Gentlemen/Ladies:
Pursuant to the foregoing Notice to Bidders, the undersigned hereby proposes and binds himself/herself on award by the City Council under this Proposal to execute in accordance with such award, a Contract with necessary bonds of which this Proposal, the Notice to Bidders and the Plans and the Specifications, shall be a part, to furnish any and all required labor, material, and services for performing and completing the work set forth in the said Specifications and shown on the Plans accompanying them, within the time hereinafter set forth and at the prices named in this Proposal as follows:

In case of discrepancy between the item price and the total set forth for a unit basis item, the item price hall prevail, provided, however, it the amount set forth as an item price is ambiguous, unintelligible or uncertai or any cause, or is omitted, or is the same amount as the entry in the "Total" column, then the amount set fort in the "Total" column for the item shall prevail and shall be divided by the estimated quantity for the item and the price thus obtained shall be the item price.
Contractor shall provide a schedule of values for all lump sum items of work listed in the Proposal and noted in the Special Provisions. The schedule of values shall be submitted to the City Engineer for approval within 5 calendar days after the Contract has been awarded.
Selection of a firm will be based upon the information provided in the response to this RFP. The City reserves the right to award this contract not necessarily to the contractor with the lowest cost proposal, but to the contractor that provides the best overall match to the service specifications, and which best serves the interest of the City NOTE: For Proposal to be VALID: (1) the Prosper must submit all completely executed and signed City of Salinas forms; (2) the Contractor and all Subcontractors shall have valid, current and active Contractor's license(s) for the classification(s) of work performed; and (3) the Contractor and all Subcontractors must possess and maintain a Public Works Contractor Registration with the DIR pursuant to Labor Code section 1725.5, and the licenses) must be valid at the time Contract is awarded and throughout the Contract as approved by Council.
It is expressly understood and agreed that this Bid shall have the following documents completed, all of which are incorporated into and made a part hereof. The following information shall be submitted with the Bid Proposal on the Bid Opening Date:

If the Bidder's Statement of Subcontractors - Part I is not submitted, it shall be assumed that the Contractor shall do all the prospective Contractors website

The highest ranked and second highest ranked Bidders shall be notified to submit the original BID Documents (items 1-17) and the following forms (items 18 thru 21), fully completed, to the Public Works Department, City of Salinas, within 5 working days after notification.

Failure to comply with these requirements may result in the forfeiture of the Bidder's rank in the Bid process.
The selected Bidder shall submit the following Federal forms, fully completed, to the Public Works Department, City of Salinas, on an annual basis until project completion. The Documents to be completed and submitted are the following:

34. Semi-Annual Labor Standards Enforcement Report - Local Contracting Agencies (HUD Form 4710)
The City shall award the contract to the Bidder, that meets the REP's criteria, if a contract is awarded. This does not preclude the City from adding to or deleting from the contract, any of the bid items after the highest ranked bidder had been determined. The City further reserves the right to award or reject the Base Bid or any items) within, depending on available funding.
Also, the award of the Contract, if it be awarded, shall be to the Bidder that meets the RFP's criteria whose Proposal complies with all the requirements prescribed and who has met the goal for Minority/Women Business Enterprises (M/WBE) participation or has demonstrated, to the satisfaction of the City of Salinas, adequate good faith efforts to do so. Meeting the goal for (M/WBE) participation or demonstrating to the satisfaction of the City of Salinas, adequate good faith efforts to do so is a condition for being eligible for award of Contract.
All prospective Bidders shall use Caltrans' MBE/WBE listing which is available on the website address http://www.dot.ca.gov/hq/bep/.
The successful Bidder and all Subcontractors must have a valid City of Salinas business license before the commencement of work.
Except as may otherwise be provided herein, all work to be done under this Contract shall conform to the applicable requirements of the Standard Specifications, Design Standards and Standard, updated March 2017, City of Salinas-Public Works Department, the 2018 State of California, Department of Transportation, Standard Specifications (For Construction of Local Streets and Roads), and the 2019 California Building Code.
The undersigned understands that the quantities given are approximate only, being given as a basis for the comparison of Bids, and the City of Salinas does not, expressly or by implication, agree that the actual amount of work shall correspond therewith, but reserves the right to increase or decrease the amount of any portion of the work, or to omit portions of the work, as may be deemed necessary or advisable by the City Engineer without claim for damage or loss of anticipated profit and that payment shall be made only on the basis of the actual quantities of work performed.
Each Bid shall be in accordance with the Plans and Specifications, submitted on the Proposal form furnished and accompanied by a certified or cashier's check or Bid Bond made payable to the City of Salinas, for an amount equal to at least ten percent (10%) of that amount of the Bid, such guaranty to be forfeited should the Bidder to whom the Contract is awarded fail to enter into the Contract within 15 calendar days after notification of the award of Contract to the Bidder. The Contractor shall diligently prosecute the work to completion on or before the expiration of 75 Working Days
The undersigned agrees, if awarded the Contract, that there shall be paid by the undersigned and by all Subcontractors under him/her, to all laborers, workmen and mechanics employed in the execution of such 18 DocuSign Envelope ID: 274E01CE-80A2-405C-BOCD-27F7D734E891 PROPOSAL - Cont.
Contract or any Subcontract thereunder, not less than the general prevailing rate of per diem wages, and rates for overtime and legal holidays in the locality in which the work is to be performed, as ascertained and determined, pursuant to the state statute thereto applicable, by the City Council, the schedule thereof being set forth in the advertisement for Bids and in the Specifications for said work.
The undersigned further agrees that all work to be done under this Contract shall be done in accordance with the provisions of that certain form of Agreement attached hereto and hereby made a part of these Specifications.
Enclosed herein is a (Bidder's bond, certified check, or cashier check) for not less than 10% of the total amount of the Proposal and the undersigned agrees that, in case of his/her default in executing the Contract and the necessary bonds after award and due notice thereof, the said check or bond and the money payable thereon shall become and remain the property of the City of Salinas as liquidated damages.
All questions about the meaning or intent of the Contract documents shall be submitted to the City of Salinas through the project page on the Planet Bids website. Replies shall be issued by Addenda electronically on-line through the PlanetBids Vendor Portal website and ONLY to Bidders who are registered Prospective Bidders for this project. QUESTIONS RECEIVED AFTER MARCH 07 BY 2PM SHALL NOT BE ANSWERED. Only questions answered by Addenda shall be binding. Oral and other interpretations or clarifications shall be without legal effect.
Any and all Addenda to the Plans and/or Specifications shall be signed and attached hereto this Proposal.
For any money earned by the Undersigned and withheld by the City of Salinas, to insure the performance of the Contract, the Undersigned may, at his/her request and expense, substitute securities equivalent to the amount withheld in the form and manner and subject to the conditions provided in Section 22300 of the Public Contracts Code of the State of California.
