A RESOLUTION OF THE CITY OF SALINAS CITY COUNCIL CONCURRING WITH ITS HOMEKEY PROJECT PARTNERS ON THE CHANGE OF OWNERSHIP FOR EACH OF ITS HOMEKEY PROJECTS TO THAT OF OFFICIALLY RECORDED OWNER AND AUTHORIZING THE CITY MANAGER OR DESIGNEE TO EXECUTE ANY REQUIRED AMENDMENTS OR DOCUMENTS AS DEEMED NECESSARY BY THE STATE TO INCORPORATE THE CHANGE OF OWNERSHIP, AS OFFICIALLY RECORDED, ON EACH APPLICABLE HOMEKEY PROJECT PROPERTY; AND AUTHORIZING THE SUBMISSION OF THREE SEPARATE, APPLICABLE STATE OF CALIFORNIA DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT RESOLUTIONS CONCURRING WITH THE CHANGE OF OWNERSHIP, AS OFFICIALLY RECORDED, ON EACH HOMEKEY PROPERTY AND ALLOWING ITS INCLUSION IN THE APPLICABLE HCD STANDARD AGREEMENT AS A HOMEKEY PROJECT PARTNER WHEREAS, on July 16, 2020, the California Department of Housing and Community Development (HCD) issued a Notice of Funding Availability (NOFA) for the Round 1 Homekey Program grant funds pursuant to Health and Safety Code section 50675.1.1 (Assembly Bill No. 83 (2019-2020 Reg. Sess.); and WHEREAS, on August 13, 2020, the City of Salinas (City), Step Up on Second Street, Inc. (Step Up), and Shangri-La Industries LLC (SLI) jointly submitted a Round 1 Homekey Program application to purchase and convert the property located at 545 Work Street into interim housing for the first year and for permanent supportive housing thereafter for people experiencing chronic homelessness; and WHEREAS, on September 17, 2020, the City, Step Up, and SLI were notified by HCD that Round 1 Homekey Program funds had been awarded for the Step Up in Salinas Homekey Project; and WHEREAS, on November 18, 2020, 545 Work Street, LP, a Delaware Limited Partnership, officially recorded ownership of the 545 Work Street project property; and WHEREAS, on November 30, 2020, the City, Step Up, SLI, and HCD entered into a Standard Agreement (20-HK-00132) for the purchase and rehabilitation of the Step Up in Salinas Homekey Project located at 545 Work Street; and WHEREAS, on September 9, 2021, HCD issued a NOFA for the Round 2 Homekey Program grant funds pursuant to Health and Safety Code section 50675.1.3 (Assem. Bill No. 140 (2021-2022 Reg. Sess.), § 20.); and WHEREAS, on February 16, 2022, the City, Step Up, and SLI were notified by HCD that Round 2 Homekey Program funds had been awarded for both the Step Up on Fairview and Step Up on Sanborn Homekey projects; and WHEREAS, on March 16, 2022, the City, Step Up, SLI, and HCD entered into a Standard Agreement (21-HK-17097) for the purchase and rehabilitation of the Step Up on Fairview Homekey Project located at 1030 Fairview Avenue; and WHEREAS, on March 17, 2022, the City, Step Up, SLI, and HCD entered into a Standard Agreement (21-HK-17100) for the purchase and rehabilitation of the Step Up on Sanborn Homekey Project located at 180 S. Sanborn Road; and WHEREAS, On March 22, 2022, 1030 Fairview LP, a Delaware Limited Partnership, officially recorded ownership of the 1030 Fairview Avenue project property; and WHEREAS, On April 6, 2022, 180 Sanborn LP, a Delaware Limited Partnership, officially recorded ownership of the 180 S. Sanborn Road project property; and WHEREAS, HCD has requested that the City, Step Up, and SLI provide an appropriate State resolution from its governing body authorizing the inclusion of the official ownership entity of record for each Homekey project property on the Standard Agreement for each of the Homekey projects through submission of an applicable State HCD Resolution; and NOW, THEREFORE, BE IT RESOLVED that the Salinas City Council concurs with its Homekey project partners, SLI and Step Up, on the change of ownership executed on each of its Homekey project properties and authorizes the City Manager or designee to execute any required amendments or documents deemed necessary by the State to incorporate the change of ownership, as officially recorded, on each applicable Homekey property; and BE IT FURTHER RESOLVED that the Salinas City Council approves the submission of a State of California Department of Housing and Community Development Resolution concurring with the change of ownership for 545 Work Street to 545 Work Street, LP, a Delaware Limited Partnership, and allowing its inclusion in the HCD Standard Agreement as a project partner for the Step Up in Salinas Homekey project as required by HCD regulations; and BE IT FURTHER RESOLVED that the Salinas City Council approves the submission of a State of California Department of Housing and Community Development Resolution concurring with the change of ownership for 1030 Fairview Avenue to 1030 Fairview LP, a Delaware Limited Partnership, and allowing its inclusion in the HCD Standard Agreement as a project partner for the Step Up on Fairview Homekey project as required by HCD regulations; and BE IT FURTHER RESOLVED that the Salinas City Council authorizes the submission of a State of California Department of Housing and Community Development Resolution concurring with the change of ownership for 180 S. Sanborn Road to 180 Sanborn LP, a Delaware Limited Partnership, and allowing its inclusion in the HCD Standard Agreement as a project partner for the Step Up on Sanborn Homekey project as required by HCD regulations.
