A RESOLUTION ACCEPTING THE CERTIFICATE OF CORRECTION FOR THE PARCEL MAP RECORDED AS VOLUME 12 OF PARCEL MAPS AT PAGE 75 IN THE COUNTY OF MONTEREY TO DELETE THE AREA DESIGNATED AS “1.0 ACCESS DENIAL” IN ACCORDANCE WITH SECTIONS 66469 & 66472.1 OF THE SUBDIVISION MAP ACT WHEREAS, in 2022, staff met with the development team of 1012 and 1016 Abbott Street and, WHEREAS, the proposed site plan requires access along East Blanco Road to facilitate internal circulation; and, WHEREAS, the subject parcels were created through a parcel map recorded as Volume 12 Parcel Maps at Page 75 in the County of Monterey; and, WHEREAS, said Parcel Map contains a “1.0 access denial” segment along the frontage of East Blanco Road; and WHEREAS, the map does not specifically dedicate the “access denial rights”; and WHEREAS, the map does provide acceptance of the “access denial rights”; and WHEREAS, the “access denial rights” are no longer appropriate or necessary; and WHEREAS, modification of the “access denial rights” does not impose any additional burden on the fee owners; and WHEREAS, the map is consistent with the General Plan, the zoning code and the Subdivision Map Act; and WHEREAS, the proposed site plan is consistent with Salinas Municipal Code section 31-401.10; and WHEREAS, the map would not result in violations to the Salinas City Codes.
NOW, THEREFORE, BE IT RESOLVED BY THE SALINAS CITY COUNCIL that pursuant to Salinas Municipal Code sections 31-1202 and 31-401.10 the City Council accepts the Certificate of Correction for the parcel map recorded as Volume 12 of Parcel Maps at Page 75 in the County of Monterey to delete the area designated as “1.0 access denial” in accordance with 66469 & 66472.1 of the Subdivision Map Act.
