Description/Analysis
Issue Detail: Staff recommends Council approve supplemental agreement #2 with Maddaus Water Management Inc. to provide the necessary analysis and time to identify recommended changes to City water efficiency programs to better align with new State Water Resource Control Board (SWRCB) mandates. The original contract was approved by City Council in October 2023, but SWRCB delays in final rule making and changes to mandated performance criteria delayed execution of original consultant scope. This supplemental agreement will extend time and funding to evaluate water use and program activity, one year after the completion of the report for the purpose of identifying community response to any program changes, as originally called out in the Request for Proposals. The Water Efficiency and Conservation Plan is expected to be finalized by the end of September 2025, while the current agreement expires on January 31, 2026.

Additionally, the consultant will provide technical support to the City for the development of water efficiency and conservation sections of its 2025 Urban Water Management Plan to align them with the Water Efficiency and Conservation Plan.

Policy Considerations: The proposed supplemental agreement exceeds the City Manager’s approval authority and requires Council approval pursuant to City Code section 3.04.020.

Economic Impacts: None.

Environmental Considerations: This report concerns administrative activities that will not have a significant effect on the environment and does not constitute a “project” as defined by the California Environmental Quality Act (CEQA) Guidelines Sections 15378(b)(2 and 5), and are not subject to CEQA [CEQA Guidelines Section 15060(c)(3)].

Sustainability: The work tied to the proposed supplemental agreement is consistent with the 2040 General Plan goal ERC 5, “Careful stewardship and efficient consumption of water and energy.” Commission/Committee Action: Not applicable.

Rationale for Recommendation: In late October of 2023, Maddaus Water Management, Inc. was awarded the contract to update the City’s Water Efficiency and Conservation Plan. Work began shortly after contract award, but the bulk of the analysis was necessarily delayed until the SWRCB finalized the “Making Conservation a California Way of Life” regulation in July of 2024.

The work as outlined in the second supplemental agreement will allow the City’s consultant additional time to complete its evaluation of the City’s water efficiency and conservation programs tied to future mandates, and expand the scope slightly to allow the consultant to assist both in the submission of the City’s mandatory statewide reporting the next two calendar years, and alignment of the Water Efficiency and Conservation Plan with the 2025 Urban Water Management Plan (UWMP). The first supplemental agreement involved a non-disclosure agreement involving data sharing and protection tied to a review of hourly water use data.

Currently, the contract expires on January 31, 2026, approximately four months after the expected finalization of the Water Efficiency and Conservation Plan. Extending the agreement through December 31, 2026, and expanding the scope will allow time for the consultant to conduct additional analysis and complete the Plan, aligning this work with water efficiency sections of the 2025 UWMP.

Financial Considerations: The proposed supplemental agreement would raise the not-to-exceed amount by $70,000 for a total not-to-exceed amount of $423,204 and is an extension of time of performance to December 31, 2026. Sufficient funding exists in the Water Conservation Program
