DATE: FEBRUARY 21, 2023
DEPARTMENT: CITY ATTORNEY’S OFFICE

POLICE SERVICE OF SALINAS
FROM: JIM PIA, ASSISTANT CITY MANAGER
CHRISTOPHER A. CALLIHAN, CITY ATTORNEY

TONYA ERICKSON, POLICE SERVICES ADMINISTRATOR
TITLE: TRANSFER OF ANIMAL SERVICES VEHICLES TO COUNTY OF MONTEREY RECOMMENDED MOTION:

It is recommended that the City Council approve a Resolution authorizing the transfer of City-owned vehicles, previously used for animal control services, to the County of Monterey to support the formation and the operation of the Hitchcock Road Animal Services Agency.

EXECUTIVE SUMMARY:

On December 13, 2022, the City Council approved a Joint Exercise of Powers Agreement establishing the Hitchcock Road Animal Services Agency. This action was the latest in a series of actions to end the City’s provision of animal services and to coordinate and combine such services with the County of Monterey, and ultimately, with any of our local jurisdictions that would like to join. Through this series of actions, the City and the County are able to eliminate the duplication of efforts and inefficiencies in the provision of such services. Under existing agreements, the County will provide animal control services within the city limits until the joint powers agency is fully-formed and operational. With the City no longer directly providing animal control services, the City no longer needs the Animal Services Vehicles within its fleet; however, as the County, and ultimately the joint powers agency, will provide those services, those agencies do and will have a need for such vehicles.

BACKGROUND:

The City currently owns and maintains several vehicles previously used to provide animal control services within the city. With the City no longer providing such services, it no longer has a need to maintain such vehicles within its fleet. The County is currently providing animal control services within the city until the joint powers agency is fully-formed and operational, at which time the joint powers agency will take on the role and the responsibility for providing such services. In order to provide the County, and ultimately the joint powers agency, with vehicles needed to provide such services, the proposed action is to transfer the City’s animal control services vehicles to the County. This transfer will include the following vehicles:
2017 Ford F-250 Super Duty Truck, with Deerskin Mfg Animal Control Unit; VIN 1FTBF2A65HEB93051; License Plate No. 1292137 2019 Ram 3500 Truck, with Deerskin Mfg Animal Control Unit; VIN 3C7WR8AJ6KG720314; License Plate No. 1582062 Additional miscellaneous equipment was previously used by Salinas Animal Control and which has been identified as unnecessary for City purposes, but which can support the County and JPA’s provision of animal services within the city. This additional equipment is also proposed to be transferred to the County:

1 CEQA CONSIDERATION:

Not a Project.  The City of Salinas has determined that the proposed action is not a project as defined by the California Environmental Quality Act (CEQA) (CEQA Guidelines Section 15378). In addition, CEQA Guidelines Section 15061 includes the general rule that CEQA applies only to activities which have the potential for causing a significant effect on the environment.  Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.  Because the proposed action and this matter have no potential to cause any effect on the environment, or because it falls within a category of activities excluded as projects pursuant to CEQA Guidelines section 15378, this matter is not a project.  Because the matter does not cause a direct or foreseeable indirect physical change on or in the environment, this matter is not a project.

STRATEGIC PLAN INITIATIVE:

Approving the proposed resolution will support the City Council’s Strategic Plan Goals related to Effective and Culturally Responsive Government. The Strategic Plan can be viewed here [link].

DEPARTMENTAL COORDINATION:

Administration, Legal, and Police Coordinated on this effort.

FISCAL AND SUSTAINABILITY IMPACT:

There is no impact to the City’s General Fund with the City Council’s approval of the proposed Resolution, other than the one-time loss of vehicle assets. Based upon the combined depreciated value of the vehicles as of June 30, 2022, this loss would be approximately $37,700. With the City Council’s approval of the proposed Resolution, the two vehicles identified in this Report will be removed from the City’s fleet and the City will be relieved from all responsibility and maintenance of these vehicles, thereby resulting in an associated reduction in cost to the City.
