2-Supplement No. 2
Description/Analysis
Issue Detail: YPCE’s Park Maintenance Division is responsible for on-going pond maintenance and water quality testing at City Parks. Proper maintenance and testing are critical to the long-term health of the park ponds and necessary for public health, safety, and welfare. Without a quality maintenance program, the ponds will degrade back to their prior state within five to seven years.

On April 4, 2024, Council authorized the City Manager or designee, to execute a contract (PRC002743) with Clean Lakes, Inc. for pond maintenance and testing for City parks in an amount not to exceed $1,112,838 for a contract term not to exceed five years (File ID:2024-00609).

Supplemental Contract No. 1 was executed to extend the agreement through June 30, 2026, and to increase the contract amount by $8,808 for additional as-needed services, resulting in a new not-to- exceed total of $1,121,646 over the potential five-year term.

Due to the City’s acceptance of responsibility for Granite Regional Park Pond, YPCE is requesting authorization for the Interim City Manager or designee to execute Supplemental Contract No. 2, increasing the not-to-exceed amount by $122,437, for a new not-to-exceed amount of $1,244,083.

Approving Supplemental Contract No. 2 will allow YPCE to provide on-going service at Granite Regional Park Pond moving forward.

Policy Considerations: The recommendations in this report are in accordance with the provisions of the City Code 3.56 related to the purchase of services and supplies.

Economic Impacts: None.

Environmental Considerations: Continuing maintenance activities, such as pond maintenance and testing, are not considered a “project” for the purposes of California Environmental Quality Act (CEQA) pursuant to Section 15378(b)(2) of the CEQA Guidelines (Title 14 Cal. Code Reg. § 15000 et seq.). Therefore, no environmental review is necessary.

Sustainability: The use of natural biological chemicals that do not harm plants or animals is required for this contract.

Commission/Committee Action: None.

Rationale for Recommendation: In accordance with City Code 3.56, YPCE issued Invitation for Bid No. B24191311005 for Pond Maintenance and Testing in City Parks. Staff received one response from Clean Lakes, Inc. A non-professional services agreement was awarded for one year with four optional one-year extensions to Clean Lakes, Inc., the lowest responsive and responsible bidder.

Financial Considerations: The original contract for the period beginning July 1, 2024, had a not-to- exceed amount of $1,121,646. Supplemental Contract No. 1 in the amount of $8,808 was executed for as-needed pond maintenance treatment. The proposed Supplemental Contract No. 2 in the amount of $122,437 would increase the agreement’s not-to-exceed amount to $1,244,083.

Sufficient funding is available in YPCE’s Fiscal Year 2025/26 operating budget to execute this extension. Any further extensions of this contract are subject to sufficient funding in the applicable fiscal years’ budget.

Local Business Enterprise (LBE): LBE requirements have been waived.
