Description/Analysis
Issue Detail: On February 27, 2024, the City Council adopted the 2040 General Plan, which effectively eliminated City-mandated parking minimums citywide. The Land Use and Placemaking (LUP) Element of the General Plan includes the following pertinent regulatory policy:

LUP-4.14 Elimination of Vehicle Parking Minimums. The City shall not require new or

existing development to provide off-street vehicle parking spaces.

Policy LUP-4.14 has been in effect since March 28, 2024, when the 2040 General Plan took effect.

However, the provisions of Title 17 of the Sacramento City Code (Planning and Development Code) relating to minimum off-street vehicle parking requirements have not yet been updated since the adoption of the new 2040 General Plan. State law (Government Code § 65860) requires that the zoning code be consistent with the general plan. The proposed ordinance amends provisions of Title 17 of the Sacramento City Code to ensure consistency with the 2040 General Plan as it relates to removing the minimum off-street vehicle parking requirements.

Policy Considerations: The 2040 General Plan was adopted on February 27, 2024, and became effective on March 28, 2024. General Plan Goal LUP-4 includes 16 policies that incentivize infill development to support walkable, transit-oriented centers and corridors that concentrate new jobs, housing, and entertainment opportunities to support frequent, reliable transit service and foster connected, accessible neighborhoods. This ordinance aligns the Sacramento City Code with the following 2040 General Plan policy:

LUP-4.14 Elimination of Vehicle Parking Minimums. The City shall not require new or existing development to provide off-street vehicle parking spaces.

This ordinance also supports implementation of the following Climate Action & Adaptation Plan action:

TR-2.2: Eliminate parking minimums Citywide, develop parking maximums and require parking management and transportation demand management plans for all areas of the City based on available transportation options, travel patterns, and land use.

In addition, this ordinance supports implementation of the following 2021-2029 Housing Element policy:

Program H8. Revisions to Parking Requirements. The City shall consider further eliminating City-mandated parking minimums and explore instituting parking maximums along established transit corridors.

Economic Impacts: Minimum vehicle parking requirements that require new development to provide more parking than the market demands can increase the cost of construction without producing an associated benefit, while reducing the amount of land available for other uses such as housing.

Eliminating minimum vehicle parking requirements can increase housing options by reducing costs associated with the provision of parking. Increasing the availability of housing will improve residents’ ability to better their economic situations, reduce poverty and homelessness, and promote social integration. Eliminating minimum vehicle parking requirements can also improve land use efficiency

by allowing a larger portion of a property to be developed for housing or commercial uses instead of for parking vehicles. This is anticipated to increase overall economic activity, encourage new businesses and business expansions, and support a built environment that supports mode shifts to transit and active transportation.

Environmental Considerations: The City has prepared an Initial Study for the ordinance (project) in compliance with the California Environmental Quality Act (CEQA), and has concluded that the project would not result in any additional significant environmental effects not previously analyzed in the Master Environmental Impact Report (EIR) for the 2040 General Plan, certified by the City on February 27, 2024. Pursuant to Public Resources Code section 21157.1 and CEQA Guidelines section 15177, the City has determined that the project is a subsequent project within the scope of the 2040 General Plan Master Environmental Impact Report. The City noticed the Initial Study for a 30-day review period, as required by CEQA Guidelines section 15087. The Initial Study was made available from 2/21/25 through 3/24/25 on the City of Sacramento’s website:
https://www.cityofsacramento.gov/community-development/planning/environmental/impact-reports.

No comments were received on the Initial Study.

Sustainability: Eliminating minimum vehicle parking requirements is expected to reduce housing development costs, thereby contributing to increased housing production and attainability that will contribute to sustainable economic growth in Sacramento. Additionally, eliminating minimum vehicle parking requirements can increase development density and land use intensity, functionally reducing distances between homes and businesses. In coordination with City efforts to concentrate new development in centers and corridors that are supportive of active transportation and transit mode shifts, the removal of minimum parking requirements can contribute to development patterns that support the City’s goals to shift more trips to low-carbon modes of transport including transit, bicycling, and walking.

Commission/Committee Action: On February 27, 2025, the Planning & Design Commission conducted a public hearing on the ordinance. The Commission passed a motion to forward the resolution for environmental review and the ordinance, as presented, to the City Council for consideration.

On March 11, 2025, the Law and Legislation Committee reviewed and forwarded the resolution for environmental review and the ordinance, as presented, to the City Council for consideration. Upon passing the motion to forward the Ordinance for consideration by City Council, the Law and Legislation Committee requested that staff consider how development projects that do not provide any onsite parking be potentially restricted from participating in a current or future Residential Parking Permit program. Staff will follow up and bring forward a recommendation to address this parking permit issue as part of the Parking Strategy, which will be brought forward for City Council consideration later this year. Law & Legislation Committee members also expressed an interest in parking management strategies to mitigate spillover parking impacts in residential neighborhoods.

This will also be addressed in the forthcoming Parking Strategy.

On March 25,2025, the City Council passed the ordinance for publication pursuant to Sacramento City Charter section 32(c).

Rationale for Recommendation: The modifications contained in the proposed ordinance will ensure that Title 17 of the Sacramento City Code is consistent with the 2040 General Plan which requires that the City not mandate minimum off-street vehicle parking requirements in new or existing development.

Financial Considerations: Not applicable.

Local Business Enterprise (LBE): Not applicable.
