Description/Analysis
Issue Detail: SCS Engineers (SCS) provides professional engineering support services to ensure the City is compliant with landfill regulations. Staff is requesting the approval of Supplemental No. 3 to Agreement 2022-0986 with SCS to increase the not-to-exceed amount by $121,500 to receive additional engineering consulting services from licensed engineers for landfill closure, monitoring, and reporting requirements. California Department of Resources Recycling and Recovery (CalRecycle) and the Central Valley Regional Water Quality Control Board (Water Board) impose these requirements through regulations and the Sacramento County Environment Management Department Local Enforcement Agency (County LEA) enforces the City’s adherence to these requirements.

Policy Considerations: The recommendations in this report are in accordance with City Code Chapter 3.56 and Administrative Policy 4102 for Professional Services Agreements and City Code section 3.04.020 for contract amendments.

Economic Impacts: None.

Environmental Considerations: California Environmental Quality Act (CEQA): The report concerns administrative activities and government fiscal activities that do not constitute a “project” and is not subject to the provisions of CEQA (CEQA Guideline Sections 15060(c)(3), 15378(b)(2), and 15378(b) (4)).

Sustainability: The appropriate monitoring and management of former landfill sites is consistent with the 2040 General Plan, Goal EJ-1.5 Compatibility with Hazardous Materials Facilities.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: Professional engineering services from consultants are necessary for the City to fulfill its ongoing regulatory obligations at its multiple closed landfill sites. SCS is currently involved in addressing several outstanding requests for compliance associated with the City’s closed landfills. The related regulatory agencies continue to impose new reporting requirements and expand on previously required reporting requirements, which increase the overall engineering services costs for monitoring, reporting, and compliance. As a result, a substantial amount of the agreement’s budget has been used to respond to these compliance requests. Staff recommends City Council approve Supplemental Agreement No. 3 with SCS to update the following existing tasks:
· Task 409 Ongoing Support and Consultation for Landfill Sites · Task 422 Prepare plans for Gas Collection and Control System (GCCS) Improvements at Cannon & Scollan (City owned property)
· Task 432 28
th Street Landfill Postclosure Management Plan
· Task 434 Probe Compliance Issues
And to establish the following new task:
· Task 436 28th Street Landfill Notice of Violation from Central Valley Regional Water Quality Control Board (Water Board)
Financial Considerations: Supplemental Agreement No. 3 to City Agreement No. 2022-0986 will increase the not-to-exceed amount of $368,699 by $121,500 for a revised not-to-exceed total of $490,199. Sufficient funding exists in the Cannon-Scollan Trust Project (Solid Waste Fund 6007 and General Fund 1001), Landfill Site Closure Project (Solid Waste Fund 6007 and General Fund 1001), and 28
th St Landfill Regulatory Project (Solid Waste Fund 6007 and General Fund 1001) as follows:

Cannon-Scollan Trust (Y13000200, Fund 6007) $6,900
Cannon-Scollan Trust (Y13000200, Fund 1001) $6,900

This agreement was awarded under RFQ EV00000031 for On-Call Environmental Services, which was a competitive procurement conducted by the City’s Economic Development Department in 2019. This RFQ required consultants to submit their Local Business Enterprise certification status. LBE firms were given 5 additional points on the evaluation criteria worksheet.
