545 WORK STREET LP AT 545 WORK STREET TO THE CITY OF SALINAS WHEREAS, in July 2020 the California Department of Housing and Community Development (HCD) released a Notice of Funding Availability for the Homekey Program, which provides funding in partnership with public agencies to develop permanent housing for people experiencing homelessness; and WHEREAS, on October 13, 2020, the Salinas City Council authorized a resolution to enter into a Co-Application through HCD with Shangri-La Industries, LLC (Shangri-La) and Step Up on Second, Inc. (Step Up) to acquire the Good Nite Inn Hotel located at 545 Work Street (Property) (Resolutions No. 21963 and 21964) and convert it to permanent housing for the chronically homeless.

In addition, CEQA Guidelines Section 15061 includes the general rule that CEQA applies only to activities which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. Because the proposed action and this matter have no potential to cause any effect on the environment, or because it falls within a category of activities excluded as projects pursuant to CEQA Guidelines section 15378, this matter is not a project. Because the matter does not cause a direct or foreseeable indirect physical change on or in the environment, this matter is not a project. Any subsequent discretionary projects resulting from this action will be assessed for CEQA applicability; and NOW, THEREFORE, BE IT RESOLVED that the Salinas City Council accepts the Quitclaim Deed from the 545 Work Street LP for a portion of certain real property located at 545 Work Street, and more particularly described on Exhibit A of the Quitclaim Deed (attached and incorporated herein); and BE IT FURTHER RESOLVED, the Mayor of Salinas is hereby authorized and directed to execute the Certificate of Acceptance, transferring the rights, title and interest in that portion of land described in the Quitclaim Deed located at 545 Work Street to the City of Salinas.
