RESOLUTION NO. (N.C.S.)
A RESOLUTION APPROVING A MASTER LICENSE AGREEMENT WITH UNDERLINE MONTEREY, LLC FOR THE INSTALLATION OF SMALL WIRELESS FACILITIES WITHIN THE PUBLIC RIGHT-OF-WAY WHEREAS, the Salinas City Council desires to improve access to broadband services through both wireless and direct connections; and WHEREAS, on December 14, 2021, the Salinas City Council adopted Resolution No. 22264 entering into a Network Deployment and Service Agreement with Underline Monterey, Inc. (“Underline”) to allow Underline to construct and operate an open-access broadband network within the City of Salinas; and WHEREAS, Underline desires to utilize City-owned infrastructure within the public right-of-way for the installation of Small Wireless Facilities; and WHEREAS, on April 2, 2019, the Salinas City Council adopted Resolutions 21580 and 21581 establishing regulations and fees to govern the permitting, inspection, and monitoring of Small Wireless Facilities within the City right-of-way; and WHEREAS, pursuant to the above, the City and Underline have negotiated a Master License Agreement for the use of City-owned facilities within the right-of-way for Small Wireless Facilities.
NOW, THEREFORE, BE IT RESOLVED that the Salinas City Council hereby approves the attached Master License Agreement and authorizes the City Manager to execute said Agreement on behalf of the City of Salinas.
