Description/Analysis
Issue Detail: The proposed omnibus ordinance includes various amendments to Title 17 of the City Code in response to new planning and zoning laws passed during the 2024 State legislative session as well as a budget trailer bill from May 2025. The amendments are, with two exceptions, limited to changes necessary to align the City Code with State law, including:
· AB 2085 (Community Clinics)
· SB 1211 (Accessory Dwelling Units)
· AB 2904 (Zoning Ordinances: Notices)
File ID: 2026-00023 1/13/2026
· AB 3122 (Streamlined Housing Approvals)
· AB 2243 (Middle Class Housing Act of 2022 and Affordable Housing and High Road Jobs Act of 2022: Ministerial Housing Changes)
· SB 450 (SB 9 Approvals)
· AB 130 (Housing Omnibus - Permit Streamlining Act)
One administrative clean-up amendment is included to clarify the criteria for staff to determine the timely filing of appeals; another is to address the applicability of objective standards to accessory dwelling units located in historic districts or on landmark properties.
A detailed explanation of proposed amendments is provided at Attachment 2 (Background). A redline (showing deletions/additions) and clean version of the ordinance are at Attachment 3 and 4.
Policy Considerations: Title 17 (Planning & Development Code) is the primary means by which the City’s land use policy is implemented. The ordinance helps advance the following 2040 General Plan goals and policies:
Land Use Element
Goal LU-1: A compact urban footprint and sustainable development pattern with infrastructure that supports efficient delivery of public services while protecting surrounding open space lands.
Goal LU-2: Balanced and connected community with thriving neighborhoods and centers and development intensities linked to transit.
Goal LU-3: Flexible development standards to promote revitalization in corridors and centers.
Housing Element
Policy H-2.3.2: Streamlined Application and Building Process. The City shall continue to facilitate interdepartmental review of development applications, encourage pre-application meetings with planning and building staff, and streamline the overall planning application and building process for all development types.
Policy H-2.3.5: Clear Development Standards and Approval Procedures. The City shall maintain and administer clear development standards, and approval procedures for a variety of housing types, including, but not limited to, multifamily housing and emergency shelters.
Economic Impacts: None.
File ID: 2026-00023 1/13/2026
Environmental Considerations: The proposed ordinance is exempt from CEQA pursuant to California Environmental Quality Act (CEQA) Guidelines Sections 15060(c)(3), 15061(b)(3), and 15378(b)(5). None of the proposed amendments will result in direct or indirect physical changes in the environment and as such the ordinance is exempt from CEQA review.
Sustainability: The proposed ordinance includes amendments that help to make zoning standards easier to understand and implement. This will help facilitate development in the City in a manner consistent with existing policy, including that relating to sustainability.
Commission/Committee Action: On May 28, 2025, pursuant to City Code Section 17.916.010(A), the Planning Director initiated the proposed ordinance. On November 13, 2025, pursuant to City Code Section 17.916.010.B, the Planning & Design Commission reviewed the ordinance and, after conducting a public hearing, forwarded an approval recommendation to City Council. On December 2, 2025, pursuant to the City Council Rules of Procedure, the Law & Legislation Committee considered the ordinance and forwarded an approval recommendation to City Council. On December 9, 2025, the City Council
passed for publication the ordinance title in accordance with Sacramento Charter section 32(c).
Rationale for Recommendation: Orderly and well-planned development cannot be easily achieved without accurate and clear regulations. The ordinance provides for regulations which are consistent with new state laws. In doing so, the ordinance helps staff and code users maintain focus on achieving the policy goal rather than being distracted by questions about City Code inconsistencies with state law.
Financial Considerations: Not applicable.
Local Business Enterprise (LBE): Not applicable.

ATTACHMENT 2: BACKGROUND
Introduction
This attachment provides a summary for each amendment proposed in the omnibus ordinance. For this omnibus ordinance, amendments are, with two exceptions, limited to those necessary to align Title 17 (Planning & Development Code) with state planning and zoning laws passed during the 2024 legislative session, including those attached to the budget adoption in May 2025.
Each ordinance section is focused on one of the new state laws and organized as follows:
Topic: State law local ordinance amendments respond to. Ordinance Section numbers: to locate and review the text within the ordinance. Title 17 Section Number(s): to identify the specific section(s) being amended. Issue Statement: to explain why an amendment is proposed. Amendment Summary: to concisely explain the proposed amendment. Rationale: the reasoning behind amendment(s) proposed.
