Issue Detail: The PBID is a property-based assessment district that was initially established in 2005 for a five-year term under the PBID Law of 1994 (California Streets and Highways Code section 36600 et seq.). On July 21, 2015, the PBID was renewed for a ten-year term from January 1, 2016 through December 31, 2025. The owners’ association for the PBID is now gathering petitions from property owners for a proposed renewal of the PBID for a ten-year term from January 1, 2026, through December 31, 2035. The renewed PBID would continue to provide safety, security and image enhancement, advocacy and economic development, and administration activities.

The total PBID assessment, which includes 488 assessed parcels, for the first year of this proposed renewal term would be approximately $1,318,803. Of the 488 parcels that would be assessed, 37 are currently City-owned and the City’s assessment for the first year of the renewal term would be $85,952. City-owned parcels have been assessed since the PBID’s formation and have benefitted

from the PBID services. During the PBID term ending December 31, 2025, the City was assessed for 25 parcels. However, the owners’ association is proposing a larger boundary for the renewed DBPBID. Accordingly, the City would have 37 properties assessed in the renewed PBID term. Staff is recommending that City-owned parcels continue to be included as assessed parcels in the renewed PBID.

Policy Considerations: The proceedings under which the PBID is proposed to be renewed are set forth in California Streets and Highways Code section 36600 et seq., referred to as the “Property and Business Improvement District Law of 1994.”
Economic Impacts: None.

Environmental Considerations: This report concerns administrative activities and governmental fiscal activities that do not constitute a “project” under the California Environmental Quality Act (CEQA) Guidelines Section 15378(b)(2) and Section 15378(b)(5). The proposed action in this report is therefore not a “project” subject to the provisions of CEQA (CEQA Guidelines Section 15060(c)(3)).

Sustainability: Not applicable.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: The recommended action authorizes the Interim City Manager or designee to sign the property owner’s petition and assessment ballot in the affirmative on behalf of the City-owned property that is located within the PBID.

Financial Considerations: If the PBID is renewed, the City will continue to participate as a property owner, with the City paying a total assessment of $85,952 in the first year of the ten-year renewal period for City-owned properties in the PBID. Future increases in the PBID’s assessment rates are capped at 5% annually during the renewal period. Assessment payments would continue to be funded by General/Measure U funds.

Local Business Enterprise (LBE): Not applicable.

RESOLUTION NO.

Adopted by the Sacramento City Council

DESIGNATING THE CITY MANAGER OR DESIGNEE AS THE

SIGNATURE AUTHORITY FOR CITY-OWNED PROPERTY IN THE

RENEWED DEL PASO BOULEVARD
PROPERTY AND BUSINESS IMPROVEMENT DISTRICT NO. 2025-02
BACKGROUND:

A. The Del Paso Boulevard Property and Business Improvement District (DBPBID) is a property-based assessment district that was initially established in 2005 for a five-year term under the PBID Law of 1994 (California Streets and Highways Code section 36600 et seq.). On July 21, 2015, the DBPBID was renewed for a ten-year term from January 1, 2016 through December 31, 2025.

B. The owners’ association for the DBPBID is now gathering petitions from property owners for a proposed renewal of the DBPBID for a ten-year term from January 1, 2026, through December 31, 2035.

C. City-owned parcels have been assessed under the DBPBID since its formation.

During the DBPBID term ending December 31, 2025, the City was assessed for 25 parcels. However, the owners’ association is proposing a larger boundary for the renewed DBPBID. Accordingly, the City currently owns 37 parcels within the proposed area of the renewed DBPBID. The City-owned parcels will have a total annual assessment of approximately $85,952 for the first year of the proposed renewal term. Future assessment rates may be subject to an increase of no more than five (5%) annually.

D. City staff recommends that the City-owned parcels be included as assessed parcels in the renewed DBPBID because the City properties have thus far benefitted from the DBPBID’s services. Staff is thus seeking Council authorization for the City Manager or designee to sign the property owner’s petition supporting renewal, and if renewal proceedings are initiated, sign the assessment ballot for the City-owned parcels in favor of renewal for the DBPBID.

BASED ON THE FACTS SET FORTH IN THE BACKGROUND, THE CITY COUNCIL RESOLVES AS FOLLOWS:

Section 1 The City Manager or designee is authorized to sign a petition supporting renewal of the DBPBID per Streets and Highways Code section 36621(a), and if renewal proceedings are initiated, vote for the following City-owned properties (APNs listed) to be included in the renewal of the DBPBID in accordance with Streets and Highways Code section 36623(a):
