TITLE: DIRECT PURCHASE OF POLICE EQUIPMENT
RECOMMENDED MOTION:
A motion to approve a Resolution authorizing the direct purchase of four 40MM Multi Launchers and accessories for a total cost not to exceed $16,278.46.
RECOMMENDATION:
Staff recommends that City Council approve the direct purchase of four 40MM Multi Launchers and accessories for a total cost not to exceed $16,278.46.
EXECUTIVE SUMMARY:
Assembly Bill 481, codified in Government Code sections 7070 through 7075 requires a law enforcement agency (LEA) to obtain approval from the applicable governing body prior to the funding, acquisition, or use of “Military Equipment” as defined by the Bill. As 40MM projectile launchers are defined as “Military Equipment” per AB 481, we are seeking City Council approval to purchase these items.
BACKGROUND:
Assembly Bill 481 – Military Equipment Funding, Acquisition, and Use, identifies the 40MM Projectile Launcher “Military Equipment” and as such requires City Council approved to purchase. Projectile launchers have been used by the Salinas Police Department for many years and was initially used exclusively by the SWAT Team. In recent years, the 40MM launcher was expanded to Patrol to ensure access to for field-based officers. The 40MM launcher affords the ability to use less lethal impact munitions (sponge rounds/foam batons) in conjunction with de-escalation tactics when feasible. This allows officer to address a threat from a greater distance and provides an alternative option for deadly force when reasonable. This can potentially prevent a deadly force encounter.
Use of 40MM Launchers requires special training, and all SPD officers are now qualified for use of this equipment. These four new projectile launchers, and the associated accessories and cases, will be used to expand access within the Patrol Division and to introduce to the Investigations Unit. We currently have nine 40MM launchers assigned to the Patrol Division and two of these new launchers will be specifically assigned to Patrol Sergeants to ensure quick access to this equipment. The remaining two 40MM launchers will be assigned to the Investigations Division for use during high-risk operations.
The department is requesting approval for the direct purchase of four 40MM Multi Launchers, with associated accessories and cases, for a total cost not to exceed $16,278.46. There are no local vendors for the purchase of the specialized police equipment indicated above. We have found LC Action to consistently provide the most competitive prices for specialized police equipment. The City Council has the authority to approve this direct purchase under Salinas Municipal code Section12-27 and without application of the local purchasing preference pursuant to Salinas Municipal Code Section 12-28.080.
POLICE COMMUNITY ADVISORY COMMITTEE:
The Police Chief and Sergeant James Godwin presented AB 481 – Military Equipment Funding, Acquisition, and Use to the Police Community Advisory Committee on March 30, 2022. The Committee was able to ask questions and provide comments. We will discuss this direct purchase request with the Police Community Advisory Committee at their next meeting on April 27, 2022.
CEQA CONSIDERATION:

STRATEGIC PLAN INITIATIVE:
Approving the purchase will support the City Council’s Strategic Plan Goal of Public Safety.
DEPARTMENTAL COORDINATION:
The Police Department and Legal Department have coordinated on the policy and requirements of Assembly Bill 481, and the Police Department will coordinate with the Finance Department during the purchasing process.
