Description/Analysis
Issue Detail: The City of Sacramento is eligible to receive Federal and State funding for certain Transportation Projects through the California Department of Transportation (Caltrans). The Federal- Aid Highway Program and most Local Assistance programs funded with State-only funds are reimbursable programs. Agreements must be executed in order to pay funds to a Local Public Agency.

General agreements, such as Master Agreements, Program Supplement Agreements, Fund Exchange Agreements and/or Fund Transfer Agreements, need to be executed between Caltrans and the City before such funds can be claimed. The agreements define the general terms and conditions applicable to the City as the Administering Agency which must be met to receive federal- aid or state funds.

Currently, the City is operating under Master Agreements executed as City Agreements 2016-0424 and 2021-0792 to receive federal-aid and state funds respectively. These Master Agreements are

periodically updated and re-executed to account for changes in laws and policies. As such, authorization to execute future agreements and any amendments thereto can be delegated to the City Manager or the City Manager’s designee to execute all Master Agreements, Program Supplemental Agreements, Fund Exchange Agreements, Fund Transfer Agreements and any amendments thereto with Caltrans.

Caltrans requires approval by Council to delegate authority to the City Manager or designee to execute any future general funding agreements and amendments as well as authority to execute Program Supplemental Agreements, Fund Exchange Agreements, Fund Transfer Agreements and any amendments thereto with Caltrans to the Master Agreements.

Policy Considerations: The recommended action supports the City’s 2040 General Plan goals of developing an equitable, sustainable multi-modal transportation system that provides a range of viable and healthy travel choices for users of all ages, backgrounds, and abilities. In accordance with General Plan M-1.41, the City shall explore options to reduce funding shortfalls, including actions to ensure adequate shares of regional funding, identification of new funding sources, and prioritization of funding opportunities.

Economic Impacts: None.

Environmental Considerations: Delegating signature authority for funding agreements is not considered a project as defined by Section 15378(a) of the California Environmental Quality Act (CEQA) guidelines. The recommended action involves no physical construction and has no potential to cause significant impact to the environment. Individual projects funded pursuant to terms and conditions of future agreements are subject to environmental review in compliance with CEQA and National Environmental Policy Act (NEPA).

Sustainability: Not applicable.

Commission/Committee Action: None.

Rationale for Recommendation: The recommended action authorizes the Interim City Manager or the designee to execute general funding agreements and any amendments necessary to receive federal and state transportation funds. These agreements implement budgetary actions approved by the City Council.

Financial Considerations: Not applicable. All budgetary actions associated with agreements are approved through separate actions.

Local Business Enterprise (LBE): Not applicable.
