4-Ordinance Removing Minimum Vehicle Parking Requirements (Redline) 5-Ordinance Removing Minimum Vehicle Parking Requirements (Clean) Description/Analysis
Issue Detail: On February 27, 2024, the City Council adopted the 2040 General Plan, which effectively eliminated City-mandated parking minimums citywide. The Land Use and Placemaking (LUP) Element of the General Plan includes the following pertinent regulatory policy:
LUP-4.14 Elimination of Vehicle Parking Minimums. The City shall not require new or
File ID: 2025-00742 3/25/2025 Consent Item 10.
existing development to provide off-street vehicle parking spaces.
Policy LUP-4.14 has been in effect since March 28, 2024, when the 2040 General Plan took effect.
However, the provisions of Title 17 of the Sacramento City Code (Planning and Development Code) relating to minimum off-street vehicle parking requirements have not yet been updated since the adoption of the new 2040 General Plan. State law (Government Code § 65860) requires that the zoning code be consistent with the general plan. The proposed ordinance amends provisions of Title 17 of the Sacramento City Code to ensure consistency with the 2040 General Plan as it relates to removing the minimum off-street vehicle parking requirements.
Policy Considerations: The 2040 General Plan was adopted on February 27, 2024, and became effective on March 28, 2024. General Plan Goal LUP-4 includes 16 policies that incentivize infill development to support walkable, transit-oriented centers and corridors that concentrate new jobs, housing, and entertainment opportunities to support frequent, reliable transit service and foster connected, accessible neighborhoods. This ordinance aligns the Sacramento City Code with the following 2040 General Plan policy:
LUP-4.14 Elimination of Vehicle Parking Minimums. The City shall not require new or existing development to provide off-street vehicle parking spaces.
This ordinance also supports implementation of the following Climate Action & Adaptation Plan action:
TR-2.2: Eliminate parking minimums Citywide, develop parking maximums and require parking management and transportation demand management plans for all areas of the City based on available transportation options, travel patterns, and land use.
In addition, this ordinance supports implementation of the following 2021-2029 Housing Element policy:
Program H8. Revisions to Parking Requirements. The City shall consider further eliminating City-mandated parking minimums and explore instituting parking maximums along established transit corridors.
Economic Impacts: Minimum vehicle parking requirements that require new development to provide more parking than the market demands can increase the cost of construction without producing an associated benefit, while reducing the amount of land available for other uses such as housing.
Eliminating minimum vehicle parking requirements can increase housing options by reducing costs associated with the provision of parking. Increasing the availability of housing will improve residents’ ability to better their economic situations, reduce poverty and homelessness, and promote social integration. Eliminating minimum vehicle parking requirements can also improve land use efficiency

by allowing a larger portion of a property to be developed for housing or commercial uses instead of for parking vehicles. This is anticipated to increase overall economic activity, encourage new businesses and business expansions, and support a built environment that supports mode shifts to transit and active transportation.
Environmental Considerations: The City has prepared an Initial Study for the ordinance (project) in compliance with the California Environmental Quality Act (CEQA), and has concluded that the project would not result in any additional significant environmental effects not previously analyzed in the Master Environmental Impact Report (EIR) for the 2040 General Plan, certified by the City on February 27, 2024. Pursuant to Public Resources Code section 21157.1 and CEQA Guidelines section 15177, the City has determined that the project is a subsequent project within the scope of the 2040 General Plan Master Environmental Impact Report. The City noticed the Initial Study for a 30-day review period, as required by CEQA Guidelines section 15087. The Initial Study was made available from 2/21/25 through 3/24/25 on the City of Sacramento’s website:
https://www.cityofsacramento.gov/community-development/planning/environmental/impact-reports Sustainability: Eliminating minimum vehicle parking requirements is expected to reduce housing development costs, thereby contributing to increased housing production and attainability that will contribute to sustainable economic growth in Sacramento. Additionally, eliminating minimum vehicle parking requirements can increase development density and land use intensity, functionally reducing distances between homes and businesses. In coordination with City efforts to concentrate new development in centers and corridors that are supportive of active transportation and transit mode shifts, the removal of minimum parking requirements can contribute to development patterns that support the City’s goals to shift more trips to low-carbon modes of transport including transit, bicycling, and walking.
