TITLE: CERTIFICATE OF CORRECTION FOR THE PARCEL MAP RECORDED IN THE COUNTY OF MONTEREY AS VOLUME 12 OF PARCEL MAPS AT PAGE 75 RECOMMENDED MOTION:
A motion to approve a Resolution accepting the Certificate of Correction for the parcel map recorded as Volume 12 of Parcel Maps at Page 75 in the County of Monterey to delete the area designated as “1.0 access denial” in accordance with Sections 66469 & 66472.1 of the Subdivision Map Act.
EXECUTIVE SUMMARY:
As part of a preapplication review with the developer of 1012 and 1016 Abbott St, staff received a request to delete the strip of land designated as “1.0 access denial”. The contract City Surveyor and staff have reviewed the request and made findings in accordance with Sections 66469 & 66472.1 of the Subdivision Map Act.
BACKGROUND:
On September 21, 2022, staff met with the development team of 1012 and 1016 Abbott St. The proposed development requires access along East Blanco Road to facilitate internal circulation. The proposed site plan was reviewed by staff and access along East Blanco Road was determined to be acceptable. Development of the site will require a lot consolidation of two parcels, APN 002-881-043 and 002-881-015. The parcels were created in 1978 through a parcel map recorded in the County of Monterey as Volume 12 Parcel Maps at Page 75. Said map identified a “1.0 access denial” segment along the East Blanco Road frontage. A review of the map was found to contain errors that the applicant would like to correct to delete the “1.0 access denial”. The following findings were made:
The map does not specifically dedicate the “access denial rights”.
The map does not provide acceptance of the “access denial rights”.
In accordance with Section 66472.1 of the Subdivision Map Act, a determination needs to be made that the “access denial rights” are no longer appropriate or necessary and that the modification does not impose any additional burden on the fee owners.
Staff has determined that the access denial rights are no longer necessary, and modification of the access denial rights do not create a burden on the fee owners. Deletion of the “1.0 access denial” area would facilitate the redevelopment two parcels that contain a shuttered business and vacant lot.
