Suspension of Competitive Bidding for the Sutter’s Landing Restroom and Concession Project (L19911700) (Two-Thirds Vote Required)
File ID: 2025-01132
Location: 20 28th Street, District 4
Recommendation: Pass a Motion by two-thirds vote suspending competitive bidding, in the best interests of the City, to utilize a two-step process authorizing the use of the Request for Qualifications (RFQ) process to pre-qualify construction firms based on their experience, expertise, and capacity to complete the project followed by an Invitation for Bid (IFB) to solicit bids exclusively from the pre- qualified firms to ensure the selection of the most qualified contractor at the lowest competitive price for construction of the Sutter’s Landing Restroom and Concession Project (L19911700).

1-Description/Analysis
Description/Analysis
Issue Detail: Sutter’s Landing Regional Park was established after the closure of the old City of Sacramento Landfill. The Park offers a variety of recreational activities for visitors, including amenities such as the 28th & B Skate and Urban Art Park, basketball courts, bocce ball courts and a dog park.

This project includes the development of 1.5 acres of parkland and the construction of an approximately 2,500 square feet building with public restrooms, space for future rentals, designed to enhance river access, and offices for City Park Rangers.

Policy Considerations: The recommendations contained in this report are consistent with City Code Section 3.56.230(E) allowing the City Council to suspend competitive bidding to utilize an alternative method for a contract upon a two-third vote when City Council determines that it is in the best interest

of the City to suspend the competitive bidding requirements.

Economic Impacts: None.

Environmental Considerations: California Environmental Quality Act (CEQA): The action is an administrative activity that would not result in a direct or indirect significant effect on the environment and is exempt from CEQA review. (CEQA Guidelines section 15378(b)(5); 15060(c)(3). The City will conduct the required CEQA process prior to awarding a contract.

Sustainability: None.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: City staff recommend suspending the traditional competitive bidding process for the construction of the Sutter’s Landing Restroom and Concession Project in favor of a two-step procurement method. This approach would involve:

1. Request for Qualifications (RFQ): Pre-qualifying construction firms based on their experience, expertise, and capacity to complete the project.

2. Invitation for Bid (IFB): Soliciting bids exclusively from the pre-qualified firms to ensure the selection of the most qualified contractor at the lowest competitive price.

This RFQ/IFB process ensures that the project is awarded to a contractor with the necessary experience and capability to handle the complexities of the Project while maintaining cost efficiency.

The Sutter’s Landing Restroom and Concession Project involves 1.5 acres of park development and construction of a 2,500 square foot building on the old landfill. The project presents significant, complex and unusual challenges including installation of underground utilities within the landfill, potential unforeseen subsurface conditions, possibly buried waste and landfill gas.

Given the complexity of the work, securing a highly qualified contractor with a proven track record in similar projects is critical to ensuring a successful project that meets City, and community expectations, and adheres to the construction schedule required by grant funding deadlines.

By implementing the RFQ/IFB process, the City can balance quality and cost-effectiveness, ensuring that only the most capable contractors compete for the project while still securing the lowest bid among them. City staff recommend this approach to enhance project success and maximize public investment.

To meet the grant deadlines and retain the awarded funding for the Sutter’s Landing Park Restroom and Concession Building, construction should start in 2025. It is paramount to the success of the

project to contract with a qualified and experienced Contractor that is capable to complete the project within the allocated timeframe and purchase equipment in order to avoid delays to construction. Any delay in project delivery could result in forfeiture of state grant funding.

Staff will return to City Council for approval of the construction contract.

Financial Considerations: The total project cost, including City staff time and management, is about $4.5 million. The funding strategy includes $3 million budgeted in L19911702 SLP-Conc/Rest/Multi Bldg. (Other Capital Grant, Fund 3704) and $595,274 set aside in L19167019 Sutter’s Landing Facility Improvements (General Fund, Fund 1001). In addition, an additional $975,000 in state grant funding (Other Capital Grant, Fund 3704) will be added once the agreement with the State has been executed. These combined sources will fully cover all project costs.

Local Business Enterprise (LBE): Not applicable.
