RESOLUTION NO. (N.C.S.)
AMENDMENT TO CONTRACT BETWEEN THE CITY OF SALINAS AND ANDERSON PACIFIC ENGINEERING CONSTRUCTION FOR CONSTRUCTION SERVICES RELATED TO THE LAKE STREET EMERGENCY SEWER REPAIRS WHEREAS, on February 2, 2021, a wastewater backup and release of raw sewage occurred in Chinatown with subsequent analysis indicating that failure of a City sewer main and the risk of another sewage release was highly likely in the near future; and WHEREAS, engineering staff engaged Anderson Pacific Engineering Construction and Wallace Group, Inc. to begin preparations to perform the repair work on an emergency basis; and WHEREAS, the project developed into one broader in scope and complexity than staff, engineering or the contractor could have reasonably expected from the onset; and WHEREAS, these additional services require an amendment to the Contract with Andersen Pacific Engineering Construction in the amount of $1.1 million.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SALINAS, that the amendment to the Contract between the City of Salinas and Andersen Pacific Engineering Construction for construction services related to the Lake Street Emergency Sewer Repairs (Project No. 9302) in the amount of $1.1 million and extending the term of the agreement is hereby approved; and BE IT FURTHER RESOLVED that the City Council approves a transfer of $203,200 from 2301 Development Fees Sewer, and $896,800 from CIP 9853, to CIP 9302 (5800.50.9302-66.4000, Capital Outlays); and BE IT FURTHER RESOLVED that the City Council authorizes an increase of the CIP 9302, Lake Street Emergency Repairs, appropriation in the same amount of $1.1 million; and BE IT FURTHER RESOLVED that the Mayor of Salinas is hereby authorized and directed, for and on behalf of the City of Salinas, and as its act and deed, to execute the amendment to the contract between the City of Salinas, a Charter City, and Andersen Pacific Engineering Construction, a California Corporation; and BE IT FURTHER RESOLVED that the City Manager is authorized to execute extensions and/or non-substantive modifications to the Contract, as necessary.
