Issue Detail: Under California Government Code (GC) section 30029.05(e), the State of California provides CitzOpt and CitzOpt-Growth funds to counties. In accordance with GC section 30061(g), counties are required to distribute these funds to cities based on population. GC section 30061(d) prohibits a city’s governing body from altering any previously adopted appropriations of existing funds upon receipt of these funds. GC section 30062(a) further mandates that the funds must be used solely to support frontline municipal law enforcement services, such as equipment and supplies to support operations, community policing efforts, and patrol services, and may not be used to supplant existing public safety funding.

Further, GC section 30063 requires that funds received pursuant to GC sections 30029.05(e) and

30061(g) be accounted for separately and used exclusively for the purposes specified in the statute.

These funds cannot be comingled with other resources and must be used only to support law enforcement activities.

Policy Considerations: The recommendations in this report are consistent with GC section 30061 (c)(2), which requires that funding be appropriated by the governing body; and Resolution 2025- 0162, Section 11.5, which states that Council approval is required to adjust operating grant revenue and expenditure budgets for renewals of $250,000 or more.

Economic Impacts: None.

Environmental Considerations: The proposed activity is not a project pursuant to the California Environmental Quality Act (CEQA) as it is an organizational or administrative activity of governments that will not result in direct or indirect physical changes in the environment (CEQA Guidelines, section 15378(b)(5)).

Sustainability: Not applicable.

Commission/Committee Action: Not applicable.

Rationale for Recommendation: Program disbursements to cities are mandated in state law and the use thereof is limited to activities that directly support frontline municipal law enforcement services.

Financial Considerations: Funds must be used solely to support frontline municipal law enforcement services, such as equipment and supplies to support operations, community policing efforts, and patrol services and cannot be used to supplant, or otherwise replace, other appropriated resources per GC section 30062(a).

Local Business Enterprise (LBE): Not applicable.
