1-Description/Analysis
2-Purchase and Sale Agreement
3-Resolution
Description/Analysis
Issue Detail: On November 15, 2022, per Resolution No. 2022-0352, the City Council declared the property located at 2260 Glen Ellen Circle as “surplus property.” On July 2, 2024, in accordance with the California Surplus Land Act (the “SLA”) as set forth in Government Code Section 54220 et seq., a Notice of Availability (NOA) was sent to local public agencies and Housing Sponsors on the list posted by the California Department of Housing and Community Development (HCD). One Housing Sponsor responded to the NOA within 60 days, and per the SLA requirements, negotiations commenced with the respondent. However, the City and the respondent were unable to reach an agreement. On July 11, 2025, the City hired Turton Commercial Real Estate to list the Property for sale on the open market for $350,000. The City received 11 verified offers and selected the offer with the most favorable terms at the highest price, a $475,000 cash sale.

Policy Considerations: The recommendations in this report are consistent with the provisions of City Code Section 3.04.010 and Chapter 3.88 regarding the disposition of real property owned by the City, and the California Surplus Land Act (Government Code section 54220 et seq.).

Economic Impacts: None
Environmental Considerations: California Environmental Quality Act: The sale of surplus property is exempt from environmental review under CEQA Guidelines Section 15312, Surplus Government Property Sales, because the property is not located in an area of statewide, regional or areawide concern; it does not have significant values for wildlife habitat; the use of the property and adjacent property has not changed since the time of purchase; and the PSA does not approve development of the property.

Sustainability: Not applicable.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: Approval of the PSA will allow the City to dispose of this surplus property which has been vacant for more than 8 years. The sale will eliminate the costs for maintenance of the Property and provide funds to repay the Storm Drainage Fund, Water Fund, and Wastewater Fund. The remaining net sales proceeds are to be deposited in the City’s Innovation and Growth Fund.

Financial Considerations: The property was purchased in 1997 for $71,000, using a variety of fund

sources. The Storm Drainage Fund and Water Fund each contributed $19,360, the Wastewater Fund contributed $9,684, and the remaining funds came from the General Fund. The City must return a portion of the sales proceeds to the Storm Drainage, Water, and Wastewater Funds, equivalent to what would have accrued if invested in Pool A. The City Treasurer’s Office has calculated these amounts as follows:
· Storm Drainage Fund - $42,696
· Water Fund - $42,696
· Wastewater Fund - $21,357
There is a 5% brokerage commission owed to the broker representing the City, and the City will be required to pay its share of property tax assessments, escrow fees, and transfer taxes. In addition, Department of Public Works staff time will be paid out of the sales proceeds after the close of escrow.

These costs and repayment to the Storm Drainage Fund, Water Fund, and Wastewater Fund will be deducted from the $475,000 cash sales proceeds. The remaining net cash sales proceeds will be deposited in the Innovation and Growth Fund pursuant to Resolution No. 2015-0038.

Local Business Enterprise (LBE): Not applicable.

RESOLUTION NO. 2025-

Adopted by the Sacramento City Council

Approving Purchase and Sale Agreement with Hoang Vinh Hoang for Property at 2260 Glen Ellen Circle

BACKGROUND

A. In 1997, the City acquired the property at 2260 Glen Ellen Circle, APN: 035- 0131-053-0000 and a portion of 035-0131-054-0000, (“Property”) for $71,000 with $19,360 from the Storm Drainage Fund, $19,360 from the Water Fund, $9,684 from the Wastewater Fund, and $22,596 from the General Fund. The Property was occupied by the Water Conservation Office until approximately 2015 and is now vacant. The City has since determined that the Property is no longer necessary for the City’s operations.

B. In accordance with the California Government Code section 54221(b)(1) of the Surplus Land Act, the Property was declared “Surplus Land” by the City Council on November 15, 2022, via Resolution No. 2022-0352. The City issued a Notice of Availability on July 1, 2024, and received letter of interest from an affordable housing developer. The City negotiated with the respondent for more than 90 days, however the negotiations did not result in a sale of the Property for an affordable housing project.

C. The City listed the Property for sale on the open market and selected the offer with the most favorable terms at the highest price.

D. The City has complied with the provisions of City Code Section 3.04.010 and Chapter 3.88 regarding the disposition of real property.

BASED ON THE FACTS SET FORTH IN THE BACKGROUND, THE CITY COUNCIL RESOLVES AS FOLLOWS:

Section 1. The Purchase and Sale Agreement (PSA) with Hoang Vinh Hoang for the property at 2260 Glen Ellen Circle for $475,000.00 is hereby approved.

Section 2. Selling the Property without first calling for bids is in the best interest of the City under City Code section 3.88.090.A.2.

Section 3. The Interim City Manager or the Interim City Manager’s designee is authorized to execute the PSA, escrow instructions, and grant deed and to take all actions and execute all additional documents as may be necessary to implement the property sale.

Section 4. The Interim City Manager or the Interim City Manager’s designee is authorized to pay the broker fee, escrow fees, assessments, transfer taxes, and other fees from the sales proceeds to complete the sale of the Property in accordance with the terms of the PSA.

Section 5. The Interim City Manager or the Interim City Manager’s designee is authorized to increase the Fiscal Year (FY) 2025/26 revenue budget in the Department of Utilities by $42,696 (Water Fund, Fund 6005) and increase the available fund balance of the Water Fund by the same amount.

Section 6. The Interim City Manager or the Interim City Manager’s designee is authorized to increase the FY2025/26 revenue budget in the Department of Utilities by $21,357 (Wastewater Fund, Fund 6006) and increase the available fund balance of the Wastewater Fund by the same amount.

Section 7. The Interim City Manager or the Interim City Manager’s designee is authorized to increase the FY2025/26 revenue budget in the Department of Utilities by $42,696 (Storm Drainage Fund, Fund 6011) and increase the available fund balance of the Storm Drainage Fund by the same amount.

Section 8. The Interim City Manager or the Interim City Manager’s designee is authorized to increase the FY2025/26 revenue budget in the Citywide and Community Support Department by $368,251 (Innovation and Growth Fund, Fund 2031), increase the FY2025/26 expenditure budget in the Citywide and Community Support Department by up to $368,251 for staff costs related to executing the PSA, and increase the available fund balance of the Innovation and Growth Fund by up to $368,251 for remaining net sales proceeds pursuant to Resolution No. 2015-0038.