Commission/Committee Action: On February 27, 2025, the Planning & Design Commission conducted a public hearing on the ordinance. The Commission passed a motion to forward the resolution for environmental review and the ordinance, as presented, to the City Council for consideration.
On March 11, 2025, the Law and Legislation Committee reviewed and forwarded the resolution for environmental review and the ordinance, as presented, to the City Council for consideration.
Rationale for Recommendation: Staff recommend the City Council review the ordinance and pass for publication the ordinance per Sacramento City Charter Section 32 for City Council consideration on April 8, 2025. The proposed ordinance will ensure that Title 17 of the Sacramento City Code is consistent with the 2040 General Plan which requires that the City not mandate minimum off-street vehicle parking requirements in new or existing development.
Financial Considerations: Not applicable.
File ID: 2025-00742 3/25/2025 Consent Item 10.
Local Business Enterprise (LBE): Not applicable.
Attachment 2 – Background
Since 2013 the City and State have been making modifications to off-street vehicle parking regulations, which have removed minimum parking requirements in the following areas:
2013: The City eliminated all minimum vehicle parking requirements in the "Central Business District and Arts & Entertainment District" and removed parking minimums citywide for non-residential projects on small lots of 6,400 square feet or less.
2019: The City removed minimum parking requirements within a 1/4 mile of existing and proposed light rail stations. The City also reduced minimum parking requirements by 50% for parcels between 1/4 and 1/2 mile from a light rail station.
2021: The City ended minimum parking requirements for accessory dwelling units (ADUs).
January 2023: Assembly Bill (AB) 2097 went into effect, prohibiting minimum parking mandates within a 1/2 mile of a major transit stop. AB 2097 affects 46% of the land area within Sacramento.
On February 27, 2024, the City concluded a robust multi-year effort to update the 2035 General Plan with the adoption of the new 2040 General Plan. The 2040 General Plan officially eliminated citywide mandatory parking minimums, with the following policy in the Land Use and Placemaking (LUP) Element:
LUP-4.14 Elimination of Vehicle Parking Minimums. The City shall not require new or existing development to provide off-street vehicle parking spaces.
State law (Government Code § 65860) mandates that the zoning code be consistent with the general plan. Therefore, following the adoption of the new General Plan, staff drafted the proposed ordinance which will align provisions of Title 17 of the Sacramento City Code regarding minimum off-street vehicle parking requirements with the newly adopted General Plan.
Eliminating parking minimums has not meant that off-street parking spaces are no longer being provided. Developers and lenders, who closely monitor market demand, can provide the number of parking spaces they deem necessary or preferable for their project, whether for residential or commercial properties.

SECTION 31.
SecƟon 17.608.010 of the Sacramento City Code is hereby amended to read as follows:
17.608.010 Purpose.
The purpose of this chapter is to implement general plan goals and policies by establishing off-street vehicle and bicycle parking requirements that balance the city's goal to encourage walking, bicycling, and transit use with the goal to provide adequate off-street parking to meet the needs of shoppers, visitors, and employees and other workers, and reduce on-street vehicle parking demand on nearby residential streets.
Off-street parking requirements are based on the needs of the community and consider the context of the neighborhood, transit availability, on-street parking availability, density and mix of uses, walkability, and the use of alternative modes of transportation.
Parking requirements are designed to accommodate average day-to-day demand, as opposed to peak demand, to reduce excessive off-street parking and free up land for more economically productive uses. It is also the purpose of this chapter to provide flexibility and allow alternative means of addressing parking demand.
14 SECTION 32.
SecƟon 17.608.020 of the Sacramento City Code is hereby amended to read as follows:
17.608.020 General provisions.
A. Off-street parking requirement. Off-street vehicle parking shall not be exceeded and bicycle parking shall be provided and maintained for all existing and new development at the ratios specified in and in accordance with the standards and requirements of this chapter.
B. Parking to be provided on-site. Required off-street parking shall be provided and maintained on the same parcel or integrated development site as the land use it is intended to serve, except as provided in section 17.608.060. An integrated development site is a site consisting of two or more contiguous parcels sharing parking facilities with reciprocal access and parking easements or similar shared-parking agreements.
