Description/Analysis
Issue Detail: In 2022, the City of Sacramento made a joint application with Capitol Corridor Joint Powers Agency (JPA) for grant funding under the Transit and Intercity Rail Capital Program (TIRCP), administered by the California State Transportation Agency (CalSTA), for a suite of improvements to the Sacramento Valley Station (SVS). The City was awarded $42.451 million for eight project components, one of which included funding for environmental review under the federal National Environmental Protection Act (NEPA) for the proposed Regional Bus Mobility Hub (RBMH), a new

facility to support inter-city bus services throughout Northern California, primary regional bus connector to the state’s passenger rail network at SVS. The City was awarded $26.745 million in the 2023 TIRCP grant program in construction funds for the RBMH. The balance of construction funding is assumed to come from federal funds.

California Environmental Quality Act (CEQA) review has already taken place for the SVS plan area and project level review RBMH. In order to accommodate future federal funding, the project also requires approval under the National Environmental Policy Act (NEPA) to be approved by the Federal Transit Administration (FTA) as the responsible federal agency.

SacRT is the transit operator and the designated recipient of federal transit funding from FTA for the Sacramento region. As the City is not a designated transit agency, staff began consultation in July 2023 with Sacramento Regional Transit (SacRT) staff and met with FTA staff to determine how to move forward with NEPA review. FTA requested that the City enter into an agreement with SacRT for the purposes of the City's preparation of NEPA documentation for the RBMH.The City initiated a Memorandum of Understanding (MOU) with SacRT in January 2024, along with the start of procurement of a consultant team to conduct the environmental review. The MOU with SacRT was executed on April 3, 2025.

The City conducted a formal procurement process to retain a qualified professional environmental firm to conduct federal environmental clearance for the Project for NEPA review under FTA. Based on the merits of their written proposals, a panel consisting of City staff is recommending awarding the contract to the top ranked firm, Environmental Science Associates. City Council approval is needed for the acceptance of the TIRCP grant funding and award of the professional services contract.

Policy Considerations: The development of the Project is consistent with the Central City Specific Plan and Railyards Specific Plan and the following 2040 General Plan Policies:

M-1.22 Increase Transit Ridership. The City shall support work to increase transit ridership citywide.

M-1.23 Transit Priority . Where appropriate, the City shall support transit by incorporating features such as bus bulbs, traffic signal priority, queue jumps, and other solutions into priority corridors to improve transit speed, reliability, and operating efficiency while reducing passenger delay.

M-5.2 Sacramento Valley Station. The City shall work to establish Sacramento Valley Station as the premier regional transit hub of Northern California, linking regional rail, light rail, bus, and high-speed rail service, and plan for the expansion of rail service to strengthen connections between Sacramento, the Central Valley, the Bay Area, Northern California, and beyond.

Economic Impacts: None.

Environmental Considerations: The City Council adopted Resolution 2021-0073 on April 6, 2021, which certified an Addendum to the Subsequent Environmental Impact Report for the Sacramento Railyards Specific Plan Update, KP Medical Center, MLS Stadium, & Stormwater Outfall Projects, and Environmental Impact Report for the Central City Specific Plan, as necessitated by the amendment of the Railyards Specific Plan to incorporate the planning updates contained in the Sacramento Valley Station (SVS) Area Plan. This addendum was limited to environmental review under the California Environmental Quality Act (CEQA) for the plan area and project level review for the proposed Regional Bus Mobility Hub (RBMH). The proposed scope of work is to extend environmental review for the RBMH to encompass federal clearance under NEPA and FTA guidelines.

Sustainability: The transportation sector accounts for over 57% of community-wide greenhouse gas emissions, the largest single sector in the community. Providing safe multi-modal transportation alternatives helps to reduce single-occupant vehicle use and contributes towards the Sacramento region’s climate change goals. The Sacramento Valley Station Regional Bus Stops furthers the City’s commitment to sustainability by laying the groundwork for the expanded use of the regional commuter buses and local bus services connecting to the multi-modal transportation hub, which will reduce the use of fossil fuels, encourage less driving, and reduce dependence on private automobiles.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: On January 23, 2024, the Department of Public Works advertised a Request for Proposals (RFP) to firms with experience in preparing environmental review under the National Environmental Protection Act (NEPA) and understanding of California Environmental Quality Act as it pertains to NEPA for the Sacramento Valley Station Regional Bus Mobility Hub. Four firms attended the pre-proposal meeting and of those four, two firms responded. A panel consisting of staff from the City’s Department of Public Works and Community Development Department and the Office of the City Attorney reviewed and evaluated the two consultant teams’ written proposals based on experience, qualifications, project understanding, work plan, and contacted references provided.

Environmental Science Associates was chosen by the panel as the top ranked firm based on the written proposal.

Simultaneously with the RFP process, the City began negotiating a Memorandum of Understanding (MOU) with Sacramento Regional Transit (SacRT) to outline responsibilities and costs for SacRT’s participation in the NEPA. With the execution of the MOU, staff is bringing forward the professional agreement to conduct the environmental work and accept the TIRCP grant funds for this project.

