council intended, hearing items have had to be postponed. In order for the Board to address pressing hearing items it is necessary to bypass review by the Personnel and Public Employees Committee and to print ordinance in its entirety in lieu of passing for publication.

BE IT ENACTED BY THE COUNCIL OF THE CITY OF SACRAMENTO:
SECTION 1.
Section 2.50.020 of the Sacramento City Code is hereby amended to read as follows:
2.50.020 Purpose of board.
The board is established for the purpose of providing final interpretation of the provisions of chapters 8.96 and 8.100 and hearing appeals provided thereunder.
SECTION 2.
Section 2.50.030 of the Sacramento City Code is hereby amended to read as follows:
2.50.030 Powers and duties of board.
The powers and duties of the board are as follows:
A. Provide final interpretation of the provisions of chapter 8.100.
B. Hear appeals provided for in chapter 8.100.
C. Recommend to the city council such new ordinances or amendments to chapter
8.100 (the housing code) as may be deemed desirable.
D. Provide final interpretation of the provisions of chapter 8.96.
E. Hear appeals provided for in chapter 8.96.
SECTION 3.
Section 2.50.045 is hereby added to the Sacramento City Code to read as follows:
2.50.045 Staff; rules and regulations; decisions.

A. The building official or designee shall serve as staff to the board.
B. The board may adopt reasonable rules and regulations for conducting its business.
Copies of all rules or regulations adopted by the board shall be delivered to the building official, who shall make them freely available to the public.
C. The board shall render all decisions and findings in writing to the parties and the building official.

Section 8.96.090 of the Sacramento City Code is hereby amended to read as follows:
8.96.090 Housing code advisory and appeals board.
The City of Sacramento hH ousing cCode aAdvisory and aA ppeals bBoard, created in Chapter 8.100 of this title, shall hear appeals provided for hereunder and shall provide final interpretations of this chapter code. Appeals to the board shall be processed in accordance with Aarticle V of this chapter. Copies of all rules and regulations adopted by the board shall be delivered to the building official, who shall make them freely accessible to the public. The housing code advisory and appeals board shall be referred to as the housing board in this chapter.
