EXECUTIVE SUMMARY:
On November 17, 2020, City Council approved Resolution No. 22000 awarding a construction contract to the Don Chapin Company, Inc. for the Bardin Road Safe Routes to School Improvements, Project No. 9218 in the amount of $7,941,211.00. Following execution of the contract and initiation of the project, construction of the project commenced on March 15, 2021.
BACKGROUND:
The Bardin Road Safe Routes to School Improvements (Bardin SRTS) project aims to transform Bardin Road into a multi-modal “complete street” corridor by improving pedestrian, bicycle, and vehicular facilities along Bardin Road, between Williams Road and Sconberg Parkway. Additionally, the project will improve the intersections at Bardin Road/East Alisal Street and at Sconberg Parkway/Alisal Road by constructing a double roundabout system. Creating a dedicated drop-off zone for Bardin Elementary School and channelizing through traffic to enhance student safety. The project adds buffered bicycle lanes along Bardin Road, between Williams Road and East Alisal Street, provides pedestrian ramps where none existed, and enhances crosswalks at key intersections within the project limits. The pavement along Bardin Road will be rehabilitated and a segment at East Alisal Street (between Tampa Street and east of Margaret Street) will receive slurry seal. The safety for all road users (pedestrians, bicyclists, and drivers) will be greatly improved by installing these improvements.
The Bardin SRTS project commenced on March 15, 2021 and is currently under construction with an anticipated completion of Summer 2022. To date, the contractor has completed approximately 65% of the contract work and has utilized approximately 65% of the contract time. The project has executed eight (8) Contract Change Orders, totaling a dollar amount of $96,834.00 or 12% of the authorized project contingency of $794,121.10 per Resolution 22000.
To date, all Contract Change Orders (CCO 1 thru CCO 8) have been within the signing authority as outlined by Department Policy 75-1 (Resolution No. 21528), see Table 1 for their respective dollar amounts.
Table 1: Contract Change Order Contingency Utilization Log Department Policy 75-1, Item 3, states City Council approval and authorization is required for Contract Change Orders of more than $100,000.00, or 10% of the total contract amount. Based on Department Policy 75-1, Contract Change Orders No. 9 and 10 require City Council approval prior to execution by the City Manager, their descriptions are as follows:
Contract Change Order No. 9 (CCO No. 9):
Due to excessively deteriorated asphalt in locations proposed to be slurry sealed by the original project scope, the contractor submitted a Request for Information (RFI) and recommended the areas deemed too deteriorated for surface treatment (slurry seal), be reevaluated or considered for a more long-lasting pavement rehabilitation method. At the direction of the City Engineer, the contractor removed portions of the area in question to determine if more extensive pavement rehabilitation was required. The project team determined the pavement was too deteriorated to be a good candidate for slurry seal as originally proposed. Typically, slurry sealing is a pavement preservation method, where the existing pavement is determined to be in fair or good condition. Based on field observations and findings, it was determined to extend the limits of full depth reclamation (FDR) along Alisal Road between Bardin Road and Margaret Street, eliminating the slurry seal and rehabilitating the roadway via FDR.
CCO No. 9 (Exhibit A) adjusts the originally planned roadway cross section from slurry sealing to full depth reclamation (FDR), extends the limits of the FDR, and adjusts the roadway section to meet City Standards. CCO No. 9 provides a credit for the contract price of the slurry seal. The total cost for CCO No. 9 is $275,244.00. There is no change to contract time for this change order.
Contract Change Order No. 10 (CCO No. 10):
The City issued Contract Change Order No 1 (CCO 1) upon discovery of unsuitable soils within Phase 1 of the Bardin SRTS Project pavement limits. Furthermore, CCO 1 anticipated the potential for unsuitable soils within future phases. At the conclusion of the work, additional material was needed to mitigate the unsuitable soils discovered in the Phase 2.
CCO No. 10 (Exhibit B), addresses the additional roadway excavation, off haul, disposal, and mitigation needed to complete the work due to the unsuitable soils discovered. The total cost for CCO No. 10 is $184,478.37. There is no change to contract time within this change order.
The combined total of CCO No. 9 and CCO No. 10 is $459,722.37. The addition of these two CCO’s would bring the new total for all project Contract Change Orders to date to $556,556.37 or 70% of the authorized 10% contingency amount, see Table 1.
City staff recommends City Council approve Contract Change Order No. 9 and 10 to the Don Chapin Company, Inc. for the Bardin Road Safe Routes to School Improvements, Project No. 9218, Federal Project ATPL-5045(031), in the amount of $275,244.00 and $184,478.37, respectively; and authorize the City Manager to execute all necessary documents related to Change Orders No. 9 and 10.
CEQA CONSIDERATION:
Statutory Exemptions. City of Salinas has determined that the project is exempt from the California Environmental Quality Act (CEQA) Guidelines (Section 15301(c) “Existing facilities”, Class1) because the project proposes to repair, maintain, and alter existing facilities. Class 1 categorically exempts the repair, maintenance, or minor alteration of existing public facilities involving negligible or no expansion of use beyond that existing at the time of the lead agency’s determination. Section 15301(c) of the CEQA Guidelines states that the types of “existing facilities” include, but are not limited to, existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails and similar facilities.
Furthermore, as a result of the federal grant, the project required compliance with the National Environmental Policy Act (NEPA). The State has determined that this project has no significant impacts on the environment as defined by the NEPA, and that there are no unusual circumstances as described in 23 CFR 771.117(b) and in 23 CFR 771.117(c): activity (c)(3).
STRATEGIC PLAN INITIATIVE:
The project supports City Council’s Goals of Infrastructure and Environmental Sustainability and Public Safety. These improvements incorporate low impact development (LID) features and provide “green streets” infrastructure while enhancing pedestrian safety and increasing connectivity, mobility, and access for transit users and pedestrians.
DEPARTMENTAL COORDINATION:
Public Works staff and Finance staff have collaborated on the funding of the Bardin Road Safe Routes to School Improvements Project.
FISCAL AND SUSTAINABILITY IMPACT:
There is no new funding being requested by the approval of CCO No. 9 or CCO No. 10 as they are within the authorized project contingency per Resolution No. 22000.
