1-Description/Analysis
2-Plans and Specifications - North Laguna and Jacinto Creek Trail Resurfacing Project Description/Analysis
Issue Detail: The North Laguna and Jacinto Creek Trail Resurfacing Project aims to rehabilitate the existing trail using a Type 1 slurry seal to extend the trail’s service life as well as improve safety at pedestrian and bicycle access points along the trail. The project includes closing trail segments for construction near and along Irene B. West Elementary School, which requires the work to occur in
File ID: 2025-01099 6/24/2025
early July while school is out and is anticipated to be completed prior to school starting in the Fall.
This project includes restriping the trail and replacement of the non-standard bollards at trail entrances. Additionally, entries and crossings to the trail will be modified where necessary to ensure accessibility compliance.
The plans and specifications for the North Laguna and Jacinto Creek Trail Resurfacing Project were completed and the project was advertised for construction. Two bids were received on May 7, 2025, and neither of the bids met the requirements to be considered responsive. Despite this, in order to meet construction deadlines, staff negotiated with the lowest bidder to deliver the project.
Policy Considerations: The actions requested are necessary for the construction of the North Laguna and Jacinto Creek Trail Resurfacing Project, which is consistent with the City’s goals of improving and expanding public safety and enhancing livability. These actions are consistent with the following goal as identified in the General Plan:
M 1.2.1 - Multimodal Choices: The City shall develop an integrated, multimodal transportation system that improves the attractiveness of walking, bicycling, and riding transit over time to increase travel choices and aid in achieving a more balanced transportation system and reducing air pollution and greenhouse gas emissions.
M 2.1.7 - Safe Pedestrian Crossings: The City shall improve pedestrian safety at appropriate intersections and mid-block locations by providing safe pedestrian crossings.
The actions requested are consistent with the City’s Administrative Policy for Public Projects, Section
8.5(B), which requires City Council to reject bids or proposals for contracts of $250,000 or more and section 3.56.090 of the Sacramento City Code which requires that all contracts involving an expenditure of $250,000 or more must be approved by the City Council. Per City Code section
3.56.230, the City Council may reject all bids, and upon a two-thirds vote, determine that it is in the best interests of the city to suspend competitive bidding and utilize an alternative method of procurement.
VSS International’s bid did not meet the minimum LBE participation requirements; however, it is anticipated the LBE will be met in negotiations. Staff does not anticipate that a readvertisement would obtain a different responsive bid that would be lower than VSS International. Being able to negotiate an agreement with VSS International and commence with construction by early summer will allow the city to complete the project as scheduled and minimize the potential for increased costs and potential disruptions associated with readvertising. The project includes trail segments near Irene B. West Elementary School which requires the work to occur in early July to avoid use by students before the students return to school in the Fall.
File ID: 2025-01099 6/24/2025
Staff recommends rejecting all bids, suspending competitive bidding, and awarding the agreement to VSS International, Inc.
Economic Impacts: This new infrastructure is expected to create 1.22 total jobs (0.7 direct jobs and
0.52 jobs through indirect and induced activities) and create $189,065 in total economic output ($119,169 of direct output and another $69,896 of output through indirect and induced activities).
The indicated economic impacts are estimates calculated using a calculation tool developed by the Center for Strategic Economic Research (CSER). CSER utilized the IMPLAN input-output model (2009 coefficients) to quantify the economic impacts of a hypothetical $1 million of spending in various construction categories within the City of Sacramento in an average one-year period. Actual impacts could differ significantly from the estimates and neither the City of Sacramento nor CSER shall be held responsible for consequences resulting from such differences.
Environmental Considerations: California Environmental Quality Act (CEQA): The Community Development Department, Environmental Planning Services Division has determined that this project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) under Class 1, Section 15301(c).
Projects exempted under Class 1, Section 15301(c) consist of the operation, repair or minor alteration to existing highways and streets, sidewalks, bicycle and pedestrian trails, and similar facilities.
Sustainability: The project is consistent with sustainability goals of promoting walking and bicycling by developing a universally accessible, safe, convenient, integrated, and well-connected pedestrian system and bicycle network. The project will reduce dependence on private automobiles, decrease the use of fossil fuels, and encourage active modes of transportation.
Commission/Committee Action: None.
Rationale for Recommendation: The Project was advertised for construction, and a total of two bids were received on May 7, 2025. The results of the bids are summarized below:
Contractor Bid
VSS International, Inc. $306,211
The Design build, Inc. $441,786
The Engineer’s Estimate was $372,000.
Neither of the bidders met the required bid conditions to be considered responsive and responsible.
