RESOLUTION NO. 22259 (N.C.S.)
ACCEPTANCE OF MONTE BELLA SUBDIVISION PHASE 5B PUBLIC
IMPROVEMENTS FOR MAINTENANCE AND RESPONSIBILITY AND
ACCEPTANCE OF THE FOLLOWING STREETS INTO THE CITY’S STREET SYSTEM: ETNA CIRCLE, NAPOLI CIRCLE, MARSALA CIRCLE, PALERMO DRIVE AND PALERMO COURT.
WHEREAS, on June 19, 2018 City Council adopted Resolution No. 21418 approving the subdivision improvement agreement and the Final Map for Monte Bella Subdivision Phase 5B ; and
WHEREAS, the Monte Bella Subdivision, Phase 5B Final Map was recorded in the Office of the Recorder of Monterey County in Volume 24 of Cities and Towns at Page 60 as Tract No. 1538; and
WHEREAS, the public improvements required by the improvement plans entitled “Improvement Plans Monte Bella Phase 5B”, approved by the City Engineer on May 2, 2018 were completed by KB Home in substantial conformance with the approved improvement plans; and
WHEREAS, the Subdivision Improvement Agreement states that a Guarantee and Warranty period of one year will remain a fter acceptance of the improvements by City Council; and
WHEREAS, Section 1806 of the California Streets and Highways Code provides that no public street shall become a City street until it is accepted into the City’s street system by resolution of the governing body; and
WHEREAS, the majority of the maintenance costs will be incorporated into and paid by the Monte Bella Maintenance District; and
WHEREAS, the project did not qualify for any exemptions to the categorial exemptions found in CEQA Guidelines Section 15300.2. On February 9, 1999 the project was determined to have significant effect on the environment and an Environmental Impact Report was prepared.
Mitigation measures were prepared for this project pursuant to the provisions of CEQA and a Statement of Overriding Considerations was adopted. The findings were made pursuant to Section 21081 of the Public Resources Code.
NOW, THEREFORE, BE IT RESOLVED that the Salinas City Council accepts the streets, as shown on the Monte Bella Subdivis ion, Phase 5B Final Map, and street improvements into the City’s street system.
