Description/Analysis
Issue Detail: Pursuant to the procedures set forth in Sacramento City Code Chapter 12.16 and California Vehicle Code Section 21101.4 and pursuant to City Council Resolution Nos. 2024-0118, 2024-0117, 2024-0116, and 2024-0115, the temporarily closures to through vehicular and pedestrian traffic for the subject alleys/streets due to serious and continual criminal activity were previously approved. Under the Vehicle Code, the City Council may extend temporary closures for up to eight additional periods of up to 18 months if the extension would assist in preventing the occurrence or recurrence of serious and continual criminal activity.

This request for an 18-month extension is the third extension for the streets and alleys of Resolution 2024-0115 and the first extension for the streets and alleys referenced in Resolutions 2024-0116, 2024-0017 and 2024-0118 of potentially eight authorized extensions. The subject alleys/streets will

File ID: 2025-01655 10/21/2025
remain physically closed to through vehicular and pedestrian traffic once the closure extensions for these subject alleys have been approved by the City Council. The adjacent property owners support the extension of the temporary closure status of the subject alleys/streets due to the continual criminal activity. The Police, Fire, and Public Works Departments support and recommend the 18- month time extension of the existing temporary closures of the subject alleys and streets as listed in Exhibit A and Exhibit B of the attached Resolution. This request is submitted to retroactively approve the temporary closure time extension granted under Resolutions 2024-0115, 2024-0116, 2024-0117 and 2024-0118 that were through October 9, 2025. This request is to retroactively approve the extensions as of October 9, 2025.

Policy Considerations: The procedures under which the closure to vehicular and pedestrian traffic is initiated are set forth in Vehicle Code Section 21101.4 and Sacramento City Code Chapter 12.16.

These codes allow the temporary closures of alleys and streets to through vehicular and pedestrian traffic for the protection or preservation of the public peace, safety, health or welfare.

Economic Impacts: None.

Environmental Considerations: California Environmental Quality Act: The temporary street and alley closures were previously determined to be exempt from the provisions of the California Environmental Quality Act (CEQA) under Section 15301(c) of the CEQA Guidelines in that this temporary street closure involves a minor alteration of an existing public facility, with no additional automobile lanes and no expansion of use beyond what currently exists. Access to the street will be given to appropriate departments and agencies. The Community Development Department, Environmental Planning Services section has reviewed the proposed action for time extensions of the temporary street and alley closures and determined the action is exempt under the same CEQA Guidelines Section 15301(c).

Sustainability: Not applicable.

Commission/Committee Action: None.

Rationale for Recommendation: Adoption of the attached Resolution will provide the continued security of the adjacent properties by eliminating the opportunity for individuals to commit illegal acts and illegal dumping within these subject alleys and streets.

Financial Considerations: The estimated cost for processing this time extension request is approximately $20,000. There is sufficient funding within the Alley Abatement Program (T15100900) to cover this project cost.

Local Business Enterprise (LBE): Not applicable.

Background: The temporary closures were processed pursuant to State Vehicle Code 21101.4 and City Code Section 12.16 and were authorized to be closed to through vehicular and pedestrian traffic for an (18) month period. The alley/street locations are included as Exhibits A and B.

The subject alleys/streets are public rights-of-way which were once unrestricted to through vehicular and pedestrian traffic. Due to illegal activity such as burglary, prostitution, vandalism, and illegal dumping, the City Council approved the temporary closures of the 112 alleys/streets. The temporary closure of these alleys/streets are valid for 18 months from the time that they were initially approved.

Extending the temporary closure status of these alleys/streets for an additional 18 months requires City Council approval.

Extension of a temporary closure of streets requires the following criteria to be met:

1. Continuation of the temporary closure will assist in preventing the occurrence or recurrence of the serious and continual criminal activity found to exist when the immediately preceding temporary closure was authorized. This finding shall be based upon the recommendation of the Police Department.

2. The street has not been designated as a through highway or arterial street.

3. Vehicular or pedestrian traffic on the street contributes to criminal activity.

Support for the temporary closure time extension in addition to meeting the criteria for this action is provided as Attachments 2, 3, and 4 by the Police Department, Fire Department, and Transportation Division, respectively.

The approval of the time extension for the temporary closures requires that the City and property owners’ maintenance of the security devices, wrought-iron gates, locking mechanisms, electric gates, bollards and non-standard gates be maintained by the responsible parties as described in the initial temporary closure.

The temporary closure time extension of the subject alleys/streets listed are not to exceed 18 months unless the closures are extended pursuant to the procedures set forth in Sacramento City Code Chapter 12.16. Pursuant to Sacramento City Code Chapter 12.16, once approved, the closures may be extended up to an additional eight (8) consecutive periods of not more than 18 months each.

Noticing to the public regarding the temporary street closures has been completed prior to this City Council meeting in accordance with City Code Section 12.16.220.

FROM: Department of Public Works, Transportation Division SUBJECT: CLEARANCE FOR THE TEMPORARY CLOSURE, TIME EXTENSION OF 112 ALLEYS/STREETS LOCATED IN COUNCIL DISTRICTS 2, 3, 4, 5, 6, 7 and 8
In reference to the requested Temporary Closure time extension of the subject alleys/streets in Council Districts 2, 3, 4, 5, 6, 7 and 8, I have reviewed the material of the subject rights-of-way. I find that the subject alleys/streets are under the City of Sacramento’s jurisdiction and the temporary closures of the subject areas do not include through highways or arterial streets. It also appears that maintaining the temporary closures will allow adequate and safe traffic circulation on the adjacent streets. The Department of Public Works supports the temporary closure time extension request of the subject alleys/streets, per Exhibit A and Exhibit B.
