RESOLUTION NO. (N.C.S.)
A RESOLUTION APPROVING AN AMENDED AND RESTATED AGREEMENT FOR SERVICES BETWEEN THE CITY OF SALINAS AND ANDERSON PACIFIC ENGINEERING CONSTRUCTION RELATED TO THE EAST LAKE STREET EMERGENCY REPAIR WORK WHEREAS, on February 2, 2021, a wastewater backup and release of raw sewage occurred in Chinatown with subsequent analysis indicating that failure of a City sewer main and the risk of another sewage release was highly likely in the near future; and WHEREAS, engineering staff engaged Anderson Pacific Engineering Construction and Wallace Group, Inc. to begin preparations to perform the repair work on an emergency basis; and WHEREAS, the project developed into one broader in scope and complexity than staff, engineering or the contractor could have reasonably expected from the onset; and WHEREAS, these additional services required amendments to the agreement with Anderson Pacific Engineering Construction bringing the amended total to $4,667,362; and WHEREAS, the current agreement is expired and an Amended and Restated Agreement is required in order to make adjustments to the purchase order with Anderson Pacific Engineering Construction; and WHEREAS, staff has determined funds encumbered on this purchase order may be reduced by $79,500.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF SALINAS, that the Amended and Restated Agreement for Services between the City of Salinas and Anderson Pacific Engineering Construction for construction services related to the East Lake Street Emergency Repair Work (Project No. 9302) in the amount of $4,587,862 is hereby approved; and BE IT FURTHER RESOLVED that the Mayor of Salinas is hereby authorized and directed, for and on behalf of the City of Salinas, and as its act and deed, to execute the amendment to the contract between the City of Salinas, a Charter City, and Anderson Pacific Engineering Construction, a California Corporation; and BE IT FURTHER RESOLVED that the City Manager is authorized to execute extensions and/or non-substantive modifications to the Contract, as necessary.
