3-Agreement Amendment - Caltrans Section 130 Funding (C2018-0341-6) Description/Analysis
Issue Detail: The Power Inn Road Queue Cutter Project will improve vehicle and pedestrian safety at the Power Inn Road Railroad Crossing between 21st Avenue and Fruitridge Road (Federal Rail Crossing ID 752887F). It will include the construction of a queue cutter traffic signal for southbound automobile traffic, close an existing sidewalk gap on the west side of Power Inn Road, install new railroad warning devices, and construct new concrete paneling to facilitate pedestrian crossings of the railroad tracks.
The project is funded with federal Section 130 funds administered by Caltrans and is intended to improve crossing safety at at-grade rail crossings. The Section 130 Railroad-Highway Crossings

Program (RHCP) is managed by the Caltrans Division of Local Assistance. Caltrans RHCP is a collaborative effort led by the California Public Utilities Commission (CPUC), funded by the Federal Highway Administration (FHWA), and implemented by Caltrans in cooperation with local agencies and railroads throughout California. Caltrans is responsible for administering funds, contracting and oversight of the Section 130 projects. The CPUC is responsible for creating the Section 130 priority funding list, development of scope, and preliminary cost estimates. Local agencies and the railroad company must work together to complete the design, environmental review, and construction for section 130 funded safety improvements. The City was awarded $929,813 in federal Section 130 funds for design and construction in March 2018. With design and bidding complete, City staff requested and received authorization for an additional $984,624 for construction and construction management costs in November 2021.
At the start of construction (May 2022), the contractor located an unanticipated conflict with a PG&E high pressure gas main which required that the project be paused while Union Pacific Railroad (UPRR) and City staff revisited the project design to avoid the conflict. The City was ultimately able to arrive at an acceptable design with UPRR; however, the delay in construction has resulted in price increases to the contractor due to material and labor price escalations. Caltrans agreed that these increased costs are eligible for additional Section 130 funds and authorized an additional $385,700 for the project for the re-design changes, bid price adjustments during work suspension and construction management costs in February 2024 for an amended Section 130 budget of $2,300,137, which is currently included in the City’s contract with Caltrans.
Local funds were previously included in the project to cover the portion of staff indirect costs that are not eligible under the grant. The total cost for the project is approximately $2.8 million.
For approval of the re-design, UPRR required a minimum clearance of the aerial utility lines from their railroad gate arm, which necessitated SMUD to relocate their poles. The coordination for review and UPRR approval has further delayed the project for which Caltrans has agreed the associated costs are eligible for additional Section 130 funds and has authorized an additional $400,000 to complete construction, for a revised Section 130 total of $2,700,137.
City Council approval is required to execute an amendment to the City’s existing project funding agreement with Caltrans in order to receive these additional funds.
Policy Considerations: The action requested supports the City’s General Plan goals of improving the transportation system and expanding public safety. The Project provides needed safety improvements at the at-grade crossing and fulfills contractual obligations with UPRR related to other capital improvement projects in the City.
The recommendations in this report are consistent with the provisions of Sacramento City Code section 3.04: city manager’s authority to issue contract amendments. City Council approval is

required as this contract amendment exceeds the city manager’s signing authority for contract amendments.
Economic Impacts: None
Environmental Considerations:
California Environmental Quality Act (CEQA) The project has been determined to be categorically exempt from CEQA under Sections 15301(c) and 15303 (d)(e).
National Environmental Policy Act (NEPA): In compliance with NEPA, Caltrans performs NEPA clearance pursuant to Section 130 Funding program guidelines and has determined that the project qualifies for a Categorical Exclusion and is therefore categorically excluded from having to prepare an environmental assessment (EA) or environmental impact statement (EIS).
Sustainability: The Project is consistent with the City’s General Plan goals for the design of walkable communities and incorporation of multi-modal design of major corridors.
Commission/Committee Action: None
Rationale for Recommendation: Staff recommends execution of the sixth supplemental agreement to City Agreement No.2018-0341 with the California Department of Transportation (Caltrans) to receive $400,000 (Other Capital Grant, Fund 3704) to complete the construction of the project.
Financial Considerations: The total estimated cost to complete the design, right-of-way, and construction activities for the Power Inn Road Queue Cutter Project (T15186000) is approximately $2.8 million. With the execution of the supplemental agreement and increase in the revenue and expenditure budgets of the Power Inn Queue Cutter Project (T15186000) by $400,000 (Other Capital Grant, Fund 3704) there will be sufficient funding to cover remaining construction management and all other project related costs.
There are no General Funds currently planned or allocated for this project.
Local Business Enterprise (LBE): Not applicable.

RESOLUTION NO.
Adopted by the Sacramento City Council
Contract Amendment with Caltrans and Budgetary Adjustments: Power Inn Queue Cutter Project (T15186000)
BACKGROUND
A. The Power Inn Road Queue Cutter Project (T15186000) will improve vehicular and pedestrian safety at the Power Inn Road Railroad Crossing between 21st Avenue and Fruitridge Road (Federal Rail Crossing ID 752887F). It will include the construction of a queue cutter traffic signal for southbound automobile traffic, close an existing sidewalk gap on the west side of Power Inn Road, install new railroad warning devices, and construct new concrete paneling to facilitate pedestrian crossings of the railroad tracks.
B. The project is funded with federal Section 130 funds intended to improve crossing safety at at-grade rail crossings. At the start of construction, the contractor located an unanticipated conflict with a PG&E high pressure gas main which required that the project be paused while Union Pacific Railroad (UPRR) and City staff revisited the project design to avoid the conflict. The redesign and obtaining UPRR’s approval have delayed the project and increased the costs.
C. The execution of the sixth contract amendment to City Agreement No.2018-0341 with Caltrans to receive $400,000 and approval to increase the revenue and expenditure budget is required to fund the remaining construction and construction support costs.
BASED ON THE FACTS SET FORTH IN THE BACKGROUND, THE CITY COUNCIL RESOLVES AS FOLLOWS:
Section 1. The City Manager or designee is authorized to execute a contract amendment to City Agreement No. 2018-0341 with the California Department of Transportation (Caltrans) to receive $400,000 in additional funding for construction of the Power Inn Queue Cutter Project (T15186000).
Section 2. The City Manager or designee is authorized to increase the revenue and expenditure budgets of the Power Inn Queue Cutter Project (T15186000) by $400,000 (Other Capital Grant, Fund 3704).
