RE: AB 1243 & SB 684 – POLLUTERS PAY CLIMATE SUPERFUND ACT – SUPPORT
Dear Assemblymember Addis and Senator Menjivar:
On behalf of the City of Sacramento (City), I write in support of AB 1243 and SB 684, the Polluters Pay Climate Superfund Act (Act). The legislation would establish the Polluters Pay Climate Superfund Program, which is modeled after the federal Superfund law that requires companies to pay for the cleanup of contamination caused by their activities. Under the Act, the State would determine the total amount of damage caused to the state by covered fossil fuel emissions from a specified period and assess a cost recovery demand against responsible parties to be used to fund qualifying expenditures.
California is already experiencing the harmful effects of climate change, including an increase in extreme heat events, drought, floods, wildfire, sea level rise, and more. There also is a human cost to climate change, with its effects harming people’s physical health, mental health, and food security. We can expect these harmful effects to continue and worsen. The California Natural Resources Agency estimates that climate disasters will cost California at least $113 billion annually by 2050.
The Act is intended to shift the financial burden of the climate crisis away from taxpayers to the businesses that have profited off the fossil fuel industry. Funds would be used to pay the companies’ fair share of costs associated with climate change damage, adaptation, and mitigation in California. These costs could include community disaster preparedness, such as evacuation planning and emergency housing, as well as energy efficiency, zero-emission fleets and charging, and natural resource protection.
The City has undertaken a comprehensive effort to address the effects of climate change, including adoption of our Climate Action & Adaptation Plan. The Climate Action & Adaptation Plan encompasses a multifaceted approach to reduce climate pollution, addressing critical areas such as sustainable transportation, energy efficiency and electrifying building energy systems, renewable energy adoption and storage, and waste reduction. The City estimates the long- term cost for direct city operations to meet carbon neutrality by 2045 to be around $3.2 billion, which does not include other climate-related costs, such as bike and pedestrian-friendly infrastructure, EV charging and urban trees. The Act would provide critical funding to the City so that we can address the effects of climate change locally.
AB 1243 and SB 684 would reduce the burden of climate change and climate-related emergencies on local governments and taxpayers. For this reason, the City is pleased to support AB 1243 and SB 684. If there are any questions about the City’s position, please contact Consuelo Hernandez, Director of Governmental Affairs, at 916- 808-7395 or [email protected].
Sincerely,
Chair, Law and Legislation Committee