A. Amendment Category: State Law Consistency
Topic: AB 2085 (Community Clinics) (website hyperlink)
Ordinance: Sections 2 to 24
Title 17: Sections 17.108.040, 17.208.510, 17.208.610, 17.208.710, 17.212.110,
17.212.210, 17.216.110, 17.216.210, 17.216.310, 17.216.420,
17.216.510, 17.216.610, 17.216.710, 17.216.810, 17.216.910,
17.220.110, 17.220.210, 17.220.310, 17.220.410, 17.220.610,
17.220.710, 17.224.110, 17.228.118
Issue: AB 2085 became effective September 28, 2024. This bill creates a streamlined, ministerial approval process for “community clinics” that satisfy objective planning standards. A “community clinic” must be licensed pursuant to Section 1204 of the Health and Safety Code and provide reproductive health services as defined in subdivision (f) of Section 423.1 of the Penal Code.
AB 2085 intends to ensure local governments do not delay or halt the provision of reproductive health services. The bill requires the city to allow “community clinics” in zones where office, retail, health care, or parking are a principally permitted use. Today, Title 17 of the City Code allows “community clinics” to locate in many zoning districts; however, the existing permit requirements and standards are not entirely consistent with AB 2085.
Amendment Summary:
Add definition for new land use of “community clinics” consistent with that provided in State law.
Add “community clinics” land use to zoning districts where office, retail, health care and parking are permitted uses, as required by State law. The affected zones are R-4, R-4A, R-5, RMX, RO, OB, OB-2, OB-3, EC, SC, C-1, C-2, C-3, C- 4, M-1, M-1(S), M-2, M-2(S), MRD, MT, and H.
Add special use regulations for “community clinics” which fulfill the ministerial review process requirement and impose standards mandated by the State.
Where applicable, apply the existing area limitations of a zoning district except when a conditional use permit is required to exceed the prescribed area. For example, multi-family zoning districts have (for office uses) the following, “This
Attachment 2: Background Page 3 of 7
and all other similarly restricted uses combined are limited to 25% of gross floor area or 6,400 square feet of a building, whichever is greater.”
Rationale: The proposed amendments ensure the City Code remains consistent with State law. The amendments are straightforward and simply apply the statute, as worded.
Topic: SB 1211 (Accessory Dwelling Units) (website hyperlink) ADU Objective Standards at Historic Properties
Ordinance: Section 25
Title 17: Section 17.228.105(C)
Issue: SB-1211 became effective January 1, 2025. This bill changed State standards for accessory dwelling units (ADUs) at existing and proposed multiple-family developments.
Existing multi-family developments may now have up to eight (8) ADUs but not more than the number of existing units on the lot. The bill also makes clear that no local standards, including those that are objective, may be imposed on ADUs proposed under and compliant with State standards.
On September 17, 2025, the Preservation Commission considered and forwarded an approval recommendation for Accessory Dwelling Unit Design Standards for Historic Properties. Should the City Council adopt those standards, it is important that Title 17 reflect their applicability in relation to other standards generally applicable citywide.
Amendment Summary:
Update the number of ADUs allowed at multi-family developments to be consistent with SB-1211.
Add a provision referencing the applicability of Accessory Dwelling Unit Design Standards for Historic Properties, when adopted by City Council.
Rationale: The proposed changes ensure consistency with State Law. The City’s website and ADU application form have already been updated to reflect the requirements of AB 1211. Additionally, the new applicability statement for Accessory Dwelling Unit Design Standards for Historic Properties ensures they will be applied rather than others applicable citywide to non-historic properties.
Topic: AB 2904 (Zoning Ordinances: Notices) (website hyperlink) Ordinance: Section 30
Title 17: Section 17.604.220
Section 17.812.030
Issue: AB-2904 became effective September 30, 2024. This bill increases the number of days public notice is required for zoning ordinance amendments considered by the Planning & Design Commission and that affect the permitted uses of real property. The notice time is increased from 10 days before a public hearing to 20 days.
Amendment Summary:
Add the 20-day notice requirement, as required by AB-2904. Update a reference in Section 17.604.220 that relies on Section 17.812.030
Rationale: The proposed change is self-explanatory and limited to edits necessary to ensure consistency with State Law.