Financial Considerations: With the increase in the revenue and expenditures budget of the Sacramento Valley Station (SVS) Regional Bus Stops Project (T15029000) by $643,000 (Other Capital Grants, Fund 3704), there will be sufficient funding to execute a professional services agreement with Environmental Science Associates in an amount not to exceed $467,608.

There are no General Funds currently allocated for this agreement.

Local Business Enterprise (LBE): Environmental Science Associates is an LBE.

RESOLUTION NO. 2025-XXXX
Adopted by the Sacramento City Council

BUDGETARY ADJUSTMENTS AND PROFESSIONAL SERVICES AGREEMENT FOR

THE SACRAMENTO VALLEY STATION REGIONAL BUS MOBILITY HUB - NATIONAL ENVIRONMENTAL POLICY ACT (NEPA) REVIEW(T15029000)

BACKGROUND

A. The City Council adopted Resolution 2021-0073 on April 6, 2021, which certified an Addendum to the Subsequent Environmental Impact Report for the Sacramento Railyards Specific Plan Update, KP Medical Center, MLS Stadium, Stormwater Outfall Projects, and Environmental Impact Report for the Central City Specific Plan, as necessitated by the amendment of the Railyards Specific Plan to incorporate the planning updates contained in the Sacramento Valley Station (SVS) Area Plan.

B. This addendum was limited to environmental review under the California Environmental Quality Act (CEQA) for the plan area and project level review for the proposed Regional Bus Mobility Hub (RBMH).

C. In 2022, the City of Sacramento successfully applied for, and was awarded, a Transit and Intercity Rail Capital Program (TIRCP) grant, for a suite of improvements to the Sacramento Valley Station (SVS) which included funding for environmental review under the federal National Environmental Protection Act (NEPA).

D. The City was awarded $26.745 million in the 2023 TIRCP grant program towards construction funds for RBMH to aid additional federal funds for the project.

E. The City’s Department of Public Works conducted a formal procurement process to retain a qualified professional environmental firm with experience in preparing environmental review under the National Environmental Protection Act (NEPA) and understanding of California Environmental Quality Act as it pertains to NEPA for the Sacramento Valley Station Regional Bus Mobility Hub. The most qualified applicant was Environmental Science Associates.

F. The Federal Transit Administration (FTA) is to be the lead federal agency for federal environmental review under NEPA.

G. Sacramento Regional Transit (SacRT) is the transit operator and the designated recipient of federal transit funding from FTA for the Sacramento region. In that role, SacRT has an established relationship with the FTA for submission of requests for project approvals, including necessary reviews under the National Environmental Policy Act (NEPA).

H. Because the City is not a transit agency, FTA requested that the City enter into an agreement with SacRT as the administering transit agency to FTA for the purposes of the City's preparation of NEPA documentation for the SVS Project.

I. The City and SacRT executed a Memorandum of Understanding (MOU) on April 3, 2025, which outlines responsibilities and costs for SacRT’s participation in the NEPA process as required by the Federal Transit Administration (FTA).

BASED ON THE FACTS SET FORTH IN THE BACKGROUND, THE CITY COUNCIL RESOLVES AS FOLLOWS:

Section 1. The City Manager or designee is authorized to increase the revenue and expenditure budget of the Sacramento Valley Station (SVS) Regional Bus Mobility Hub-NEPA (National Environmental Protection Act) Environmental Project (T15029000) by $643,000 (Other Capital Grants, Fund 3704);

Section 2. Award a professional services agreement to Environmental Science Associates in an amount not to exceed $467,608.

Section 3. The City Manager or designee is authorized to execute a professional services agreement with Environmental Science Associates in an amount not to exceed $467,608 for preliminary engineering and environmental clearance of the Sacramento Valley Station (SVS) Regional Bus Mobility Hub-NEPA Environmental Project (T15029000).

If CITY is unwilling to pay SacRT’s actual costs up to the specified amounts, City may terminate this Agreement for its convenience and CITY will be obligated to pay SacRT’s costs through the date of the termination. If SacRT anticipates that its costs will exceed the specified maximums set out above, , SacRT will provide written notice to the CITY representative pursuant to Section 4 and the parties may approve an amendment to this Agreement to increase the not to exceed amount. If an increase is not approved, SacRT will not be obligated to provide any further support services once the specified cap is met, and CITY will not be obligated to pay any amounts for services in excess of the specified amounts CITY must disburse funds to SacRT no later than 30 days after receipt of invoices from SacRT, accompanied by appropriate supporting documentation. 3. INDEMNITY CITY must protect, defend, indemnify and hold harmless SacRT, and its officers, agents, and employees from any and all claims, damages, losses, costs, expenses (including reasonable attorney’s fees and actual court costs), injuries, or liabilities or every kind on account of damage to property or injury to person (including death), that directly or indirectly arise from or relate to the acts or omissions of SacRT, its officers, agents, employees, contractors and subcontractors with respect to the Project, except to the extent that such claims, damages, losses, costs, expenses or liabilities result from the sole negligence or willful misconduct of SacRT.