C. Calculation of the off-st reet parking requirement. The required maximum number of off-street vehicle and minimum number of bicycle parking spaces shall be rounded in accordance with section 17.104.050.C.
D. Expansion or change in use of exis ting buildings and structures that do not meet current parking requirements. The following rules apply to buildings and uses that met all applicable parking requirements when initially constructed or established, but that do not meet current parking requirements due to changes to the building or use.
1. Increases in building size.
a. Additional vehicle and bicycle parking is required in accordance with chapter 17.608 only when there is an increase in gross building square footage of 15% or more or, in the case of a residential project, an increase in the number of residential units by 15% or more.
a. When there is an increase in gross building square footage of less than 15% or, in the case of a residential project, an increase in the number of residential units of less than 15%, no vehicle parking is required, and, additional bicycle parking shall be provided in accordance with chapter 17.608 unless—
i. the increase in building square footage is less than 15% or, in the case of a residential project, the increase in the number of residential units is less than 15%; and
15 ii. it is physically infeasible to accommodate the
additional bicycle spaces.
b. When additional bicycle parking is required by this
subsection D.1, it is required only for the additional gross building square footage or residential units.
2. Change in use.
a. When a conditional use permit is required for a new use, both vehicle and bicycle parking shall be provided in accordance with chapter 17.608.
b. When a conditional use permit is not required, no additional vehicle or bicycle parking is required.
E. Restaurant outdoor seating. Square footage allocated to restaurant outdoor seating is not included in calculating the minimum off-street vehicle parking requirement for restaurants.
F. Affordable housing and senior housing.
1. The oƯ-street vehicle parking requirement is reduced by 50% or each aƯordable housing unit and each senior housing unit.
21. The bicycle parking requirement is reduced by 50% for each senior housing unit.
32. For purposes of this section, an "affordable housing unit" is a housing unit restricted to occupancy by a lower or very low income household as defined in section 50079.5 of the California Health and Safety Code section 50079.5. A "senior housing unit" is a housing unit restricted to occupancy based on age requirements for older persons under section 51.3 of the California Civil Code section
51.3. G. Transit-oriented development.
1. There is no minimum off-street vehicle parking requirement for uses located within one-quarter mile from the center of an existing or proposed light rail station platform.
2. The off-street vehicle parking requirement is reduced by 50% for uses located greater than one-quarter mile but less than or equal to one-half mile from the center of an existing or proposed light rail station platform.
16 HG. Accessibility and electric vehicle charging.
1. If a building permit requires an existing off-street parking facility to comply with any building standards or other requirements in the Sacramento City Building Code related to accessibility, or if accessible parking spaces are otherwise created, the number of parking spaces required by this title may be reduced, redesigned, and restriped as necessary without issuance of a permit under this title.
2. If a building permit requires an existing off-street parking facility to comply with any building standards or other requirements in the Sacramento City Building Code related to electric vehicle charging spaces or if electric vehicle charging spaces are otherwise created, the number of parking spaces required by this title may be reduced, redesigned and restriped, as necessary without issuance of a permit under this title.
IH. Exemptions for small lots. Off-street parking is not required for nonresidential uses on lots of 6,400 square feet or less.
JI. Exemptions for nonresidential uses in residential mixed use development.
Off-street parking is not required for non-residential uses in mixed use buildings in which at least 50% of the building's square footage is devoted to residential uses.
KJ. Exemptions for adaptive reuse. Off-street vehicle and bBicycle parking is not required for those portions of historic resources that are converted from nonresidential uses to residential uses.
LK. Exemptions for accessory dwelling units and junior accessory dwelling units.
When parking is removed in conjunction with the construction of an accessory dwelling unit or junior accessory dwelling unit, no replacement parking is required for the accessory dwelling unit or other dwelling units on the same lot.
ML. Authority to require greater or fewer off-street parking spaces. The zoning administrator, planning director, planning and design commission, or city council may require greater or fewer off-street parking spaces than required by this chapter, or may impose other parking-related requirements, as a condition of a conditional use permit, variance, or site plan and design review, unless prohibited from doing so by California Government Code section 65863.2.
