ROOM RENTAL AGREEMENT
BETWEEN MARINA HOTELS CI, LLC,
AND CITY OF SALINAS

This Amendment No. 2 to the Room Rental Agreement (Amendment) is entered into this 21st day of March, 2023, by and between the City of Salinas (City) and Marina Hotels Ci, LLC, (Owner). City and Owner may be individually referred to herein as a “Party” and collectively the City and Owner may be referred to as the “Parties.”
RECITALS
WHEREAS, the City and Owner first entered into a Room Rental Agreement effective October 1, 2022, pursuant to which Owner agreed to act as and provide certain services to the City for compensation (Agreement); and WHEREAS, the City and Owner entered into Amendment No. 1 on January 27, 2023 to extend term of services commence October 1, 2022 and ending on April 30, 2023; and WHEREAS, the City and Owner desire to increase the Agreement amount by $250,000 through this Amendment No.2, using Encampment Resolution Grant and City ARPA funds.
NOW, THEREFORE, in mutual consideration of the terms and conditions set forth below, the Parties agree as follows:
TERMS
The Agreement sections below will be amended as follows:
Section 3 “RENT” is revised to read as follows:
As consideration for the use of rooms within the Premises, City agrees to pay to the Owner the total amount of seventy-three dollars ($73.00) per day per room actually used by the City for the Program, plus damages to rooms. The total amount of consideration to be paid to the Owner through the Initial Term of this Agreement shall not exceed Nine Hundred and Seven Thousand and zero cents ($907,000.00).
All other covenants, terms, and conditions set forth in the Original Funding Agreement and Amendment No. 1 which are not herein amended, shall remain in full force and effect as if fully set forth herein.
