RESOLUTION NO. (N.C.S.)
A RESOLUTION OF THE SALINAS CITY COUNCIL APPROVING CONTRACT CHANGE ORDERS 3, 4, 5, 6, 7, AND 8 TO HA CONSTRUCTION FOR THE NATIVIDAD CREEK PARK RESTROOM REHABILITATION PROJECT (CIP 9346) WHEREAS, through its HUD FY 2019-20 Annual Action Plan, the Salinas City Council allocated CDBG Entitlement Funds towards the rehabilitation of the Natividad Creek Park Restroom Rehabilitation Project - CIP 9346 (Project); and WHEREAS, on June 20, 2023, through Resolution No. 22724, City Council accepted the bid and awarded the Natividad Creek Park Restroom Rehabilitation Project (CIP 9346) to HA Construction in the amount of $151,000; and WHEREAS, on September 20, 2023, the Construction Contract for the Project was fully executed; and WHEREAS, on November 20, 2023, the Project started construction; and WHEREAS, as the General Contractor started construction, unknown conditions were uncovered with the Project and Project site as well as design elements that needed to be adjusted and/or were missed during the design phase; and WHEREAS, the Project had a construction contingency of $30,200 which allowed the project manager, Community Development Director, City Engineer, and Interim City Manager to approve Contract Change Orders 1 and 2; and WHEREAS, Change Orders 3, 4, 5, 6, 7, and 8, require the construction contract with HA Construction to be increased to $220,355.19; and WHEREAS, the Project’s construction contingency will also need to be increased to $44,070.81, to support any additional change orders through Project completion; and WHEREAS, with the increased Project contingency, Contract Change Orders (1 through 8), and the original construction contract with HA Construction, the total construction cost will be increased to $264,426.00; and WHEREAS, the City of Salinas has determined that the project is exempt from the California Environmental Quality Act (CEQA) Guidelines Section 15301 Existing Facilities, Class I (a)(c)(d)(g) as the Project proposes rehabilitation of an existing public restroom facility; and WHEREAS, on April 6, 2021, the CEQA Notice of Exemption for the Project was completed and filed with the County of Monterey; and NOW, THEREFORE, BE IT RESOLVED that the Salinas City Council hereby approves Contract Change Orders 3, 4, 5, 6, 7, and 8 to the HA Construction contract for the Natividad Creek Park Restroom Rehabilitation Project (CIP 9346) in the amount $39,465.19; and BE IT FURTHER RESOLVED that the Salinas City Council hereby approves an increase of the Project’s contingency to $44,070.81, for the Natividad Creek Park Restroom Rehabilitation Project (CIP 9346); and BE IT FURTHER RESOLVED that the Salinas City Council hereby authorizes the City Manager or designee to execute any necessary revisions, amendments and/or change orders applicable to the Natividad Creek Park Restroom Rehabilitation Project as needed.
