Description/Analysis
Issue Detail: City Code section 3.128.210 requires an annual budget for maintenance benefit areas formed under City Code Chapter 3.128 to be presented to Council for approval. This approval and the fixing of the service fee will authorize the City to collect service fees for additional maintenance provided in the Old Sacramento and 12th Street maintenance benefit areas in FY2025/26. Specific information on each district is provided in the Background section of this report.

File ID: 2025-00748 5/27/2025 Item 3.

Policy Considerations: The actions in the recommended resolutions are required by City Code Chapter 3.128. Approval of the attached resolutions will fix the service fees charged to owners of property for FY2025/26 and provide funding for additional maintenance services in FY2025/26 within the maintenance benefit areas that specially benefit the charged properties.

Economic Impacts: None.

Environmental Considerations:

California Environmental Quality Act (CEQA): Under the CEQA Guidelines, continuing administrative activities of a maintenance benefit area and creation of government funding mechanisms or other government fiscal activities which do not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment do not constitute a project and are therefore exempt from CEQA review (14 Cal. Code Regs. § 15378(b)(2), (b)(4)).

Sustainability: Not applicable.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: The purpose of the maintenance benefit areas is to recover City costs incurred for providing additional services above City standard services, including additional street sweeping, cleaning of building facades, additional trash collection, and weed control.

Financial Considerations: The total of all service fees for property owners in the Old Sacramento Maintenance Benefit Area for FY2025/26 is projected at $70,060, as shown on Exhibit C to the attached resolution. The service fees are charged based on a combination of property front footage, parcel area, and structure area. The proposed fees for FY2025/26 are the maximum allowed for the Old Sacramento Maintenance Benefit Area and are unchanged from FY2024/25, as they are not subject to annual inflation adjustment.

The proposed service fee rate for the 12th Street Maintenance Benefit Area No. 2008-02 for FY2025/26 is $5.12 per linear foot of the property frontage on 12th Street. This is an increase of $0.26 per linear foot compared to FY2024/25 and is below the maximum allowed in the District of $5.23.

The total of all service fees is projected at $19,571, with an expense budget of $27,643 as shown on Exhibit B to the attached resolution. The assessment in FY2025/26 is less than the projected budget due to increased service costs. The difference will be supported with the use of available fund balance. The amount charged to the property owners is proposed to be approximately $410 per year for a typical 80-foot-wide parcel.

Local Business Enterprise (LBE): Not applicable.

ATTACHMENT 1

BACKGROUND

The Old Sacramento Maintenance Benefit Area and the 12th Street Maintenance Benefit Area No. 2008-02 are “maintenance benefit areas” established pursuant to City Code Chapter 3.128. Property owners within the maintenance benefit areas pay, through service fees charged, for costs related to maintenance services within each benefit area. The benefit areas were established to provide a level of service for public property that is higher than the City standard. The real property owners charged receive a special benefit from such additional maintenance services. The service fees charged are used to defray these additional City and contractor expenses associated with the higher level of maintenance provided to each benefit area.

Old Sacramento Maintenance Benefit Area, Fund 2208
On October 2, 1984, the City Council adopted Resolution No. 84-832 authorizing the formation of the Old Sacramento Maintenance Benefit Area. This area includes commercial parcels within a two and one-half service block in Old Sacramento between Front and 2nd Streets. Maintenance services include street sweeping, collection of trash in street receptacles and service courts, and cleaning of building facades, all of which are of specific benefit to the maintenance benefit area properties. These services are above and beyond the City’s standard level of service, and there is no contemplation that the additional services will ever be provided on a citywide basis. The purpose of the maintenance benefit area is to provide a means to recover costs incurred by the City for these additional services.

12th Street Maintenance Benefit Area No. 2008-02, Fund 2207 On August 7, 2008, City Council adopted Resolution No. 2008-552 approving the formation of the 12th Street Maintenance Benefit Area No. 2008-02. Maintenance services include clean-up of the sidewalks and gutters, litter pick-up and weed control in the landscaped areas. Maintenance also includes shrub and tree pruning performed up to four times per year and leaf collection and removal during the fall and winter seasons.

The purpose of the maintenance benefit area is to provide a means to recover costs incurred by the City for these additional services above and beyond the City’s standard level of service.

A map of each maintenance benefit area is included as an exhibit to each respective resolution.
