RESOLUTION NO. (N.C.S.)
A RESOLUTION APPROVING A CONTRACT CHANGE ORDER FOR
ROW DELAY CLAIM TO THE DON CHAPIN COMPANY IN THE AMOUNT OF $117,745.29 AND AUTHORIZING THE CITY MANAGER TO
EXECUTE ALL NECESSARY DOCUMENTS RELATED TO THE
ROW DELAY CLAIM CHANGE ORDER
WHEREAS, On November 17, 2020, City Council approved Resolution 22000 awarding a construction contract to the Don Chapin Company, Inc. for the Bardin Road Safe Routes to School Improvements, Project No. 9218 in the amount of $7,941,211.00; and WHEREAS, construction of the project commenced on March 15, 2021; and WHEREAS, there was a redesign of the roadway section along Bardin Road between E Alisal St and Williams Rd due to the discovery of shallow utilities which caused a delay to the project and stopped construction for a period of time; and WHEREAS, the redesign triggered ROW delay costs per the project contract documents; and WHEREAS, the total ROW delay costs incurred for the period claimed by the Don Chapin Company per the Caltrans rates and delay factors is $117,745.29; and WHEREAS, Department Policy 75-1 (Resolution No. 21528), states all Contract Change Orders above $100,000 or above 10% of the contract amount require Council Authorization.
NOW, THEREFORE, BE IT RESOLVED that the City Council approves a contract change order for ROW delay claim to the Don Chapin Company Inc. in the amount of $117,745.29 for the Bardin Safe Routes to School Project, CIP 9218 and authorize the City Manager to execute all necessary documents related to the Change Order.
