RESOLUTION NO. (N.C.S.)

A RESOLUTION OF THE SALINAS CITY COUNCIL AUTHORIZING THE MAYOR TO EXECUTE A MEMORANDUM OF

UNDERSTANDING WITH THE COUNTY OF MONTEREY REGARDING THE MUTUAL PLANNING AND IMPLEMENTATION OF GOVERNMENT SERVICES AND FACILITIES IN DOWNTOWN SALINAS AND ESTABLISHING A PARKING FACILITY CAPITAL IMPROVEMENT PROGRAM ACCOUNT WHEREAS, downtown Salinas encompasses Monterey County’s largest concentration of local and state government offices, including the County Administrative Offices, the State Superior Court, and Salinas City Hall; and WHEREAS, the County and the City each recognize that the continued concentration of government offices and government workers in the downtown Salinas is beneficial for the efficient and effective provision of many government services and functions and is essential for the economic health and well-being of downtown Salinas; and WHEREAS, since 2012 the City and County have mutually agreed to work together under a Memorandum of Understanding to plan a Government Center that connects to downtown as provided in the 2015 Downtown Vibrancy Plan (DVP); and WHEREAS, while many accomplishments have been achieved to date, there are still many actions and projects related to DVP implementation and the Downtown Government Center that will need to be undertaken and/or implemented over the course of the next five (5) years; and WHEREAS, given that continued City and County coordination of these efforts is vital, City and County staff prepared a draft Downtown MOU to ensure continued collaboration on planning of a multi-agency campus style government center as provided in the DVP; and WHEREAS, this MOU only outlines an agreed upon approach for the City and County to coordinate planning activities for a Government Center and downtown Salinas as provided in the DVP and to commit staff and financial resources to undertake identified planning activities, all of which can be seen with certainty to have no possible significant effect on the environment; and WHEREAS, Section 15061 (b) (3) of the CEQA Guidelines states that when it can be seen with certainty that there is no possibility that the activity in question, in this case the adoption of an MOU, may have a significant effect on the environment, the activity is not subject to CEQA; and WHEREAS, if recommended policies or actions progress to a “project” level further CEQA analysis will be required to address potential environmental impacts of a proposed project.

NOW, THEREFORE, BE IT RESOLVED that the Salinas City Council hereby approves the attached Memorandum of Understanding between the County of Monterey and the City of Salinas Regarding Mutual Planning and Implementation of Government Services and Facilities in Downtown Salinas, provided as Exhibit A, in substantially the form submitted to the City Council and Board of Supervisors of the County and authorizes the Mayor to execute the Memorandum of Understanding on behalf of the City; and BE IT FURTHER RESOLVED that the Salinas City Council hereby directs staff to establish a new Capital Improvement Program (CIP) for the Parking Facility with a supplemental appropriation of $600,000 for 5800.50.xxxx-63.5900 (Other Professional Services), authorizing transfers to the CIP Fund (5800) of $300,000 from the General Fund (Fund 1000) and $300,000 from Fund 5203 – Developers Contribution to fund the supplemental appropriation, and budgeting revenue of $300,000 to 5230.00.0000-50.5703 for reimbursement received from the County for its portion of Planning Activity Costs; and BE IT FURTHER RESOLVED that this Resolution shall take immediate effect upon approval.