Topic: AB 130 (Housing Omnibus – Permit Streamlining Act) (website hyperlink)
Ordinance: Section 27 to 29
Title 17: Chapter 17.800
Issue: AB 130 became effective July 1, 2025. This omnibus bill changes many provisions of the Government Code and Public Resources Code relating to housing.
Included therein are substantive amendments to the Permit Streamlining Act (California Government Code Title 7, Division 1, Chapter 4.5). The City Code provides implementing regulations for the Permit Streamlining Act at Chapter 17.800, and some of the provisions there require amendment to be consistent with AB 130.
Amendment Summary:
Implement the Permit Streamlining Act’s amended provisions for ‘deemed approved’ outcomes.
Attachment 2: Background Page 5 of 7
Clarify application types not subject to the Permit Streamlining Act in response to AB 130 definition changes for “development project.”
Revise the criteria and process for applications processed untimely to align with the Permit Streamlining Act.
Miscellaneous edits to align terminology in Chapter 17.800 with the Permit Streamlining Act, as amended by AB 130.
Rationale: The proposed amendments ensure the City Code remains consistent with State law. Concurrent with the public hearings for this local omnibus ordinance, staff are also reviewing (and revising) all Planning Forms (see
https://www.cityofsacramento.gov/community-development/planning/planning-forms) to ensure compliance with the Permit Streamlining Act.
Topic: AB 3122 (Streamlined Housing Approvals) (website hyperlink) Ordinance: Section 32
Title 17 Section 17.860.020
Issue: AB 3122 became effective September 30, 2024. This bill changes a provision in Government Code Section 65913.4 which provides a streamlined, ministerial review process for multi-family housing developments including affordable housing. This process is commonly referred to as SB 35, originally enacted in the year 2017.
Presently, the City Code provides implementing regulations at Section 17.860.020, and which are inconsistent with the changes made by AB 3122.
Amendment Summary:
For denied applications, add a new provision requiring a 30-day review period for resubmittals, consistent with AB 3122.
Rationale: The proposed change ensures the City Code remains consistent with State law. The accompanying application form has already been updated on the Community Development Department website to reflect the requirements of AB 3122.
Topic: AB 2243 (Middle Class Housing Act of 2022 and Affordable Housing and High Road Jobs Act of 2022: Ministerial Housing Changes) (website hyperlink)
Ordinance: Section 33
Title 17 Section 17.860.021
Issue: AB 2243 became effective September 20, 2024. This bill changes Government Code Section 65852.24 which provides a streamlined, ministerial review process for affordable housing developments at commercially zoned properties and along commercial corridors. Presently, the City Code provides implementing regulations at Section 17.860.021 but which do not yet reflect the change made by AB 2243.
Amendment Summary:
For denied applications, add a new provision requiring a 30-day review period for resubmittals, consistent with AB 2243.
Rationale: The proposed change ensures the City Code remains consistent with State law. The accompanying application form has already been updated on the Community Development Department website to reflect the requirements of AB 2243.
Topic: SB 450 (SB 9 Approvals) (website hyperlink)
Ordinance: Section 34 & 35
Title 17: Section 17.864.020, 030
Issue: SB 450 became effective September 19, 2024. This bill changes provisions in Government Code Sections 65852.21 and 66411.7 relating to urban lot splits and housing developments with two units. These projects are commonly referred to as ‘SB 9’ projects. The City Code provides implementing regulations at Chapter 17.864, and which do not yet reflect the change made by SB 450.
Amendment Summary:
For both urban lot splits and housing developments of up to two units, add a new provision requiring a 60-day review period for application approval or denial.
Applications not acted upon within that timeframe are deemed approved. For urban lot splits, remove impacts on the physical environment as a basis for which to deny applications.
For housing developments, remove the bulk control standards at Section
17.864.020(A)(2)(d) to achieve consistency with Government Code Section
Attachment 2: Background Page 7 of 7
65852.21(b)(2)(B)(ii) which states, in relevant part, “a local agency may require a setback of up to four feet from the side and rear lot lines.” The State Housing & Community Development Department (HCD) has provided written guidance that the referenced setback maximum applies to upper stories and that setback regulations by other names (e.g., step back, or bulk control) resulting in a setback greater than 4 feet are not permitted.
Rationale: The proposed amendments ensure the City Code remains consistent with State law. The amendments are straightforward and simply apply the statute (including State HCD guidance), as worded. The accompanying application form for SB 9 projects has already been updated on the Community Development Department website to reflect the requirements of SB 450.
