DATE: JANUARY 11, 2022
DEPARTMENT: PUBLIC WORKS
FROM: DAVID JACOBS P.E., L.S., PUBLIC WORKS DIRECTOR

ANDREW EASTERLING, TRAFFIC ENGINEER
TITLE: PEDESTRIAN CROSSING ENHANCEMENTS; CIP 9188, HSIPL-5045(035) RECOMMENDED MOTION:

A motion to approve a Resolution:

Awarding a contract to Precision Grade, Inc. for the Pedestrian Crossing Enhancements Project; CIP 9188, HSIPL-5045(035), in the amount of $1,058,098.00; Authorizing an increase of $365,00.00 to CIP 9188 appropriation for construction; and Authorizing a transfer from the Measure X Fund.

RECOMMENDATION:

It is recommended that the City Council approve a Resolution awarding a contract to Precision Grade, Inc. for the Pedestrian Crossing Enhancements Project; CIP 9188, HSIPL-5045(035), in the amount of $1,058,098.00; and authorizing an increase of $365,00.00 to CIP 9188 appropriation and use of Measure X fund balance for construction.

EXECUTIVE SUMMARY:

On August 10, 2021 City Council approved plans and specifications for the Pedestrian Crossing Enhancements Project, and authorized the issuance of invitation to bid the project, by Council Resolution (No. 22161). The project was advertised on August 11, 2021, and the City opened bids on September 9, 2021. The low bidder was Precision Grade, Inc. for the amount of $1,058,098.00. The contractor did not meet the Disadvantaged Business Enterprise (DBE) goal specified in the contract, however the contractor made a good faith effort and the City can award the contract with a lower the DBE commitment. Based on the bid results and the existing balance there is a budget shortfall of $360,392.70. Staff recommends an increase of $365,000.00 to CIP 9188 appropriation and a transfer from the Measure X Fund for the same amount to cover the budget shortfall.

BACKGROUND:

On February 5, 2019, City Council accepted $250,000 in Highway Safety Improvement Program (HSIP) Cycle 9 grant funds to enhance uncontrolled crosswalks at six locations, via Council Resolution (No. 21558). On June 23, 2020 City Council approve an agreement with the Transportation Agency of Monterey County (TAMC) for the use of Regional Surface Transportation Program (RSTP), which included $90,473.60 programmed towards the Pedestrian Crossing Enhancements Project, by Council Resolution (No. 21873). On August 26, 2020 the TAMC Board of Director’s awarded $545,000 in RSTP competitive grant funds to Salinas for the Pedestrian Crossing Enhancements Project.

City staff completed plans, and specifications for the project, and estimated the probable construction cost. The project generally consists of crosswalk enhancements at six uncontrolled pedestrian crossing locations: Sanborn Road and Buckhorn Drive; Natividad Road and Pacheco Street; W Laurel Drive and Parkside Street; E Laurel Drive and Tapadero Street; Iverson Street and Lang Street; and Wood Street and Santa Maria Street. The enhancements include high visibility signs and markings, median pedestrian refugee islands, rectangular rapid flashing beacons and a pedestrian hybrid beacon. While six uncontrolled crossing are proposed to be enhancements, the plan also proposes removing a marked crosswalk at Geil St and Iverson St which is adjacent to a location which is being enhanced. Staff recommends City Council approve Plans and Specifications for the Pedestrian Crossing Enhancements Project; CIP 9188, HSIPL-5045(035).

Five contractors submitted bid proposals for the project, and the results are as follows:

Contractor
Total Bid
Precision Grade, Inc.
$1,058,098.00
Granite Rock Company
$1,113,190.00
Granite Construction
$1,150,729.00
Alfaro Communications
Construction Inc.
$1,170,372.00
Norcal Contractor
$1,285,916.68
Precision Grade, Inc is the low bidder. The DBE Goal was 12% participation, and the Precision Grade bid proposal appeared to have met the goal. However, when reviewing the proposal with Caltrans Local Assistance, it was determined that one of the DBE subcontractor did not have the appropriate certifications to claim work as DBE participation. City staff initially found that the contractor did not meet the DBE goal and did not conduct a good faith effort. On October 18, 2021, the contractor submitted a request for a reconsideration hearing. On November 22, 2021 the City made determination that the contractor did make a good faith effort, and on December 3, 2021, the contractor submitted a revised DBE Commitment rate of 9.7%. The City can award the contract with a lower DBE commitment, since a good faith effort was made.

CEQA CONSIDERATION:

The City of Salinas has determined that the project is exempt from the California Environmental Quality Act (CEQA) Guidelines (Section 15301, Class 1(c)) because the actions consists of operation and minor alteration of an existing City street. A notice of exemption has been prepared and will be submitted to the County Clerk’s office.
