TITLE: MASTER SERVICES AGREEMENTS FOR ON-CALL MATERIAL
TESTING SERVICES
RECOMMENDED MOTION:
A motion to aspprove a Resolution approving Master Service Agreements with Earth Systems Pacific, Twining, Inc., and Moore Twining Associates, Inc., to provide on-call material testing services for various City of Salinas Public Works Capital Improvement Projects (CIPs).
BACKGROUND:
Capital Improvement Projects (CIPs) require construction inspection to ensure compliance with project plans and specifications. On April 14, 2021, the City Council approved a resolution for the Quality Assurance Program (QAP) (Resolution No. 22078). The QAP is a program that requires testing of materials to ensure construction materials conform to the plans and specifications. Testing may require materials sampling or testing both onsite and offsite. Thus, to facilitate the efficient completion of Public Works projects, there is a need to have on-call consultant contracts (Master Services Agreements) with material testing firms. A request for qualifications (RFQ) for interested material testing firms was advertised in February 2023, and submittals were received from five firms. The firms submitting qualification statements were:
Apex Testing Laboratories (San Francisco, CA)
Earth Systems Pacific (Salinas, CA)
Moore Twining Associates, Inc. (Sand City, CA)
Ninyo & Moore Geotechnical & Environmental Sciences Consultants (San Jose, CA) Twining, Inc. (Concord, CA)
The submittals were reviewed based on the selection criteria listed in the RFQ document that included:
1) Firm Profile
2) Quality of Staff/Project Team
3) Relevant Project Experiences and References
4) Demonstrated Technical Ability
5) Local Purchasing Preference (10% of total earned points) Based on these criteria, the review panel comprising of four City staff selected Earth Systems Pacific, Twining, Inc., and Moore Twining Associates, Inc., as the three top-ranked firms to provide material testing services, for a five-year term, under a Master Services Agreement with the City of Salinas. Under the terms of the Master Services Agreement, compensation will be provided on a project-by-project basis, with each project subject to review and approval by the City Engineer. Consultants will be awarded projects based on a request for proposal process amongst the on-call consultants.
CEQA CONSIDERATION:
Not a Project. The City of Salinas has determined that the proposed action is not a project as defined by the California Environmental Quality Act (CEQA) (CEQA Guidelines Section 15378). In addition, CEQA Guidelines Section 15061 includes the general rule that CEQA applies only to activities which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Because the proposed action and this matter have no potential to cause any effect on the environment, or because it falls within a category of activities excluded as projects pursuant to CEQA Guidelines section 15378, this matter is not a project. Because the matter does not cause a direct or foreseeable indirect physical change on or in the environment, this matter is not a project. Any subsequent discretionary projects resulting from this action will be assessed for CEQA applicability.
STRATEGIC PLAN INITIATIVE:
This item relates to the current City Council Goal of Infrastructure and Environmental Sustainability. Approval of the Master Services Agreements will assist towards the efficient and effective process to complete projects that benefit the community.
