DATE: MARCH 22, 2022
DEPARTMENT: PUBLIC WORKS DEPARTMENT
FROM: DAVID JACOBS, DIRECTOR
THRU: HILDA GARCIA, PW ADMIN SUPERVISOR
TITLE: ACCEPTANCE OF GRANT OF EASEMENT FOR PUBLIC ROADWAY PURPOSES RECOMMENDED MOTION:

A motion to approve a Resolution accepting the Grant of Easement for public roadway purposes from the Santa Rita Union School District.

RECOMMENDATION:

Staff recommends that the City Council:

Accept the Grant of Easement for public roadway purposes from the Santa Rita Union School District; and Authorize the Mayor to execute the certificate of acceptance for the Grant of Easement; and Authorize the City Clerk to submit the Grant of Easement to the Monterey County Recorder for recordation.

BACKGROUND:

Staff is currently working on the Boronda Road Congestion Relief Project, which will widen East Boronda Road into a four-lane roadway (two lanes at each direction) with landscaped median, and bike lanes between Dartmouth Way and Independence Boulevard, and will include construction of multi-lane roundabouts at the intersections of McKinnon Street, El Dorado Drive, Natividad Road, and Independence Boulevard. The project will be constructed in phases. Phase 1 will construct the McKinnon Roundabout with the roadway widening, and associated improvements, from Dartmouth Way to a point between McKinnon and El Dorado.

During the research and review of the roadway dedications for the Phase 1 project, it was discovered that the strip of land fronting McKinnon Elementary School on which the existing McKinnon Street is now located, was not dedicated as a public roadway (location depicted in Exhibit A and Exhibit B of Grant of Easement). Consequently, staff worked with Santa Rita Union School District (SRUSD) staff and its attorney to dedicate the strip of land to the City of Salinas for public roadway and public utilities easement by way of a “Grant of Easement”, to rectify the public record system.

CEQA CONSIDERATION:

The environmental impacts of the Boronda Road Congestion Relief Project have been analyzed in accordance with CEQA guidelines. An Initial Study (IS) was prepared to evaluate the potential impacts associated with the project. Based upon review of the IS, the proposed project will not have a significant effect on the environment because the mitigation measures outlined in the Mitigation Monitoring and Reporting Program (MMRP) have been included in the project.

A Mitigated Negative Declaration (MND) was prepared for this project pursuant to the provisions of CEQA, and on November 3, 2020, the Salinas City Council adopted and approved the MND and MMRP for the project.

STRATEGIC PLAN INITIATIVE:

This item does not relate to the Council 2020-2023 Goals but rather an effort to rectify the public records system with regards to public infrastructure [link].

DEPARTMENTAL COORDINATION:

The City’s Legal, Community Development and Engineering Departments worked cooperatively to formulate the document and Engineering staff met and negotiated with SRUSD’s attorney on the language contained in the grant of easement.

FISCAL AND SUSTAINABILITY IMPACT:

There is no current fiscal impact associated with this issue.