N. Exemptions for development near a major transit stop. Off-street vehicle parking is not required for development on sites located within one-half mile of a major transit stop as defined in California Public Resources Code section 21155, subdivision (b). In the case of a conflict between the city's standards set forth in this subsection and the requirements set forth in California Government Code section 65863.2, the provisions of the California Government Code prevail.
17 SECTION 33.
A. SubsecƟon B of secƟon 17.608.030 of the Sacramento City Code is hereby amended to read as follows:
B. Maximum number of off-street Vvehicle parking requirements spaces.
Maximum Vvehicle parking requirements are established for land uses in each parking district as stated in Table 17.608.030B establishes the maximum number of off-street vehicle parking spaces allowed for land uses within each parking district. SECTION 31.
Section 17.608.010 of the Sacramento City Code is hereby amended to read as follows:
17.608.010 Purpose.
The purpose of this chapter is to implement general plan goals and policies by establishing off-street vehicle and bicycle parking requirements that balance the city's goal to encourage walking, bicycling, and transit use with the goal to meet the needs of shoppers, visitors, and employees and other workers.
SECTION 32.
Section 17.608.020 of the Sacramento City Code is hereby amended to read as follows:
17.608.020 General provisions.
A. Off-street parking requirement. Off-street vehicle and bicycle parking shall be provided and maintained for all existing and new development at the ratios specified in and in accordance with the standards and requirements of this chapter.
B. Parking to be provided on-site. Required off-street parking shall be provided and maintained on the same parcel or integrated development site as the land
14 use it is intended to serve, except as provided in section 17.608.060. An integrated development site is a site consisting of two or more contiguous parcels sharing parking facilities with reciprocal access and parking easements or similar shared-parking agreements.
C. Calculation of the off-street parking requirement. The maximum number of off-street vehicle and minimum number of bicycle parking spaces shall be rounded in accordance with section 17.104.050.C.
D. Expansion or change in use of existing buildings and structures that do not meet current parking requirements. The following rules apply to buildings and uses that met all applicable parking requirements when initially constructed or established, but that do not meet current parking requirements due to changes to the building or use.
1. Increases in building size.
a. When there is an increase in gross building square footage or, in the case of a residential project, an increase in the number of residential units, additional bicycle parking shall be provided in accordance with chapter 17.608 unless—
i. the increase in building square footage is less than 15% or, in the case of a residential project, the increase in the number of residential units is less than 15%; and
ii. it is physically infeasible to accommodate the
additional bicycle spaces.
b. When additional bicycle parking is required by this
subsection D.1, it is required only for the additional gross building square footage or residential units.
2. Change in use.
a. When a conditional use permit is required for a new use, parking shall be provided in accordance with chapter 17.608.
b. When a conditional use permit is not required, no additional bicycle parking is required.
E. Restaurant outdoor seating. Square footage allocated to restaurant outdoor seating is not included in calculating the minimum off-street vehicle parking requirement for restaurants.
15 F. Affordable housing and senior housing.
1. The bicycle parking requirement is reduced by 50% for each senior housing unit.
2. For purposes of this section, an "affordable housing unit" is a housing unit restricted to occupancy by a lower or very low income household as defined in California Health and Safety Code section 50079.5. A "senior housing unit" is a housing unit restricted to occupancy based on age requirements for older persons under California Civil Code section 51.3.
H. Exemptions for small lots. Off-street parking is not required for nonresidential uses on lots of 6,400 square feet or less.
I. Exemptions for nonresidential uses in residential mixed use development.
Off-street parking is not required for non-residential uses in mixed use buildings in which at least 50% of the building's square footage is devoted to residential uses.
J. Exemptions for adaptive reuse. Bicycle parking is not required for those portions of historic resources that are converted from nonresidential uses to residential uses.
K. Exemptions for accessory dwelling units and junior accessory dwelling units.
When parking is removed in conjunction with the construction of an accessory dwelling unit or junior accessory dwelling unit, no replacement parking is required for the accessory dwelling unit or other dwelling units on the same lot.
16 SECTION 33.
A. Subsection B of section 17.608.030 of the Sacramento City Code is hereby amended to read as follows:
