TITLE: EXTRATERRITORIAL WASTEWATER SERVICE AND REIMBURSEMENT AGREEMENTS BETWEEN CITY AND SALINAS 101 LLC AND PRE-ANNEXATION AGREEMENT WITH THE COUNTY OF MONTEREY RECOMMENDED MOTION:

A motion to approve resolutions authorizing the Mayor to:
execute an Extraterritorial Wastewater Service Agreement (Sewer Agreement) and associated Reimbursement Agreement (Agreements) with Salinas 101 LLC (Owner), and execute a Pre-Annexation Agreement with the County of Monterey for portions of Economic Development Element Economic Opportunity Area K (EDE EOA K).

RECOMMENDATION:

It is recommended that the City Council approve resolutions authorizing the Mayor to:
execute a Sewer Agreement and associated Reimbursement Agreement (Exhibit A and B to the resolution, Agreements) with Salinas 101 LLC (Owner) to establish the terms and conditions under which the City would allow connection to its wastewater collection and disposal system, and execute a Pre-Annexation Agreement with the County of Monterey for portions of EDE EOA K.

EXECUTIVE SUMMARY/BACKGROUND:

On March 22, 2022, the City Council considered approving resolutions authorizing the Mayor to execute the Agreements listed above. The Board of Supervisors approved the execution of the Pre-Annexation Agreement earlier that day. At the meeting, the City Council received staff’s presentation, asked questions, provided comments, and passed a motion to refer the item to the Housing and Land Use Committee (HLUC) for consideration of a recommendation to City Council. On March 29, 2022, the HLUC received staff’s presentation, asked questions, provided comments and passed a motion recommending that the City Council approve resolutions authorizing the Mayor to execute the three Agreements. This is a supplemental report to the March 22, 2022 City Council staff report. Both reports should be reviewed together as this report only focuses on the HLUC March 29th meeting and the Committee’s action.

DISCUSSION:

Information presented to the HLUC included an aerial showing the proposed project site in the context of surrounding uses and current County zoning designation (Light Commercial) and explanation that City policy requires an annexation application, support of future annexation or the development of farmworker housing as criteria for allowing connection to City’s collection and disposal system, the Sala Road proposed project cannot proceed without these Agreements in place, the high cost of infrastructure is a deterrent to development, especially smaller projects such as farmworker housing, construction of a new sewer line from the proposed project to the connection point at Russell Road would remove barriers for future development of EDE Target Area K and a proposed farmworker housing project to the north of the Sala Road project, and future annexation of Target Area K and the Sala Road project would lead to growth, development, and increased revenues for the city.

Based on the additional information presented and public comment received in support of the proposed Agreements, the HLUC unanimously passed a motion recommending City Council authorize the execution of the three Agreements. HLUC also requested that items, such as this be brought to the Committee prior to Council consideration. The video of the March 22, 2022 HLUC Meeting can be viewed here.
