Description/Analysis
Issue Detail: On-call contracts are typically established to supplement staff during peak workloads, provide specialized services, support essential facilities, and deliver projects more cost-effectively and efficiently.

Public Works requested that a new On-Call Professional Services List for Engineering and Construction related tasks be established and it was approved by City Council on April 1, 2025 (Motion No. 2025-0086), to maintain this “best practice” for efficient and cost-effective project delivery. Convention & Cultural Services Department would like to enter into an agreement with one of the Contractors on this list, Lionakis Company.

The new On-Call Professional Services List for Engineering and Construction related tasks anticipates the work will be needed over the next five years.

Entering into this On-Call Professional Services contract will enable staff to expedite and complete projects more quickly and efficiently.

Policy Considerations: The recommendations in this report are in accordance with the provisions of City Code Section 3.56, which requires City Council approval for contracts encumbering $250,000 or more.

Economic Impacts: None.

Environmental Considerations: California Environmental Quality Act (CEQA): The action is exempt from review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines section 15301. The action involves the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. The exemption covers interior or exterior alterations involving such things as interior partitions, plumbing, and electrical conveyances; existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities (this includes road grading for the purpose of public safety);restoration or rehabilitation of deteriorated or damaged structures, facilities, or mechanical equipment to meet current standards of public health and safety, unless it is determined that the damage was substantial and resulted from an environmental hazard such as earthquake, landslide, or flood.

Sustainability: Not applicable.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: On-call contracts are designed to ensure timely services during periods of peak workload, when specialized expertise is needed, or when essential facility operations are disrupted.

On April 1, 2025, the City Council approved the creation of an On-Call Professional Services List for Public Facilities. The Facilities Maintenance Division allowed other City departments to piggy-back onto their solicitation provided each department got their our approvals. The Department of Convention and Cultural Services seeks an on-call professional services agreement with Lionakis Company who was on the approved list. The contract will supplement staff during peak demand, provide specialized services, support essential facility operations, and enhance cost-effectiveness and efficiency.

Financial Considerations: The contract will have a not-to-exceed amount of $350,000 over a five- year period, as identified in Attachments 2. Purchase orders encumbering funds under these agreements will only be issued once specific projects are identified and funding is secured. Funding for each project will be determined when the project is initiated, and the purchase order is authorized.

Potential funding sources may include local or state funds, or department operating budgets. While

contractors may receive multiple assignments each year, the total value of all assignments will not exceed the contract limit specified in Attachment 2.

Local Business Enterprise (LBE): The minimum LBE requirements is waived as the city has suspended competitive bidding and utilized an alternate procurement method to select vendors.