The costs bid by VSS International, Inc. during the advertising process are comparable to other bids
File ID: 2025-01099 6/24/2025
the city has recently received. Staff does not anticipate re-advertising the project would result in additional bidders or lower bids. If the project is re-advertised, the City will not be able to construct the trail this Summer. To minimize the impacts of construction, the project needs to be done when school is out for the Summer.
Staff recommends the construction contract be awarded to VSS International, Inc. due to the favorable pricing and the required construction schedule to avoid impacts to adjacent schools.
Construction is anticipated to begin July 2025 and should be completed by October 2025. Staff will work on finalizing the terms with VSS International, Inc., and once the terms are finalized, have the City Manager or designee execute the construction contract to avoid any delays since construction is set to commence in July 2025.
Financial Considerations: The estimated total cost to complete North Laguna and Jacinto Creek Trail Resurfacing Project is approximately $727,129. There is sufficient funding in the Pedestrian and Bike Trail Repair and Maintenance Project (K15222100) to award the construction contract to VSS International, Inc. for an amount not to exceed $306,211 and cover remaining construction management costs.
Local Business Enterprise (LBE): VSS International is not an LBE, but has partnered with two LBEs, Anrak, and Sacramento Transfer for this project to meet the minimum LBE participation requirement. Anrak will provide sweeping services and Sacramento Transfer will provide trucking services.

3.6 CHANGED CONDITIONS
a. Differing Site Conditions
1. During the progress of the work, if subsurface or latent physical conditions are encountered at the site differing materially from those indicated in the contract or if unknown physical conditions of an unusual nature, differing materially from those ordinarily encountered and generally recognized as inherent in the work provided for in 4 the contract, are encountered at the site, the party discovering such conditions shall promptly notify the other party in writing of the specific differing conditions before the site is disturbed and before the affected work is performed.
2. Upon written notification, the engineer will investigate the conditions, and if it is determined that the conditions materially differ and cause an increase or decrease in the cost or time required for the performance of any work under the contract, an adjustment, excluding anticipated profits, will be made and the contract modified in writing accordingly. The engineer will notify the contractor of the determination whether or not an adjustment of the contract is warranted.
3. No contract adjustment which results in a benefit to the contractor will be allowed unless the contractor has provided the required written notice. b. Suspensions of Work Ordered by the Engineer
1. If the performance of all or any portion of the work is suspended or delayed by the engineer in writing for an unreasonable period of time (not originally anticipated, customary, or inherent to the construction industry) and the contractor believes that additional compensation and/or contract time is due as a result of such suspension or delay, the contractor shall submit to the engineer in writing a request for adjustment within 7 calendar days of receipt of the notice to resume work. The request shall set forth the reasons and support for such adjustment.
2. Upon receipt, the engineer will evaluate the contractor's request. If the engineer agrees that the cost and/or time required for the performance of the contract has increased as a result of such suspension and the suspension was caused by conditions beyond the control of and not the fault of the contractor, its suppliers, or subcontractors at any approved tier, and not caused by weather, the engineer will make an adjustment (excluding profit) and modify the contract in writing accordingly. The contractor will be notified of the engineer's determination whether or not an adjustment of the contract is warranted.
3. No contract adjustment will be allowed unless the contractor has submitted the request for adjustment within the time prescribed.
4. No contract adjustment will be allowed under this clause to the extent that performance would have been suspended or delayed by any other cause, or for which an adjustment is provided or excluded under any other term or condition of this contract. c. Significant Changes in the Character of Work
1. The engineer reserves the right to make, in writing, at any time during the work, such changes in quantities and such alterations in the work as are necessary to satisfactorily complete the project. Such changes in quantities and alterations shall not invalidate the contract nor release the surety, and the contractor agrees to perform the work as altered.
2. If the alterations or changes in quantities significantly change the character of the work under the contract, whether such alterations or changes are in themselves significant changes to the character of the work or by affecting other work cause such other work to become significantly different in character, an adjustment, excluding anticipated profit, will be made to the contract. The basis for the adjustment shall be agreed upon prior to the performance of the work. If a basis cannot be agreed upon, then an adjustment will be 5 made either for or against the contractor in such amount as the engineer may determine to be fair and equitable.
3. If the alterations or changes in quantities do not significantly change the character of the work to be performed under the contract, the altered work will be paid for as provided elsewhere in the contract.
4. The term “significant change” shall be construed to apply only to the following circumstances:
• When the character of the work as altered differs materially in kind or nature from that involved or included in the original proposed construction; or • When a major item of work, as defined elsewhere in the contract, is increased in excess of 125 percent or decreased below 75 percent of the original contract quantity.
Any allowance for an increase in quantity shall apply only to that portion in excess of 125 percent of original contract item quantity, or in case of a decrease below 75 percent, to the actual amount of work performed.
